RESOLUTION NO. 496
RESOLUTION GRANTING THE PLANNING DIRECTOR THE AUTHORITY
TO EXPEND PROFESSIONAL SERVICES "MONIES TO HIRE A QUALI-
FIED PERSON ON A CONTRACTUAL BASIS FOR THE PURPOSE OF
PREPARING A PARK PLAN AND RELATED CAPITAL IMPROVEMENT
PROGRAM AND AUTHORIZING THE MAYOR TO ENTER INTO A CON-
TRACT FOR SUCH PURPOSE FOR THE CITY.
WHEREAS, On July 21, 1975, the City Council did authorize the
Planning Department to initiate an update of the City of Tukwila Park and
Recreation Comprehensive Plan, and
WHEREAS, On July 21, 1975, the City Council also did authorize
the Planning Department to engage the professional services of a qualified
person to work directly with the Planning Department for a period recessary
to complete the update of the Park and Recreation Comprehensive Plan.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, RESOLVE AS FOLLOWS:
Section 1. That the Planning Director is authorized to expend
professional services monies from the Planning Department budget for the
services of a qualified person on a self employed and contractual basis
for the purpose of updating the City's Park and Recreation Comprehensive
Plan, creating a related Capital Improvement Program, and related work; and
Section 2. That funds shall be allowed to be expended to a
maximum amount of $6,000, as further limited in "Exhibit 1" to this reso-
lution, at which time the contract shall expire; and
Section 3. That this resolution shall further be conditioned
upon "Exbibit 1" to this resolution entitled "Agreement for Contractual
Services."
Section 4. That the Mayor is hereby authorized to enter the City
into a contract with a qualified person for the services stated in Section
1 above, said contract to conform to Exhibit 1 to this resolution.

EXHIBIT 1
AGREEMENT FOR CONTRACTUAL SERVICES
THIS AGREEMENT made and entered into this 16th day of September
19 75 between the City of Tukwila, a Municipal corporation, and
Carl Stixrood
WITNESSETH:
In consideration of the mutual agreements herein contained
Carl Stixrood agrees to furnish to the City of Tukwila
all professional planning services for the updating of the City's Park and
Recreation Comprehensive Plan and related Capital Improvement Program as
shall be required by the Planning Department of the City of Tukwila for the
period commencing approximately October 21 19 75 or at
such time as his present graphics contract with the City expires and ending
approximately March 22, 1976, or at such time as $4,620 are expended in wages.
1. Attached hereto and incorporated by this reference as though fully
set forth is a description and definition, including specifications, of the
work to be performed and the services to be furnished under this agreement
as well as the time and dollar relationship of this contract to the graphics
contract. For full, complete and faithful performance of said work and
services the City shall pay to Carl Stixrood the total sum of
$4,620.00 provided, however, that should this contract be termin-
ated for any reason prior to March 22 19 76 unless funds are
expended totally prior to that time, the City shall be obligated to pay and
shall pay only for such performance and services as have been actually rendered

to the date of termination. For the purposes of this proviso clause, such
payment shall be calculated on the basis of $5.50 per hour of work and
services actually performed. The contractee agrees to begin work on the
Park Plan update under the present graphics contract at such time as requested
by the Planning Director and further agrees to do graphics work for the
community wide Comprehensive Plan under this contract.
2. It is agreed by and between the parties hereto that this agreement
shall not constitute nor create an employer employee relationship and
shall not acquire as a result of this agree-
ment or the work and services to be performed hereunder any "employee bene-
fits" which may now or hereafter be established by the City of Tukwila for
its employees, either by Ordinance, practice or otherwise including, but not
by way of limitation, annual vacation leave, sick leave, health and accident
insurance coverage, or retirement benefits by way of membership of the City
in any public retirement system.
3. It is further agreed by and between the parties that Carl Stixrood
shall be solely responsible for all obligations, if any, relating to federal
income tax, self employment FICA taxes and contributions, and all other so
called employer taxes and contributions growing out of the relationship
hereby created. Carl Stixrood further agrees to hold and save the
City of Tukwila harmless from any claim, valid or otherwise, made to the City
for such employer taxes and /or contributions or withholding obligations as to
any of the aforementioned.
4. This Agreement may be terminated upon the giving of written notice
of termination by either party. Such termination shall be effective
immediately, provided that such termination shall not release Carl Stixrood
of the responsibility to complete faithfully any work then in progress, unless
the written notice so provides.
IN WITNESS WHEREOF, we have signed this agreement on the day and year
first above written.

PARK AND RECREATION PLAN UPDATE
(Services to be rendered by qualified person)
The qualified person retained to update the existing Park and Recreation
Comprehensive Plan shall perform the following tasks and other relevant
tasks as deemed necessary by the Planning Director:
1. Analyze the community's park and recreation needs based upon currantly
accepted standards. Inventory publicly owned lands as well as relevant
private parcels to determine alternative schemes for satisfying the
communities recreation needs.
2. Draft a new or update of the City's Park and Recreation Comprehen-
sive Plan, including graphics. (Trail Element to be included.)
3. Draft a Capital Improvement Program in conjunction with the Park Plan.
4. If time allows, do individual site plans for each proposed park
acquisition, including active and passive play areas, grassed and
landscaped areas, restroom facilities, drainage, walkways, and other
relevant concepts deemed necessary.
5. Graphics work as needed in any aspect of the Planning Department work
program.

(Totals $4,620) (Twenty -one working days one month)
a. Approx. 48 days to be worked in 1975.
b. Approx. 57 days to be worked in 1976 (continued contract prof. services).
c. Assumes 8 hour working day.
Extra secretarial help, supplies, printing and binding costs not to exceed
$1,380. The maximum hourly wage to be paid for extra secretarial help shall
not exceed the part time rate for the City unless such service as Kelly Girl
is used, in which case the rate charged by that firm shall be paid.
