RESOLUTION NO. 546
WHEREAS, the Governor of the State of Washington has authorized
the formation of voluntary utility coordinating councils in lieu of pending
mandatory requirements, and
WHEREAS, the City of Tukwila wishes to enter into an agreement
with the local King County One -Call System for the purpose of providing
a central location for all public utility information through the individual
public utilities;
NOW, THEREFORE, the City Council of the City of Tukwila, Washington,
does resolve as follows:
The Mayor is authorized to execute the subsequent Principal
Party Agreement for the purpose of providing a central
location for all public utility information through the
individual public utilities.
PASSED BY THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON,
at a regular meeting thereof this 19th day of July 1976.

Subsequent Principal Party Agreement
Greetings from the "King County One -Call System The
attached copy of the basic agreement entitled "One -Call
Subsurface Warning_ System King County" is for your
reference.
Besides the original five (5) principal parties to this
agreement, provisions have been made to accept subsequent
parties into the system. By accepting the terms of the
basic agreement except that billing will be on the basis
of 50 per call received, from the Call Center, with a $5
minimum monthly charge in place of the conditions in
Article XIV you may become a member of the One -Call System.
If you are in agreement with this offer, please sign below
and forward the original to me. Your signed application
will then be submitted to the five principal parties for
their acceptance, whereupon you will begin receiving notices
of excavation in your area per the agreement.

FOR
ONE-CALL SUBSURFACE WARNING SYSTEM KING COUNTY
This agreement is made and entered into this
day of ��t� �iL 1976 by and between
WASHINGTON NATURAL GAS COMPANY, SEATTLE CITY LIGHT, PACIFIC
NORTHWEST BELL TELEPHONE COMPANY, KING COUNTY AND PUGET SOUND POWER
AND LIGHT COMPANY, all of whom are hereinafter referred to as the
"Principal Parties and
WHEREAS the Principal. Parties desire to protect their respective
subsurface utility facilities from damage or interference by any
person, firm, corporation, or entity that •intends to excavate,
drill, blast, or otherwise disturb the surface or subsurface of the
earth (hereinafter referred to as "proposed work by providing a
single telephone number as hereinafter provided, thus facilitating
the receipt of notice in advance of such activities and permitting
the Principal Parties to take whatever action they deem appropriate
to prevent damage to their respective facilities and interruption of
their respective utility service to the public; and
WHEREAS it is anticipated that other parties engaged in the
rendering of services to the public having subsurface facilities in
the same area (such parties being hereinafter referred to as
"Subsequent Principal Parties may desire to participate in said
arrangement by entering into separate agreements consistent with the
terms and conditions of this Agreement; and
WHEREAS the Principal Parties desire to set forth their
procedures, responsibilities, and the terms and conditions of this
Agreement;

NOW THIEREFORE in consideration of the p; ;iises and of the mutual
'covenants and agreements hereinafter set forth, the Principal Parties
agree as follows:
ARTICLE I
There shall be established an answering service for the benefit of
all Principal Parties with Washington Natural Gas Company, as Call
Center operator, collecting and disbursing the funds necessary to the
operation of said Center. Said answering service shall be referred to as
"Call Center In the Call Center there shall be installed such
equipment as the Principal Parties may deem appropriate to effectuate
the purposes of this Agreement, which shall include but not be limited
to a system of maps furnished and maintained by the Principal Parties
indicating the boundaries of their operating areas.
ARTICLE II
Each Principal Party shall maintain its own system and facilities
records and shall respond to a call for location to prevent damage to
its facilities in such manner as it deems proper.
ARTICLE III
The Call Center shall furnish and provide such supervision, labor,
materials, equipment, supplies, and services as it may deem necessary
to operate and maintain the Call Center and to further effectuate this
Agreement.
ARTICLE IV
A telephone number shall be assigned to the Call Center to which
calls may be placed by those persons, firms, corporations, utilities
and other entities intending to carry on proposed work.

as, "Underground Utility Locating Service of King County
Each Principal Party shall subscribe as a joint user of that
service and be entitled to an indented sub listing under their firm
name as "Underground Utility Locating Service" and listing the Call
Center telephone number.
ARTICLE V
Telephone calls to the designated number will be accepted by the
Call Center weekdays only during normal business hours. Coverage
from seven o'clock a,m. to six o'clock p.m. is contemplated, but
hours will remain flexible to best suit the traffic.
No calls will be accepted on weekends, holidays or after hours.
ARTICLE VI
The caller will be requested to supply information sufficient
to complete a "Location Request Log" which will be kept on file for
five years.
ARTICLE VII
All calls to the designated telephone number shall be
sequentially numbered as received by the Call Center. These numbers
shall be used in identifying utility location requests forwarded to
the proper Principal Parties.
ARTICLE VIII
The Principal Parties will be notified of utility location
requests received at the Call Center by telephone, teletype,
facsimile or other communication device, as expeditiously and
reasonably practical after receipt thereof during normal business
days and hours.

Each Principal Party shall be individually responsible for taking
such action as it may deem necessary to protect its respective surface
and subsurface facilities and to prevent interruption of its respective
utility service.
ARTICLE X
Washington Natural Gas Company in its capacity as Call Center
Operator, shall secure and maintain in force the following insurance
against its liability as Call Center Operator, during the term of
its participation in this Agreement: comprehensive liability insurance,
including contractual liability insurance for this Agreement with
minimum limits of $1,000,000 for bodily injury per person, $1,000,000
aggregrate and $1,000,000 property damage per occurrence. Such insurance
shall be in such form and with such companies as may be acceptable to
all Principal Parties and shall name the Call Center Operator as insured
thereunder. The cost of such insurance shall be allocated and paid for
prorata as a cost of Call Center operations by all Principal Parties
and Subsequent Principal Parties, per Article XII hereof.
ARTICLE XI
It is understood and agreed that the parties to this Agreement
do not assume responsibility nor shall they be liable for any acts
or omissions of any or all other parties to this Agreement. It is
specifically agreed that services or facilities provided by the Call
Center operator or by the Principal Parties are not for the benefit
of others not party to this Agreement and that no person or other
entities are intended to be, nor shall they be, third party
beneficiaries of or to this Agreement, or of or to the services to be
provided by the Principal Parties hereunder or by the Call Center
operator.

Each Principal Party shall be responsible for a percentage of
all costs and the expenses incurred in the initial establishment of
the Call Center and its services. The percentage breakdown of costs
for the initial establishment and for operation of the Call Center
shall be as follows:
Washington Natural Gas Company 20% 20%
Seattle City Light 20% 20%
Pacific Northwest Bell 20% 20%
King County 20% 20%
Puget Sound Power and Light 20% 20%
ARTICLE XIII
First Monthly
Cost Charges
The Principal Parties shall be individually responsible for all
costs and expenses incurred in the establishment, operation, and
maintenance of telephone, teletype, facsimile or other communication
equipment in their own respective premises or elsewhere for their
internal use.
ARTICLE XIV
Other parties engaged in the rendering of services to the public
having subsurface facilities in King County may, at the option of the
Principal Parties, become secondary parties to this Agreement by
executing a "Subsequent Principal Party Agreement" and by accepting
and agreeing to be bound by the terms and conditions of this
Agreement as, and on the same terms as, other Principal Parties and
by paying their equal share of the monthly costs and expenses as they
become due.

Any amendment this Agreement shall be 4 writing, signed by the
Principal Parties.
ARTICLE XVI
This agreement shall become effective on the day and year first
above written: PROVIDED, HOWEVER, that this Agreement may be terminated
with respect to any Principal Party's participation, including
participation as operator of the Call Center, at any time after the
effective date thereof by 'giving thirty (30) days' written notice to
the other Principal Parties, addressed as follows:

party for any duty or obligation to any other party arising hereunder
which duty or obligation may have accrued or occurred prior to such

OPERATING PROCEDURES CALL CENTER
1. Calls will be received by the Call Center on 682 -5464
approximately 24 hours in advance of excavation. All
telephone conversations will be recorded on tape at
the Call Center and will be kept on file for approximately
90 days.
2. The Call Center operator will obtain the following
information and record it in the Location Request Log:
a. Excavator's name.
h. Excavator's telephone number.
c. .Type of excavation.
d. Work location.
e. City or closest city in King County.
f. A suitable time to meet the excavator on site if
required.
Other information such as job shack location, the
foreman's name, the side of the street the project
will involve, etc.
3. Upon completion of the necessary information on the
Location Request Log, the Call Center operator will
then give the excavator a six digit location request
number. The operator will then record the time of
the request.
4. The Call Center will not give out locations or possible
locations of any utilities. Also, the operator will not
guarantee that locations can be made with less than
24 hour advanced notice.
5. The operator will then notify all principal and subsequent
principal parties of the request for location and give the
parties contacted the location request number. When a party
is notified by telephone, the operator will log the name of
the person contacted as well as the time of notification.
6. Emergency calls will not be accepted by the Call Center
operator. The caller will be directed to re -dial the
appropriate emergency number of the effected utilities.
7. Calls made to the Call Center after normal working hours
will be answered by an announcement tape stating the
Call Center's normal working hours.
