SPECIAL MEETING CALL TO ORDER/PLEDGE OF ALLEGIANCE /ROLL CALL Mayor Haggerton called the Special Meeting of the Tukwila City Council to order at 7:00 p.m. and led the audience in the Pledge of Allegiance. ROLL CALL Melissa Hart, Deputy City Clerk, called the roll of the Council. Present were Councilmembers Joe Duffie, Dennis Robertson; Verna Seal, Allan Ekberg, Kathy Hougardy, De'Sean Quinn and Kate Kruller. CITY OFFICIALS Jim Haggerton, Mayor; David Cline, City Administrator; Bruce Linton, Assistant Police Chief; Bob Giberson, Public Works Director; Chris Flores, Assistant Fire Chief; Jack Pace, Community Development Director; Peggy McCarthy, Finance Director; Derek Speck, Economic Development Administrator; Joyce Trantina, Project Analyst; Mary Miotke, Information Technology Director; Trish Kinlow, Court Administrator; Kimberly Matej, Council Analyst; Melissa Hart, Deputy City Clerk. SPECIAL PRESENTATIONS a. Swearing in of Deni Delic, Transport Officer in the Police Department Assistant Police Chief Bruce Linton introduced Deni Delic. Mr. Delic and his family came to Tukwila from Bosnia in 1996, and Deni attended Cascade View Elementary. Mr. Delic earned his Associates Degree in Criminal Justice from Highline Community College and comes to Tukwila after serving as a Reserve Officer in Fife and as a Cadet with the Washington State Patrol. Mayor Haggerton administered the Oath of Office to Officer Delic, Badge #887. Mr. Delic's brother, Officer Andi Delic, pinned on his badge. Officer Delic introduced his family and expressed appreciation for the opportunity to serve in Tukwila. The Mayor and City Councilmembers extended congratulations to Officer Delic. b. Life - saving measures by three citizens: Dawn Corak, Tina Rice, Mary Thomas. Chris Flores, Assistant Fire Chief, introduced Dawn Corak, Tina Rice and Mary Thomas. Mr. Flores provided a brief history on cardiopulmonary resuscitation (CPR). On June 1, 2012 a customer entered Catherine's clothing store in Tukwila. After entering the store, she collapsed to the floor and Catherine's staff began to render life- saving assistance. One member began CPR, and another contacted 9 -1 -1. Engine 51 from the Tukwila Fire Department responded to the call, and upon arrival at the store, the crew observed the staff performing CPR. Fire personnel took over care, and the customer was revived after one shock to her heart. The patient was transported to Valley Medical Center, where she underwent surgery for placement of a defibrillator. Engine 51 felt the patient's outcome would have been different without the quick action by Dawn Corak, Tina Rice and Mary Thomas. The Tukwila Fire Department and City wish to recognize Ms. Corak, Ms. Rice and Ms. Thomas for providing life- saving measures to a Tukwila community member. Mayor Haggerton presented Ms. Corak, Ms. Rice and Ms. Thomas with medals from the Tukwila Fire Department. Authorize the acceptance of a grant from the Federal Highway Bridge Program for the Boeing Access Road over Burlington Northern Railroad Bridge Rehabilitation Project in the amount of $9,745,600.00. [Reviewed and forwarded to Consent by Transportation Committee on 12/3/12.] c. Authorize the Mayor to sign the Master Service Agreement (MSA) and the Addendum to the MSA with Integra Telecom Holdings, Inc., for City phone services in an amount not to exceed $120,000.00. [Reviewed and forwarded to Consent by Finance & Safety Committee on 12/4/12.] d. Authorize the Mayor to sign an Interlocal Agreement with the City of SeaTac for probation services. UNFINISHED BUSINESS a. Tukwila Village: (1) An ordinance relating to development agreements authorized pursuant to Chapter 18.86 of the Tukwila Municipal Code; approving and authorizing the proposed Tukwila Village Development Agreement with Tukwila Village Development Associates, LLC, a Washington Limited Liability Company. MOVED BY DUFFIE, SECONDED BY HOUGARDY THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED 7 -0. Melissa Hart, Deputy City Clerk, read the proposed ordinance by title only. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, RELATING TO DEVELOPMENT AGREEMENTS AUTHORIZED PURSUANT TO CHAPTER 18.86 OF THE TUKWILA MUNICIPAL CODE; APPROVING AND AUTHORIZING THE PROPOSED TUKWILA VILLAGE DEVELOPMENT AGREEMENT WITH TUKWILA VILLAGE DEVELOPMENT ASSOCIATES, LLC, A WASHINGTON LIMITED LIABILITY COMPANY; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. MOVED BY DUFFIE, SECONDED BY HOUGARDY THAT THE PROPOSED ORDINANCE BE ADOPTED AS READ. MOTION CARRIED 7 -0, TO ADOPT ORDINANCE NUMBER 2391. (2) Authorize the Mayor to sign the Development Agreement with Tukwila Village Development Associates, LLC, for Tukwila Village, in substantial form as the agreement in the agenda packet. MOVED BY SEAL, SECONDED BY KRULLER TO AUTHORIZE THE MAYOR TO SIGN THE DEVELOPMENT AGREEMENT WITH TUKWILA VILLAGE DEVELOPMENT ASSOCIATES, LLC, FOR TUKWILA VILLAGE, IN SUBSTANTIAL FORM AS THE AGREEMENT IN THE AGENDA PACKET. MOTION CARRIED 7 -0. The Council congratulated Derek Speck, Economic Development Administrator, for his work on the Tukwila Village project. b. MOVED BY HOUGARDY, SECONDED BY SEAL THAT THE PROPOSED RESOLUTION BE ADOPTED AS READ.* Councilmember Ekberg explained he has a few suggested edits to the draft strategic plan as presented in the agenda packet. He reviewed the items with staff and a representative from BERK Consulting and requested they be incorporated into the final plan. Joyce Trantina, Project Analyst, thanked Councilmember Ekberg for the suggested edits. *MOTION CARRIED 7 -0, TO ADOPT RESOLUTION NUMBER 1784. NEW BUSINESS a. Authorize the Mayor to sign an agreement with Securitas Security Services USA, Inc., for Court security in an amount not to exceed $80,020.00. Trish Kinlow, Court Administrator, explained Securitas Security Services has been providing security for the Tukwila Municipal Court since 2005. In an effort to have consistent contract language and insurance requirements with all City vendors, a new contract was necessary for this service. MOVED BY HOUGARDY, SECONDED BY QUINN TO AUTHORIZE THE MAYOR TO SIGN AN AGREEMENT WITH SECURITAS SECURITY SERVICES USA, INC., FOR COURT SECURITY IN AN AMOUNT NOT TO EXCEED $80,020.00. MOTION CARRIED 7 -0. b. Bond ordinance for the Tukwila Metropolitan Park District: (1) An ordinance repealing Ordinance No. 2390 relating to the issuance, sale and delivery of not to exceed $1,100,000 aggregate principal amount of limited tax general obligation bonds to undertake improvements to the pool. MOVED BY QUINN, SECONDED BY DUFFIE THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED 7 -0. Melissa Hart, Deputy City Clerk, read the proposed ordinance by title only. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, REPEALING ORDINANCE NO. 2390 RELATING TO THE ISSUANCE, SALE AND DELIVERY OF NOT TO EXCEED $1,100,000 AGGREGATE PRINCIPAL AMOUNT OF LIMITED TAX GENERAL OBLIGATION BONDS TO PROVIDE FUNDS NECESSARY TO UNDERTAKE CERTAIN IMPROVEMENTS TO THE POOL AND RELATED FACILITIES OWNED BY THE TUKWILA METROPOLITAN PARK DISTRICT; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. MOVED BY QUINN, SECONDED BY KRULLER THAT THE PROPOSED ORDINANCE BE ADOPTED AS READ.* Peggy McCarthy, Finance Director, explained Foster Pepper contacted City staff on December 6, 2012, about a scrivener's error discovered in Ordinance No. 2390. Section 9, A. Optional Redemption, currently reads the Bonds shall not be subject to optional redemption prior to maturity." The sentence contains the word "not," which would make the bonds non - callable. The ordinances before the Council this evening correct the error. *MOTION CARRIED 7 -0, TO ADOPT ORDINANCE NUMBER 2392. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, RELATING TO CONTRACTING INDEBTEDNESS; PROVIDING FOR THE ISSUANCE, SALE AND DELIVERY OF NOT TO EXCEED $1,100,000 AGGREGATE PRINCIPAL AMOUNT OF LIMITED TAX GENERAL OBLIGATION BONDS TO PROVIDE FUNDS NECESSARY TO UNDERTAKE CERTAIN IMPROVEMENTS TO THE POOL AND RELATED FACILITIES OWNED BY THE TUKWILA METROPOLITAN PARK DISTRICT, AND TO PAY THE COSTS OF ISSUANCE AND SALE OF THE BONDS; FIXING OR SETTING PARAMETERS WITH RESPECT TO CERTAIN TERMS AND COVENANTS OF THE BONDS; APPOINTING THE CITY'S DESIGNATED REPRESENTATIVE TO APPROVE THE FINAL TERMS OF THE SALE OF THE BONDS; AND PROVIDING FOR OTHER RELATED MATTERS; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. MOVED BY QUINN, SECONDED BY KRULLER THAT THE PROPOSED ORDINANCE BE ADOPTED AS READ. MOTION CARRIED 7 -0, TO ADOPT ORDINANCE NUMBER 2393. REPORTS a. Mayor Mayor Haggerton participated in the annual employee appreciation breakfast on December 5, 2012. He explained Department Directors and Managers sponsor the annual breakfast for City employees. The Mayor, City Administrator, Department Directors and Managers fund the event. Later that evening, he attended the Suburban Cities Association South Valley Caucus meeting. On December 6, 2012 he provided the opening remarks for the 4Culture local area agencies meeting, which was held at the Tukwila Community Center. He reminded the Council of the formal grand opening and ribbon cutting event for Southcenter Parkway on December 14, 2012 at 10:00 a.m. b. City Council Councilmember Duffie attended the annual employee breakfast on December 5, 2012. He stated he was recently provided a tour of the Tukwila Pool to view the progress of the project. Council President Seal thanked Councilmember Robertson and Councilmember Quinn for filling in for her the past week. Councilmember Hougardy attended the Government Affairs meeting on December 4, 2012. Councilmember Quinn attended the Tukwila Pool Advisory Committee meeting on December 5, 2012. He thanked Councilmember Ekberg for the summary of comments received at the most recent Council Coffee Chat. He spoke about one specific comment relating to the lack of Council representation at the most recent Tukwila Village meeting. He appreciates the high level of engagement from residents, and there are times when Councilmembers are not able to attend events due to prior commitments. Councilmember Kruller attended the Government Affairs meeting on December 4, 2012 and the Genesis Project event this past weekend. She reminded the Council of the December 13, 2012 Historical Society meeting to be held at the Nelsen Historical Trust House at 15643 West Valley Highway. Tukwila City Council Special Meeting Minutes December 10, 2012 Page 5 of 5 Mayor Haggerton commented that elected officials are very busy with involvement in many different types of events that benefit the City, and there are times when an elected official is not able to attend an event. c. Staff There was no report. d. City Attorney The City Attorney was not present. e. Intergovernmental Kimberly Matej, Council Analyst, announced that Councilmembers will need to update their passwords for the City's computer network system. She announced the 2013 Council Committees will begin the week of January 14, 2013. Councilmember Hougardy stated she has finalized the Council Committee schedule. For 2013, the Utilities and Transportation Committees will swap meeting days. Additional information will be forthcoming to the Council. MISCELLANEOUS Councilmember Robertson inquired about the process that will be used for the replacement of the Council Analyst. Councilmember Hougardy explained the current Council Analyst will be transitioned to the Mayor's Office (government relations). The Council will need to discuss the desired process to be used to fill the position that will support the Council. She has discussed the issue with the City Administrator, and she proposes to have the Council discuss this in January. The Councilmembers discussed this issue and exchanged the following comments: the possibility of discussing this issue at the Council retreat; questions regarding how a Council sub - committee to assist in the hiring process would be established; the possibility of further discussion occurring at a Council work session; and the importance of involving all Councilmembers in the hiring process. Mayor Haggerton noted that at the December 3, 2012 Council meeting, he committed to the Council that they would have continued staff support until a replacement has been hired. It was his expectation that the Council would begin working on this issue in January. He suggested that Council President Seal and incoming Council President Hougardy work together on establishing a timeline and process for the Council.
