HomeMy WebLinkAboutRes 0516 - Interlocal Agreement - King County Public Defender ServiceCI Y QF UKW ATTEST: WASHINGTON RESOLUTION NO. 516 RESOLUTION AUTHORIZING MAYOR TO NEGOTIATE A DEFENSE SERVICE AGREEMENT WITH KING COUNTY, WASHINGTON WHEREAS, the City of Tukwila maintains and operates a Municipal Court; and WHEREAS, certain defendants appearing in said Court are indigent and cannot afford legal representation; and WHEREAS, said indigent defendants may be entitled to have legal counsel appointed by the Court to represent them at no expense to the defendants, NOW, THEREFORE, the City Council of the City of Tukwila, Washington does resolve as follows: The Mayor is authorized to negotiate a defense service agreement with King County, Washington, with terms and conditions identical to, or substantially similar to, the Defense Service Agreement, a copy of which is attached hereto as Attachment 1. Bauch Mayor Shirlee Kinney City Clerk THIS AGREEMENT made and entered into this er., day of Ali -cat/, by and between KING COUNTY, a municipal corporation of the State of Washington, hereinafter referred to as "County," and the CITY OF TUKWILA a municipal corporation of the State of Washington, hereinafter referred to as "City WHEREAS, the County, through the Office of Public Defense, has been providing defense services to indigents charged with State misdemeanor offenses in the County District Courts, and WHEREAS, the County Office of Public Defense has an established list of attorneys who participate in the defense of indigents in King County, and also contracts with non- -i rnfi t legal cor pnratic n s fnr said defense, and WIIEREAS, the County Office of Public Defense has an established method of determining iridigenc'y and assigning qualified cases to attorneys where constitutionally required, and WHEREAS, the City has a need for obtaining appointed counsel for qualified indigents charged with violations of certain City criminal Ordinances, NOW THEREFORE, in consideration of the mutual agreements contained herein, IT IS AGREED: 1. The County Office of Public Defense will interview defend- ants charged with violating criminal Ordinances of the City who have requested counsel, obtain and pay for legal counsel for those quali- fied indigents. 2. The City agrees to reimburse the County the sum of One Hun dred Five and no /100th Dollars ($105.00) per case for each indiaent charged with violating a City Ordinance and assigned an attorney by the Office of Public Defense, said sum to include interviewing and indigency determination by the Office of Public Defense. 3. On the last working day of each calendar quarter, the Administrator of the Office of Public Defense will certify to the City the number of cases assigned attorneys during that quarter, and upon accepting said certification, the City shall pay the county an amount equal to the number of cases so certified times One Hundred Five and no /100th Dollars ($105.00), which shall cover all costs for examination and defense including the fee for any defense attorney so assigned. 4.
