RESOLUTION AUTHORIZING THE EXECUTION AND DELIVERY
OF A CONTRACT WITH PUGET SOUND POWER
LIGHT COMPANY FOR FURNISHING
MERCURY VAPOR STREET LIGHTING
(Service Furnished)
WHEREAS, PUGET SOUND POWER LIGHT COMPANY has
offered to furnish for a period of FIVE (5) years,
upon the terms set forth in the following proposed form of contract, to -wit:

PUGET SOUND POWER LIGHT COMPANY "Company and CITY OF
TUKWI LA "Customer agree as follows:
FIRST: This contract is for mercury vapor street lighting service.
SECOND: TERM. The term of this contract is for an initial period of FIVE (5)
consecutive years beginning May 28 1974 and thereafterforsuccessiveperiods
of the same number of years, until terminated at the end of any such period, initial or
successive, by either party delivering notice of termination to the other party at least
thirty (30) days prior to the expiration of such period. If addressed to a party's address
last known to the sending party and mailed in the United States mail, notice shall be
deemed delivered to that party on the third day following the date of posting.
THIRD: SERVICES TO BE RENDERED. In consideration of the mutual promises, and
subject to the limitations herein contained, the Company agrees to furnish the necessary
electric energy requi red for dusk to dawn mercury vapor I ighti ng of streets, alleys and other
public thoroughfares which can be served fromtheCompany's existing distribution system
and to perform repairs and routine maintenance work as specified in the Company's en-
gineering standards. Repairs and maintenance work will be performed during the regularly
scheduled working hours of the Company. Individual lamps will be replaced on burnout, as
soon as reasonably possible after notification by the Customer and subject tot the Com-
pany's operating schedules and requirements. Customer agrees to purchase from the
Company, exclusively, all electric service required or used to operate customer street
lighting facilities at the rates herein fixed. Said facilities are located and described as
follows:
4 400.watt mercury vapor street lights, company owned;
141 175 watt mercury vapor street lights, company owned;
25 700 watt mercury vapor street lights, customer owned; and
200 400 watt mercury vapor street lights, customer owned, located within
the Cit of Tukwila Kin County, Washington
FOURTH: RATES. Customer agrees to pay for the electric service and energy furnished
at the following rates:

If the Customer's street lighting system consists of both Company and Customer -owned
lamps, the number of lamps ownedbytheCompany will not be combined with the number
of lamps owned by the Customer for billing purposes.

175 watt $2.95 per month
400 watt $3.15 per month; 700 watt $5.24 per month

FIFTH: INSTALLATIONS OF CUSTOMER -OWNED SYSTEM. A system installed and
wholly owned by the Customer shall conform to the Company's specifications for such
type of system in effect atthetimeof installation and shall be installed without expense
to the Company
SIXTH: LINE EXTENSIONS. Underground distribution circuits will be extended by the
Company for any service under this schedule only at the Customer's expense.
SEVENTH: THIRD PARTY DAMAGE.
A. Company -Owned Installations Street lighting facilities which
experience malicious and /or recurring damage caused by actions
of third parties shall be subject to removal by the Company
and /or payment by the Customer for such damage.
B. Customer -Owned Installations The Customer shall pay for re-
pair and /or maintenance work required (including replacement
of damaged parts, if necessary) caused by actions of third
parties, whether by accident or otherwise.
EIGHTH: CHANGE OF LOCATION. The location of Company -owned street lighting may
be changed at Customer request and upon payment by the Customer of the costs of re-
moval and reinstallation.
NINTH: SUBJECT TO REGULATORY AUTHORITY. The rights and obligations of the
parties hereunder are subject to the authority of any regulatory agency having jurisdiction
and to the Company's applicable schedules and tariffs, as they may be amended from time
to time, on file with any such regulatory agency, including, without limitation, the Com-
pany's General Rules and Provisions and its Tax Adjustment Schedule on file with the
Washington Utilities and Transportation Commission, all of which schedules and tariffs are
by this reference incorporated herein and made a part hereof. The rates hereunder are
subject to change by authority of any such regulatory agency or upon the effectiveness of
a superseding schedule of rates governing the electric service rendered hereunder filed with
such regulatory agency. Upon the effective date of such change, the Customer shall there-
after pay for service at the new rate.
