WHEREAS, The City of Tukwila and The Independent Water Company
entered into a water agreement dated January 3, 1972 which said agreement provided for
purchase by the City of Tukwila of the water distribution system owned by The
Independent Water Company, on terms to be negotiated between the parties; and,
WHEREAS, The City of Tukwila and The Independent Water Company
have had the firm of Botch and Associates make an Inventory and Evaluation, dated
February 8, 1974; and,
WHEREAS, The inventory has since been revised by the City of
Tukwila, dated February 11, 1975, which resulted in a negotiated price of
$32,000; with a minimum down payment of $5,000.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA
RESOLVE AS FOLLOWS:

A RE:SOLUTION OF INTENT TO PURCHASE THE
INDEPENDENT WATER COMPANY
That the City of Tukwila will purchase from The Independent
Water Company all of the assets, whether consisting of real property, personal
property, or mixed, which constitutes the water distribution system owned by The
Independent Water Company on terms negotiated by the parties, at a price of $32,000.
The funds for said purchase are to be provided solely from Water Department revenues
of the City of Tukwila. Attached is Exhibit A, "Service Area Map" as approved by the
State of Washington Department of Utilities and Transportation, defining the service
area of The Independent Water Company, and is hereby incorporated as a part of this
resolution. Such proposed contract shall be negotiated and fully executed on or
before July 1, 1976.
PASSED BY THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON,
at a regular meeting thereof this 21 day of June 1976
