Civil Service Rule Revision A memo was sent to Commissioners in advance of the
meeting explaining the Fire Chief's rationale for changing
Rule IX. Eligibility Lists. Assistant Chief Linton
advocated a separate rule for Police as it relates to
determining seniority for officers starting employment on
the same day. Chair Sivak noted that seniority is further
explained in Rule XII, Section 2 regarding Layoffs.
Commissioners inquired whether Civil Service Rules or
Collective Bargaining Agreement language would guide
decisions in the event of layoffs. Kim confirmed that
language in Collective Bargaining Agreements would rule,
and offered to bring copies of the respective sections
defining seniority and layoffs to the November meeting.
Commissioners also recommended that the revision be
made in draft form and reflect the Chief's changes in both
Rule IX and Rule XII for greater clarity. Commissioners
discussed whether a rule of three could be violated if
specifically addressed and agreed upon in the Civil Service
Rules.
