UNDERGROUNDING AGREEMENT
WAIVER TO UNDERGROUNDING ORDINANCE
OBLIGATION FOR FUTURE UNDERGROUNDING
In accordance with the Tukwila Municipal Code, COMCAST of Washington's proposed
aerial over -lash of 1083' of fiber located within the City of Tukwila right -of way along
Interurban Ave S between 42id Ave S and Gateway Dr requires undergrounding.
The undergrounding requirement is hereby waived provided that COMCAST of
Washington agrees to participate in future undergrounding improvements for its
proportionate share of the undergrounding costs. Furthermore, if the L.I.D /U.L.I.D
process is used to carry out the construction of the undergrounding improvements,
COMCAST of Washington waives the right to protest the L.I.D /U.L.I.D formation.
COMCAST of Washington retains the right to contest the method of calculating
assessments in such L.LD/U.L.I.D and the amount thereof to be levied.
This Agreement shall be recorded by the City Clerk with the King County Auditor as
required by the RCW. This Agreement shall be binding upon the parties, their respective
heirs, legal representatives, assignees, transferees and successors.
