HOW TO TESTIFY If you would like to address the Council, please go to the podium and state your name and address clearly for the record. Please observe the basic rules of courtesy when speaking and limit your comments to five minutes. The Council appreciates hearing from citizens but may not be able to take immediate action on comments received until they are referred to a Committee or discussed under New Business. COUNCIL MEETINGS No Council meetings are scheduled on the 5th Monday of the month unless prior public notification is given. Regular Meetings - The Mayor, elected by the people to a four -year term, presides at all Regular Council Meetings held on the 1st and 3rd Mondays of each month at 7:00 p.m. Official Council action in the form of formal motions, adopting of resolutions and passing of ordinances can only be taken at Regular Council meetings. Committee of the Whole Meetings - Council members are elected for a four -year term. The Council President is elected by the Council members to preside at all Committee of the Whole meetings for a one -year term. Committee of the Whole meetings are held the 2nd and 4th Mondays at 7:00 p.m. Issues discussed are forwarded to the Regular Council meeting for official action. GENERAL INFORMATION At each Council meeting citizens are given the opportunity to address the Council on items that are not included on the agenda during CITIZENS COMMENTS. Please limit your comments to 5 minutes. Special Meetings may be called at any time with proper public notice. Procedures followed are the same as those used in Regular Council meetings. Executive Sessions may be called to inform the Council of pending legal action, financial, or personnel matters. PUBLIC HEARINGS Public Hearings are required by law before the Council can take action on matters affecting the public interest such as land -use laws, annexations, rezone requests, public safety issues, etc. Section 2.04.150 of the Tukwila Municipal Code states the following guidelines for Public Hearings: 1. The proponent shall speak first and is allowed 15 minutes for a presentation. 2. The opponent is then allowed 15 minutes to make a presentation. 3. Each side is then allowed 5 minutes for rebuttal. 4. Citizens who wish to address the Council may speak for 5 minutes each. No one may speak a second time until everyone wishing to speak has spoken. 5. After each speaker has spoken, the Council may question the speaker. Each speaker can respond to the question, but may not engage in further debate at this time. 6. After the Public Hearing is closed and during the Council meeting, the Council may choose to discuss the issue among themselves, or defer the discussion to a future Council meeting, without further public testimony. BACKGROUND The 2013 Annual Small Drainage Program was to be cancelled due to the emergency pipe repairs needed along East Marginal Way S (EMWS). Upon further analysis, the EMWS Emergency Storm Pipe Repair 11 -19 -12 will not be able to be constructed this year. The EMWS project will be delayed due to contaminated soils, utility conflicts which require additional design and construction which will need to be timed with a fish window requiring work on the pipe be completed by the end of September. The Small Drainage Project list contains several projects that should be constructed as soon as practical to take care of minor roadway flooding and repair damaged storm pipe sections. DISCUSSION The 2013 Annual Small Drainage Program budget is $645,000. In April, $80,000 in design funds was allocated for the EMWS project with the understanding that the construction funding would also be shifted. Since the EMWS project needs to be delayed one year, a total of $565,000 is available for design and construction of small drainage projects in 2013. Public Works staff reviewed the list of known system deficiencies and from that compiled a list of four projects for design in 2013. Each project was selected because they can be designed and constructed quickly and will not require outside agency permitting. The four projects selected are: 1. S 164th St east of 51St Ave S 3. 33rd Ave S between S 140th St and 34th PI S 2. 14148 34th PIS 4. 14229 34th Ave S The current MRSC Consultant Roster was reviewed and three firms were short- listed to design the selected four projects. The firms were: KPG, Inc., PACE Engineers, and CH2M Hill. The Summary of Qualifications was evaluated for each firm and KPG was selected as the firm that best met the requirements. KPG has designed the Annual Small Drainage Program since 1991 and Public Works staff continues to be very satisfied with their work. KPG is knowledgeable of City requirements, remains flexible to design changes, and continues to complete designs within the contracted amount. It is recommended that KPG, Inc. design the 2013 Annual Small Drainage Program for a fee of $43,372.81. RECOMMENDATION Council is being asked to approve the consultant agreement with KPG, Inc. in the amount of $43,372.81 for design of the 2013 Annual Small Drainage Program and consider this item on the Consent Agenda at the June 3, 2013 Regular Meeting. Linsao W: \PW Eng \GIS \Projects \Ryan \CIP Storm Drainage\2013 drainage program.mxd s Not to Scale 6 City of Tukwila 6200 Southcenter Boulevard, Tukwila WA 98188 Contract Number: CONSULTANT AGREEMENT FOR ENGINEERING SERVICES THIS AGREEMENT is entered into between the City of Tukwila, Washington, hereinafter referred to as "the City", and KPG, Inc., hereinafter referred to as "the Consultant", in consideration of the mutual benefits, terms, and conditions hereinafter specified. Project Designation. The Consultant is retained by the City to perform engineering services in connection with the project titled '2013 Small Drainage Program'. 2. Scope of Services. The Consultant agrees to perform the services, identified on Exhibit "A" attached hereto, including the provision of all labor, materials, equipment and supplies. 3. Duration of Agreement; Time for Performance. This Agreement shall be in full force and effect for a period commencing upon execution and ending December 31, 2013, unless sooner terminated under the provisions hereinafter specified. Work under this Agreement shall commence upon written notice by the City to the Consultant to proceed. The Consultant shall perform all services and provide all work product required pursuant to this Agreement no later than December 31, 2013 unless an extension of such time is granted in writing by the City. 4. Payment. The Consultant shall be paid by the City for completed work and for services rendered under this Agreement as follows: A. Payment for the work provided by the Consultant shall be made as provided on Exhibit "B" attached hereto, provided that the total amount of payment to the Consultant shall not exceed $43,372.81 without express written modification of the Agreement signed by the City. B. The Consultant may submit vouchers to the City once per month during the progress of the work for partial payment for that portion of the project completed to date. Such vouchers will be checked by the City and, upon approval thereof, payment shall be made to the Consultant in the amount approved. C. Final payment of any balance due the Consultant of the total contract price earned will be made promptly upon its ascertainment and verification by the City after the completion of the work under this Agreement and its acceptance by the City. D. Payment as provided in this section shall be full compensation for work performed, services rendered, and for all materials, supplies, equipment and incidentals necessary to complete the work. E. The Consultant's records and accounts pertaining to this Agreement are to be kept available for inspection by representatives of the City and the state of Washington for a period of three (3) years after final payments. Copies shall be made available upon request. 7 5. Ownership and Use of Documents. All documents, drawings, specifications and other materials produced by the Consultant in connection with the services rendered under this Agreement shall be the property of the City whether the project for which they are made is executed or not. The Consultant shall be permitted to retain copies, including reproducible copies, of drawings and specifications for information, reference and use in connection with the Consultant's endeavors. The Consultant shall not be responsible for any use of the said documents, drawings, specifications or other materials by the City on any project other than the project specified in this Agreement. 6. Compliance with Laws. The Consultant shall, in performing the services contemplated by this Agreement, faithfully observe and comply with all federal, state, and local laws, ordinances and regulations, applicable to the services rendered under this Agreement. 7. Indemnification. The Consultant shall defend, indemnify and hold the City, its officers, officials, employees and volunteers harmless from any and all claims, injuries, damages, losses or suits including attorney fees, arising out of or resulting from the acts, errors or omissions of the Consultant in performance of this Agreement, except for injuries and damages caused by the sole negligence of the City. Should a court of competent jurisdiction determine that this Agreement is subject to RCW 4.24.115, then, in the event of liability for damages arising out of bodily injury to persons or damages to property caused by or resulting from the concurrent negligence of the Consultant and the City, its officers, officials, employees, and volunteers, the Consultant's liability hereunder shall be only to the extent of the Consultant's negligence. It is further specifically and expressly understood that the indemnification provided herein constitutes the Consultant's waiver of immunity under Industrial Insurance, Title 51 RCW, solely for the purposes of this indemnification. This waiver has been mutually negotiated by the parties. The provisions of this section shall survive the expiration or termination of this Agreement. 8. Insurance. The Consultant shall procure and maintain for the duration of the Agreement, insurance against claims for injuries to persons or damage to property which may arise from or in connection with the performance of the work hereunder by the Consultant, its agents, representatives, or employees. Consultant's maintenance of insurance as required by the agreement shall not be construed to limit the liability of the Consultant to the coverage provided by such insurance, or otherwise limit the City's recourse to any remedy available at law or in equity. A. Minimum Amounts and Scope of Insurance. Consultant shall obtain insurance of the types and with the limits described below: 1. Automobile Liability insurance with a minimum combined single limit for bodily injury and property damage of $1,000,000 per accident. Automobile Liability insurance shall cover all owned, non - owned, hired and leased vehicles. Coverage shall be written on Insurance Services Office (ISO) form CA 00 01 or a substitute form providing equivalent liability coverage. If necessary, the policy shall be endorsed to provide contractual liability coverage. CA revised : 1 -2013 8 Page 2 2. Commercial General Liability insurance with limits no less than $1,000,000 each occurrence, $2,000,000 general aggregate. Commercial General Liability insurance shall be written on ISO occurrence form CG 00 01 and shall cover liability arising from premises, operations, independent contractors and personal injury and advertising injury. The City shall be named as an insured under the Consultant's Commercial General Liability insurance policy with respect to the work performed for the City. 3. Workers' Compensation coverage as required by the Industrial Insurance laws of the State of Washington. 4. Professional Liability with limits no less than $1,000,000 per claim and $1.,000,000 policy aggregate limit. Professional Liability insurance shall be appropriate to the Consultant's profession. B. Other Insurance Provision. The Consultant's Automobile Liability and Commercial General Liability insurance policies are to contain, or be endorsed to contain that they shall be primary insurance with respect to the City. Any Insurance, self - insurance, or insurance pool coverage maintained by the City shall be excess of the Consultant's insurance and shall not be contributed or combined with it. C. Acceptability of Insurers. Insurance is to be placed with insurers with a current A.M. Best rating of not less than A:VIl. D. Verification of Coverage. Consultant shall furnish the City with original certificates and a copy of the amendatory endorsements, including but not necessarily limited to the additional insured endorsement, evidencing the insurance requirements of the Consultant before commencement of the work. Certificates of coverage and endorsements as required by this section shall be delivered to the City within fifteen (15) days of execution of this Agreement. E. Notice of Cancellation. The Consultant shall provide the City with written notice of any policy cancellation, within two business days of their receipt of such notice. F. Failure to Maintain Insurance. Failure on the part of the Consultant to maintain the insurance as required shall constitute a material breach of contract, upon which the City may, after giving five business days notice to the Consultant to correct the breach, immediately terminate the contract or, at its discretion, procure or renew such insurance and pay any and all premiums in connection therewith, with any sums so expended to be repaid to the City on demand, or at the sole discretion of the City, offset against funds due the Consultant from the City. 9. Independent Contractor. The Consultant and the City agree that the Consultant is an independent contractor with respect to the services provided pursuant to this Agreement. Nothing in this Agreement shall be considered to create the relationship of employer and employee between the parties hereto. Neither the Consultant nor any employee of the Consultant shall be entitled to any benefits accorded City employees by virtue of the services provided under this Agreement. The City shall not be responsible for withholding or otherwise deducting federal income tax or social security or for contributing to the state industrial insurance program, otherwise assuming the duties of an employer with respect to the Consultant, or any employee of the Consultant. CA revised : 1 -2013 Page 3 9 10. Covenant Against Contingent Fees. The Consultant warrants that he has not employed or retained any company or person, other than a bonafide employee working solely for the Consultant, to solicit or secure this contract, and that he has not paid or agreed to pay any company or person, other than a bonafide employee working solely for the Consultant, any fee, commission, percentage, brokerage fee, gifts, or any other consideration contingent upon or resulting from the award or making of this contract. For breach or violation of this warrant, the City shall have the right to annul this contract without liability, or in its discretion to deduct from the contract price or consideration, or otherwise recover, the full amount of such fee, commission, percentage, brokerage fee, gift, or contingent fee. 11. Discrimination Prohibited. The Consultant, with regard to the work performed by it under this Agreement, will not discriminate on the grounds of race, religion, creed, color, national origin, age, veteran status, sex, sexual orientation, gender identity, marital status, political affiliation or the presence of any disability in the selection and retention of employees or procurement of materials or supplies. 12. Assignment. The Consultant shall not sublet or assign any of the services covered by this Agreement without the express written consent of the City. 13. Non - Waiver. Waiver by the City of any provision of this Agreement or any time limitation provided for in this Agreement shall not constitute a waiver of any other provision. 14. Termination. A. The City reserves the right to terminate this Agreement at any time by giving ten (10) days written notice to the Consultant. B. In the event of the death of a member, partner or officer of the Consultant, or any of its supervisory personnel assigned to the project, the surviving members of the Consultant hereby agree to complete the work under the terms of this Agreement, if requested to do so by the City. This section shall not be a bar to renegotiations of this Agreement between surviving members of the Consultant and the City, if the City so chooses. 15. Applicable Law; Venue; Attorney's Fees. This Agreement shall be subject to, and the Consultant shall at all times comply with, all applicable federal, state and local laws, regulations, and rules, including the provisions of the City of Tukwila Municipal Code and ordinances of the City of Tukwila. In the event any suit, arbitration, or other proceeding is instituted to enforce any term of this Agreement, the parties specifically understand and agree that venue shall be properly laid in King County, Washington. The prevailing party in any such action shall be entitled to its attorney's fees and costs of suit. Venue for any action arising from or related to this Agreement shall be exclusively in King County Superior Court. 16. Severability and Survival. If any term, condition or provision of this Agreement is declared void or unenforceable or limited in its application or effect, such event shall not affect any other provisions hereof and all other provisions shall remain fully enforceable. The provisions of this Agreement, which by their sense and context are reasonably intended to survive the completion, expiration or cancellation of this Agreement, shall survive termination of this Agreement. Entire Agreement; Modification. This Agreement, together with attachments or addenda, represents the entire and integrated Agreement between the City and the Consultant and supersedes all prior negotiations, representations, or agreements written or oral. The project will include the following sites: Site 1: S 164th Street, Dead end east of 51St Avenue S Replace and/or slipline 12 -inch pipe through easement on private parcel. Install new catch basins and restore connections to yard drains. Site 2: 14148 34th Place South Replace brick manholes and damaged storm drain. Pipe will be re- routed down driveway in -lieu of current routing beneath shed and large tree. Prepare revised easement for new pipe location. Slipline downstream pipe segment if possible. Site 3: 14028 33td Avenue S Drainage in roadway depression overflows into private property. Install thickened edge, catch basins, and approximately 500 feet of 12 -inch storm drain to connect to existing roadway drainage system to south. Site 4: 14229 34th Avenue S The parking lot floods due to plugged pipe on adjacent property that formerly connected to roadway drainage system. Install 2 catch basins and approximately 100' of storm drain to provide connection to roadway drainage system. The Consultant shall provide necessary surveying, project design, quantity and cost estimates, and utility coordination required to complete final bid documents. It is anticipated that sites will be bid as a single bid package for the 2013 Small Drainage Program as budget or other considerations allow. The Consultant shall provide surveyed base maps with horizontal utility locations, or base maps created from field measurements, ortho - photography, and GIS data as necessary for each site. If necessary, surveyed base maps will include right -of -way line work. Project horizontal and vertical datum will be assumed on all sites. The Consultant shall provide assistance to the City with preparation of a SEPA checklist. No additional permits are anticipated. City of Tukwila 2013 Small Drainage Program Page 1 of 4 KPG, Inc. May 15, 2013 13 For the 2013 Small Drainage Program, the Consultant shall submit a 50% Review Submittal (plans and estimate only), and a 90% Review Submittal that includes plan, specifications and estimate to the City for review prior to bidding. It is the Consultants understanding that none of the 2013 Small Drainage Program sites require biological assessments, additional permits beyond those listed, wetland delineations, geotechnical review, detention facilities, or water quality treatment facilities. The budget assumes a straightforward approval process with no special studies or extensive coordination. SCOPE OF WORK TASK 1— 2013 Small Drainage Program Design 1.1 MANAGEMENT /COORDINATION /ADMINISTRATION • The Consultant shall provide continuous project management and administration for the duration of the Project. (Estimate 3 months). • Hold project coordination meetings with the City to update progress and review submittals. Assume (3) meetings. • The Consultant shall provide monthly status reports and billings. • The Consultant shall provide independent QA /QC reviews by senior in -house staff of all deliverables prior to submittal to the City. 1.2 TOPOGRAPHIC SURVEY /UTILITY LOCATES • The Consultant shall prepare base maps for each 2013 Small Drainage Program sites. Topographic survey will be performed for all sites including horizontal utility locations within the right of way. • Obtain title reports and prepare legal descriptions for up to 3 parcel easements. 1.3 PREPARE PLANS • The Consultant shall prepare final Plans for the proposed improvements including the following: o Plans shall be prepared with such provisions in such detail as to permit field layout and construction within a degree of accuracy acceptable to the City and per industry standards. o It is assumed there will be six (6) plan sheets at 1 " =20' scale full size (22" X 34 "), 1 " =40' at reduced scale (11" X 17 "). o Details will be prepared for items not available as standard details from the City, State, or WSDOT standard drawings. o The plans shall illustrate complete details of construction of the proposed improvements including limits of construction and removals, proposed invert elevations, rim elevations and required construction materials. EMWS Emergency Storm Pipe Repair 11 -19 -12 Status Update Staff provided a status update of the East Marginal Way South (EMWS) Emergency Storm Repair 11/19/12 Project. On November 19, 2012 a large sinkhole was created by a break in a 30 -inch storm water line on EMWS just south of South 124th Street. The City contracted with KPG in April to design a replacement for the failing pipe, and ensuing geotechnical investigations revealed contaminated soils that must be properly handled during design and construction. Due to this discovery, staff is recommending that construction of the EMWS repair be postponed until summer 2014 to allow sufficient preparation as well as to avoid cost overruns. Additionally, this will free up funding for other critical projects in 2013. The EMWS project construction can be included in the next Capital Improvement Program cycle. INFORMATION ONLY. B. 2013 Annual Small Drainage Program Consultant Selection and Agreement Staff is seeking Council approval of a consultant agreement with KPG, Inc. in the amount of $43,372.81 for design of the 2013 Annual Small Drainage Program. Because of the availability of funds due to the postponement of the EMWS Emergency Storm Repair Project mentioned above, the City can proceed with the design of four "work critical" projects in 2013. The following projects were selected because they can be designed and constructed quickly, and do not require outside agenda permits: 1. S 164`h St east of 51' Ave S 2. 14148 34`h P1 S 3. 33`d Ave S between S 140`h St and 34th P1 S 4. 14229 34t Ave S KPG, Inc, PACE Engineers, and CH2M Hill were short- listed for the design work on this program. Section 2. TMC 16.04.020 Amended. Ordinance Nos. 2121 §1 (part) and 2171 §1 (part), as codified at TMC Section 16.04.020, "Codes Adopted," are amended to read as follows: 16.04.020 Codes Adopted Effective July 1, 2013, the following codes are adopted by reference as if fully set forth: 1. The International Building Code, 2012 Edition, and referenced standards hereto as published by the International Code Council, Inc., and as adopted by the State of Washington in Chapter 51-50 WAC. The following Appendices, standards and amendments are specifically adopted: a. Appendix E, Supplementary Accessibility Requirements. b. ICC/ANSI A117.1- 2009, American National Standard. c. Work exempt from a building permit. Section 105.2 of the International Building Code, 2012 Edition, is amended to include provisions regarding the following work exempt from a building permit: (1) Work performed by the City of Tukwila and located in City of Tukwila right-of-way; work performed by Washington State Department of Transportation and located in WSDOT right-of-way to include public utility towers and poles, mechanical equipment not specifically regulated in this code, hydraulic flood control structures including levees; provided that any structure or building constructed in a municipal or state right-of-way and intended to be used as any occupancy classification of the State Building Code is not exempt from the provisions of this code or the related permit requirements. (2) One-story detached accessory structures used as tool and storage sheds, playhouses and similar uses, provided the floor area does not exceed 120 square feet, and such structure is outside of and entirely separated, as prescribed by Code, from any existing building on the premises. 2. The International Residential Code, 2012 Edition as amended by the State; provided that Chapters 11 and 25 through 43 of this code are not adopted. Provided further that those requirements of the Uniform Plumbing Code relating to venting and combustion air of fuel fired appliances as found in Chapter 5 and those portions of the code addressing building sewers are not adopted. Appendixes A, B, D, E and 1 of the Uniform Plumbing Code are hereby adopted by reference. Provided further that the following amendments to the Uniform Plumbing Code are adopted: a. All reference to and definition of "authority having jurisdiction" is deemed to refer to and shall mean the "Building Official." b. Water Supply and Distribution. Cross connection control for premises isolation related to the City's public water system shall be in accordance with the City of Tukwila Public Works Department's "Development Guidelines and Design and Construction Standards." Cross connection control for premises isolation related to water purveyors outside of the City of Tukwila water system shall be in accordance with that water purveyor's policies and standards. c. Sanitary Drainage. Side sewer, private sewer main extensions beyond a point defined in the plumbing code as the building drain, and required grease interceptors all within the City's sewer districts shall be in accordance with the City of Tukwila Public Works Department's "Development Guidelines and Design and Construction Standards," in conjunction with the Uniform Plumbing Code requirements. "Sanitary drainage, side sewers, private sewer main extensions beyond the building drain and grease interceptors outside the Tukwila sewer district shall be in compliance with that purveyor's policies and standards. 4. The International Mechanical Code 2012, as published by the International Code Council and as amended by the State of Washington, Chapter 51-52 WAC. 5. The International Fuel Gas Code, 2012 Edition, as published by the International Code Council, Inc. and as amended and adopted by the State of Washington. 6. The Washington Cities Electrical Code. Article 80.3 of the National Electrical Code: The 2008 Edition of the National Electrical Code (NFPA 70), including Annex A, B and C; the 2007 Edition of Standard for the Installation of Stationary Pumps for Fire Protection (NFPA 20-2007); the 2005 Edition of Standard for Emergency and Standby Power Systems (NFPA 110-2005); Commercial Building Telecommunications Cabling Standard (ANSITTIA/EIA 568-B.1 June 2002 including Annex 1 through 5); Commercial Building Standard for Telecommunications Pathway and Spaces (ANSUTIA/EIA 569-A-7 December 2001 including Annex 1 through 4); Commercial Building Grounding and Bonding Requirements for Telecommunications (ANSI/TIA/EIA 607-A-2002); and the Residential Telecommunications Cable Standard (ANSITTINEIA 570-B-2004 are adopted and shall be applicable within the City of Tukwila as amended, added to and excepted in the Washington Cities Electrical Code. The Building Official may refund any permit fee paid by the original permit applicant that was erroneously paid or collected. The Building Official may also authorize the refund of not more than 80% of the permit fee when no work has been done under a permit issued in accordance with the code. Where a plan review fee has been collected, no refund will be authorized once it has been determined that the application is complete and the plan review process has commenced. Refund of any permit fee paid shall be requested by the original permit applicant in writing and not later than 180 days after the date of fee payment. 4. Expiration of Permits. All building, mechanical, plumbing, fuel gas piping and electrical permits shall become invalid unless the work on the site authorized by such permit is commenced within 180 days after issuance or the work is suspended or abandoned for a period of 180 days after the time the work is commenced. The Building Official may grant one or more extensions for periods not more than 180 days each. The extension shall be requested in writing and justifiable cause demonstrated. All extension requests beyond one year shall include an administrative fee of $65.00 with the extension request. 5. Appeals. All references to Board of appeals is amended as follows: Any person, firm or corporation may register an appeal of a decision or determination of the Building Official provided that such appeal is made in writing within 14 calendar days after such person firm or corporation shall have been notified of the Building Official's decision. Any person, firm or corporation shall be permitted to appeal a decision of the Building Official to the Tukwila Hearing Examiner when it is claimed that any one of the following conditions exists. a. The true intent of the code or ordinance has been incorrectly interpreted. b. The provisions of the code or ordinance do not fully apply. c. The decision is unreasonable or arbitrary as it applies to alternatives or new materials. d. Appeals procedures shall be in accordance with TMC Chapter 18.116.030. 6. Violations. Whenever the authority having jurisdiction determines that there are violations of this code, a written notice shall be issued to confirm such findings. Any Notice of Violation issued pursuant to this code shall be served upon the owner, operator, occupant or other person responsible for the condition or violation, either by personal service or mail, or by delivering the same to and leaving it with some person of responsibility upon the premises. For unattended or abandoned locations, a copy of such Notice of Violation shall be posted on the premises in a conspicuous place, at or near the entrance to such premises, and the Notice of Violation shall be mailed by registered or certified mail, with return receipt requested, to the last known address of the owner, occupant or both. Any person, firm or corporation who shall willfully violate or fails to comply with a Notice of Violation is liable for the monetary penalties prescribed in TMC Section 8.45.100.A.2. Section 5. Ordinance Nos. 2121 §1 (part) and 2171 §1 (part), as codified at TMC Section 16.04.160, "Washington State Energy Code Adopted," are repealed, thereby eliminating TMC Section 16.04.160, "Washington State Energy Code Adopted." The following statements and processes are adopted for the purpose of guiding compensation programs for employees of the City of Tukwila. A. Information to be provided to the City Council. 1. For Represented Employees. A written presentation of current internal and local external public agency salary and benefit trends, including a salary and benefits market survey of comparable jurisdictions, as defined herein, will be provided to the City Council. This presentation must be made to the Council prior to the commencement of negotiations with the bargaining units regarding salary and benefits. The City Council and Administration will discuss represented employee group negotiation expectations, negotiating points, salary and benefit change floors and /or ceilings prior to the beginning and at appropriate points during negotiation sessions. 2. For Non - Represented Employees. A written presentation of current internal and local external public agency salary and benefit trends, including a salary and benefits market survey of comparable jurisdictions, as defined herein, will be provided to the City Council every year that a non - represented salary increase is due. Relevant Association of Washington Cities (AWC) data from the previous year's Washington City and County Employee Salary and Benefit Survey, for the comparable jurisdictions, will be used in the salary market survey. B. Compensation Policy. 1. All Puget Sound jurisdictions with +/ -50% of Tukwila's annual assessed valuation, based upon the Department of Revenue data, will be used to create the list of comparable jurisdictions for evaluation of salary information. It is desirable to use the same comparable jurisdictions for both represented and non - represented employee groups. 2. For non - represented employees, the City desires to pay the average salary for the particular pay scale, as derived from the comparable jurisdiction data described in Section B.1. If the City's pay scale for any classification does not represent the average of comparable salary ranges ( +/ -5 %), written justification must be provided to the City Council. For represented employees, the City desires to pay salaries that are competitive to the City's comparable jurisdictions. 3. The cost -of- living adjustment (COLA) in odd - numbered years for non - represented employees shall be based upon 90% of the Seattle- Tacoma - Bremerton Consumer Price Index (CPI -W) Average (June to June). It is desirable to calculate represented cost -of- living adjustments the same way, unless a different method is authorized by the Council. The goal of the City is to mitigate or avoid salary compression issues where possible. An example of Ssalary compression may exist would be when a non - represented supervisor earns less, or is projected to earn less than those that he /she supervises due to contracted wage increases. 6. If the Administration determines that a deviation from the above process (in its entirety or for individual positions) is necessary, it will provide justification to the City Council for review and approval prior to the adoption of any process change. The executive board and steering committee will hold a retreat on June 12th to review the organization's purpose, workplan, and budget. • Federal Fiscal Grant Manaqement Course in Washinqton D.C.: The Administrative Support Specialist from the Professional Standards Division of the Tukwila Police Department attended a Federal Fiscal Grant Management Course in Washington D.C. The Growth Management Act states that all city and county comprehensive plans must have a transportation element that includes the TDM activities and strategies. • Healthy Planninq Toolkit - Interagency Workinq Group: The meeting focused on the structure of the group, what the different jurisdictions and agencies wanted from the planning toolkit and the form the toolkit should take. Staff recommended a focus on lower cost projects with regional planning /code examples. 45 City Administrator Report Page 2 • Growinq Transit Communities - South Corridor Task Force: PSRC staff reviewed the changes that went into May's Public Review Draft of The Growing Transit Communities Strategy. PSRC staff encouraged members to have their respective boards and councils submit public comment on the strategy document (link has been routed to Council). Further communications will be conducted over email. The Task Force may be reconstituted in the future for use as a sounding board. 11. Community Events • International Potluck: Human Services staff attended an International Potluck at Cascade View Elementary on May 30. • Pitch In for Parks: Community Clean -up event at Cascade View Community Park is scheduled for June 1. • Special Olympic Swimminq: Ten Special Olympian athletes and four unified athletes will represent the Tukwila in the season ending Special Olympic Washington State Games this Saturday, June 1, at the King County Aquatic Center in Federal Way. III. Staff Updates Public Safety • Emergency Response Mobilization: Fire Department mobilized personnel and resources for potential response to the Skagit River 1 -5 Bridge Collapse. The potential existed for an extensive search of an extensive area down river from the collapse. Fortunately our city's services were not needed. Project Updates • Transit Center /Andover Park West: Staff continues to negotiate with a few property owners, but at this time have been unable to reach a successful conclusion. In order to preserve state funding and maintain grant obligation schedules, staff may have to use the authority granted by the Council at the beginning of this process. • Urban Renewal: The appraiser conducted site visits of the properties. Staff began site visits and discussions with property owners. We encourage people interested in the project to sign up for official updates at: www,tukwilawa,gov /urbanrenewal , html. • Fire Department Strateqic Plan: The Fire Department will begin the process of forming a strategic plan on Thursday May 30. BERK and Associates will facilitate the process. The project should conclude by the end of the year and will complement the 2012 City plan. • Parks Recreation and Open Space Plan (PROS): A Community Workshop was held on May 22 at the Tukwila Community Center. Those in attendance offered a lot of good input for the process. A Community Leaders Focus Group is scheduled for May 29 from 4 -6pm at the Tukwila Community Center. Move & Learn sessions are scheduled for June 1 at Cascade View Community Park. Survey is still available on -line and in written form. • Staff Recoqnition: Parks and Recreation staff attended the Annual Conference for the Washington State Association of Senior Centers. 2 staff members were recognized at the conference: Sheri McConnaughey was presented with the "Professional of the Year" award, and Jamie King won the "Rising Star" award. • Comprehensive Plan Update: The Planning Commission continued its phased review of the Comprehensive Plan update with consideration of the Southcenter /Urban Center and Transportation elements at a work session on May 21, and a public hearing on May 23. The Planning Commission directed staff to prepare new policies that support vehicle share and electric charging /alternate fuel facilities. Afterward, they accepted 46 City Administrator Report Page 3 the proposed changes and forwarded their recommendation to the City Council for consideration and action later in the year. • Strategic Plan Implementation: On May 20 -22, City staff (36) participated in High Performance Organization training, facilitated by Tony Gardner (Commonwealth Center for High - Performance Organizations) in support of the Goal #4 of the City's Strategic Plan to create "A High - Performing & Effective Organization ". This 3 -day workshop highlighted leadership models and competencies, motivation and behavior, and provided insights on how changing leadership can support positive change in organizations. Training will continue across all departments throughout the year. Additional tools and processes will be identified for sharing information across all City staff. Community Services • Spray Park at the Tukwila Community Center: Opened as scheduled for the Memorial Day weekend. Due to the weather, there was minimal use. • Cottage Creek: DCD and Parks Department staff supported volunteers from Prologis, a Tukwila company in weeding and planting the Cottage Creek buffer on Friday afternoon. • Recyclinq Proqram Events: The Recycling Program sponsored the following activities: • Staffed a booth at BECU's community secure paper and CD shredding event to provide information on waste prevention and recycling to area residents; • Provided an Earth Day pledge for Tukwila employees promoting simple actions to reduce resource use at work. 50 employees signed the on -line pledge, and received a reusable shopping bag as an incentive. • Co- sponsored a Residential Recycling Collection Event with the Fire Department at the Tukwila Village site on May 18. 443 carloads arrived with a total of over 22 tons of recyclable material collected. The event also included a sale of recycled content rain barrels to Tukwila residents. Some highlights were the collection of: 1) 22, 550 pounds of scrap metals, appliances, and electronic equipment to be sorted and recycled by metal recyclers in Seattle; 2) 250 gallons of used motor oil and petroleum products to be re- refined into new motor oil or used as bunker fuel, and 3) 104 used tires that will be either re- treaded or chipped and made into products such as garden hoses, playground mats and road bedding; 4) 17 sinks to be processed as concrete materials. IV. Responses to Council /Citizen Inquiries • Grande Terrace Apartments: The Police Department notified Code Enforcement of a car accident which severely damaged a carport support post and a portion of the apartment building "B ". Code Enforcement and a Building Inspector investigated and posted a red tag requiring that the carport structure be either repaired or removed entirely. Permits have been issued.
