HomeMy WebLinkAboutRes 0515 - Interlocal Agreement - King County Animal Control (Pet License)GI Y OF UKWILA RESOLUTION AUTHORIZING MAYOR TO NEGOTIATE ANIMAL CONTROL SERVICE AGREEMENTS WITH KING COUNTY, WASHINGTON FOR THE PERIOD JANUARY 1, 1976 THROUGH MARCH 31, 1977 WHEREAS, the City of Tukwila has previously made a contract with King County, Washington for the control of animals, which contract it wishes to renew and continue through March 31, 1976; and WHEREAS, the City of Tukwila has been requested to enter into a new and different contract with King County, Washington for animal control services to be effective from April 1, 1976 through March 31, 1977, NOW, THEREFORE, the City Council of the City of Tukwila does resolve as follows: The City of Tukwila shall renew its animal control services contract with King County, Washington for the period January 1, 1976 through March 31, 1976 and the Mayor shall execute such an agreement, and in addition, the Mayor is authorized to negotiate a new and different animal control services contract with King County, Washington for the period April 1, 1976 through March 31, 1977 with provisions for subsequent renewals. Bauch Mayor Shirlee Kinney City Clerk 1 CONTRACTING DEPT. /DIV.: CONTRACT AMOUNT: 2 TERM: TYPE Or bErty i1 i 3 4 INTERLOCAL SERVICES AGREEMENT 5 6 This AGREEMENT, entered into this 3rd day of 7 Mar h 19 76 between KING COUNTY (State of 8 Washington), hereinafter referred to as the "COUNTY" and the 9 municipal corporation of TUKWILA hereinafter 10 referred to as the "CITY 11 WITNESSETH: 12 WHEREAS, the City, pursuant to R.C.W. 39.34.010 and 13 39.34.080, and Article I, Section 120 of the King-County Charter, 14 is desirious of Contracting with the County for the performance 15 of Animal Control Services and 16 WHEREAS, the County is agreeable to rendering such services 17 on the terms and conditions hereinafter set forth and in consi- 18 deration of payments, mutual covenants and agreements herein 19 contained. 20 IT IS, THEREFORE, covenanted and agreed as follows: 21 1. Obligations: In consideration of the promise of the 22 City and payment of the sum hereinafter set forth, the 23 County promises to: 24 A. Perform to the best of its ability all services 25 relating to licensing and enforcement of City 26 ordinances or resolutions pertaining to Animal 27 Control; 28 B. Provide a level of service which is the same as that 29 of the rest of the unincorporated area of the County; 30 C. Furnish licenses and application forms for said 31 32 33 -1- 31 32 33 1P 1 2 3 City Hall shall terminate on the 30th day of (7i //2;/ e 1976 �I In consideration of the promises of the County herein 6 before set forth, the City promises to: 7 D. Enact an ordinance or resolution, which is substan- 8 tially similar to King County Ordinance No. 1396, 9 as now or hereafter amended; 10 E. Delegate to the County the following: 11 (1) The power to determine eligibility for licenses 12 issued under the terms of the City ordinance 13 or resolution, subject to the conditions set 14 forth in said ordinance or resolution and 15 subject to the review power of the King County 16 Board of Appeals. 1 (2) The power to enforce terms of the City ordi- 18 nance or resolution, including the power to 19 suspend or revoke licenses issued thereunder, 20 subject to the conditions set forth in said 21 ordinance or resolution and subject to the 22 review power of the King County Board of 23 Appeals. 24 (3) The power and duty to issue notices of vio- 25 lation and court citations shall be jointly 26 exercised by the County and the City. 27 2. Compensation and Method of Payment: 28 The City shall reimburse the County for the services 29 as delineated in this contract in the following manner: 30 A. The County shall receive all fines and fees P✓ licenses to the City for sale to the public at the City Hall; Provided, however, that said sales at the —2— ADDENDUM TO KING COUNTY ANIMAL CONTROL CONTRACT, 1976 Section 2, Subsection A., Compensation and Method of Payment: (a) Period until April 30, 1976 of each license year: (1) $.80 for each dog license sold at the City Hall shall be rebated to the City; (2) $.50 for each cat license sold at the City Hall shall be rebated to the City. The County shall receive all impound and redemption 21 :fees charged against animals. 22 3. Time of Performance: This agreement shall 9. 23 effective on the 1st day of April 19 76 24 and terminate on the 31st day of March 19 77. 25 It; is further agreed that should both parties desire 26 to continue this agreement after said termination date, 27 this contract may be renewed for a period of one year 28 on. the same terms and conditions, upon the giving of �9 written notice by either party to the other not less than 30 thirty (30) days before the expiration of this agreement. 31 32 33 —3— 1 4. Modifications: The parties agree that this agreement 2 is the complete expression of the terms hereto and any 3 oral representation or understandings not incorporated 4 herein are excluded. Further, any modification of this 5 agreement shall be in writing, signed by both parties, 6 and affixed to this original agreement. 7 5. Termination: This agreement may be terminated only 8 after thirty days written notice received by one 9 party given by the other. Failure to comply with any 10 of the provisions stated herein shall constitute material 11 breach of contract and cause for termination. Any 12 termination of this agreement shall not terminate any 13 obligation of either party matured prior to such 14 termination, nor shall it affect the validity of any 15 license issued pursuant to the City ordinance or 16 resolution.. 17 6. Hold Harmless: The County agrees to protect and hold 18 harmless the City from and against all claims, 19 demands and causes of action of any kind or character, 20 including the cost of defense thereof arising in favor 21 of third parties on account of personal injuries, death, 22 or damage to property arising from the performance of 23 services herein specified. 24 Both parties understand and agree that the County is 25 acting hereunder as an independent contractor, with the 26 intended following results: 27 A. Control of personnel, standards of performance, 28 discipline, and all other aspects of performance 29 shall be governed entirely by the County; 30 B. All persons rendering service hereunder shall be 31 32 33 1 2 3 4 5 6 7 8 9 10 11 12 i 13 14 15 16 -5- for all purposes employees of the County, although they may from time to time act as commissioned officers of the City. C. In the event of a dispute between the parties as to the extent of the service to be rendered hereunder, or the minimum level or manner of performance of such service, the determination of the Director of the King County Division of General Services shall prevail unless within ten days of such determination made in writing, the City files a written notice of appeal with the Director. Copies of such notice shall also be filed with the County Executive and the City Mavor In such event the dispute shall then be submitted for review to a three member panel composed of the County Executive, the City Mavor and a third member of their 17 choosing who shall not be an officer or employee of 18 either the County or the City. A decision or 19 determination agreed upon by a majority of said 20 panel shall be final and conclusive in all respects 21 between the parties hereto. 22 7. Audits and Inspection: The records and documents with 23 respect to all matters covered by this Contract shall 24 be subject to inspection, review or audit by the County 25 or C:Lty during the term of this Contract and seven 26 years after termination hereof. 27 8.
