HomeMy WebLinkAboutRes 0478 - Professional Services Monies to Hire a Graphic Artist WASHINGTON RESOLUTION NO. 478 RESOLUTION GRANTING THE PLANNING DIRECTOR THE AUTHORITY TO EXPEND PROFESSIONAL SERVICES MONIES TO HIRE A GRAPHICS PERSON ON A CONTRACTUAL BASIS AND AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT FOR SUCH SERVICES FOR THE CITY. WHEREAS, The narrative portion of the 1975 Tukwila Budget for the Planning Department, Section .31 -2 on page 43, authorizes monies for "some outside consultant help" for work on the comprehensive plan, and WHEREAS, The Planning Department is in need of a graphics person to perform drafting and illustrative work for the comprehensive plan, and WHEREAS, The Mayor as the chief executive of the City, is the proper person to enter the City into contracts. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, RESOLVE AS FOLLOWS: Section 1. That the Planning Director is author- ized to expend professional services monies for the services of a graphics person on a self employed and contractual basis for the purpose of preparing mapping and illustrations for the comprehensive plan; and Section 2. That funds shall be allowed to be expended to a maximum amount of $3,840, at which time the contract shall expire; and Section 3. That the Mayor is hereby authorized to enter the City into a contract with an individual or firm for graphics services as hereto for stated, said contract to significantly conform to exhibit 1 to this resolution. PASSED BY THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, And approved by the Mayor at a regular meeting thereof this 7th day of April 1975 Frank Todd Mayor Shirlee Kinney City Clerk ending 19 EXHIBIT 1 AGREEMENT FOR CONTRACTUAL SERVICES THIS AGREEMENT made and entered into this day of 19 between the City of Tukwila, a Municipal corporation, and WITNESSETH: In consideration of the mutual agreements herein contained agrees to furnish to the City of Tukwila all service as herein defined and described as shall be required by the Planning Department of the City of Tukwila for the period commencing 19 and 1. Attached hereto and incorporated by this reference as though fully set forth is a description and definition, includ- ing specifications, of the work to be performed and the services to be furnished under this agreement. For full, complete and faithful performance of said work and services the City shall pay to the total sum of provided, however, that should this contract be terminated for any reason prior to 1 9 the City shall be obligated to pay and shall pay only for such performance and services as have been actually rendered to the date of termination. For the purposes of this proviso clause, such payment shall be calculated on the basis of per hour of work and services actually performed. 2. It is agreed by and between the parties hereto that this agreement shall not constitute nor create an employer employee relationship and shall not ac- quire as a result of this agreement or the work and services to be performed hereunder any "employee benefits" which may now or hereafter be established by the City of Tukwila for its employees, either by Ordinance, practice or otherwise including, but not by way of limitation, annual vacation leave, sick leave, health and accident insurance coverage, or retirement benefits by way of membership of the City in any public retirement system. 3. It is further agreed by and between the parties that shall be solely responsible for all obligations, if any, relating to federal income tax, self employment FICA taxes and contributions, and all other so- called employer taxes and contributions growing out of the relationship hereby created. further agrees to hold and save the City of Tukwila harmless from any claim, valid or otherwise, made to the City for such employer taxes and /or contributions or with- holding obligations as to any of the aforementioned. 4. This Agreement may be, terminated upon the giving of written notice of termination by either party. Such termination shall be effective immediately, provided that such termination shall not release of the responsibility to complete faithfully any work then in progress, unless the written notice so provides.
