Handouts are available at the Building counter which provide more detailed information on application and plan submittal requirements. Application and plans must be complete in order to be accepted for plan review. VALUATION OF CONSTRUCTION Valuation for new construction and additions are calculated by the Department of Community Development prior to application submittal. Contact the Permit Coordinator at 431 -3670 prior to submitting application. In all cases, a valuation amount should be entered by the applicant. This figure will be reviewed and is subject to possible revision by the Building Division to comply with current fee schedules. BUILDING OWNER / AU :1-'ORIZED AGENT If the applicant is other than the owner, registered architect/engineer, or contractor licensed by the State of Washington, a notarized letter from the property owner authorizing the agent to submit this permit application and obtain the permit will be required as part of this submittal. EXPIRATION OF PLAN REVIEW Applications for which no permit is issued within 180 days following the date of application shall expire by limitations. The building official may extend the time for action by the applicant for a period not exceeding 180 days upon written request by the applicant as defined in Section 304(d) of the Uniform Building Code (current edition). No application shall be extended more than once. Dear Mr. Latimer, I have researched the history of site development with various agencies in order to determine if the existing triplex is legally non - conforming per the Tukwila Zoning Code. This research has shown the following findings: 1. The dwelling was originally built as a single family structure in 1943, converted to a duplex in 1946, and further converted into a triplex in 1958.1 2. The Assessor describes the current building as having 840 s.f. on the first floor, and 840 s.f in a basement (820 s.f. being finished).2 This compares with the 1,852 s.f., basement /main floor structure in the building permit application. 3. The property was originally zoned for single family uses in King County. This zoning was carried forward as R -1 -7.2 upon annexation to the City of Tukwila. 4. King County Assessor notes on the property show the following: a. 1978 -- Structure in poor condition and probably vacant, b. 1988 -- Structure vacant and advertised for sale, c. 1990 -- Structure vacant and uninhabitable, and d. 1993 -- Structure vacant and major renovations observed.4 6. A legally nonconforming use loses its vested rights if it ceases for any reason for a period of more than twenty -four months (TMC 18.70.040(3) (Nonconforming uses)). 7. Residential structures and uses located in any single family or multiple - family residential zoning district and in existence at the time of adoption of this title shall not be deemed non - conforming in terms of bulk, use, or density provisions of this title. (TMC 18.70.050(5) (Nonconforming structures)) 8. There has been a relatively high frequency of sewage spills with one in 1981 and one in 1987. The lack of spills after this date may be due to the structure being vacant (see Finding No. 5b). These facts, lead to the following three conclusions: 1. The use is legally established. -- The existing triplex is determined to be legally established per the records of the Assessor's Office and the Washington State Archives. There is potential conflict between the 1958 triplex conversion and adoption of single family zoning in the King County Zoning Code However, this is determined in your favor because it is not possible to determine when in 1958 the respective events occurred, nor that new County zoning code requirements were immediately and properly implemented. 2. The use is vested. -- The vesting of the triplex is not affected by TMC 18.70.040(3), even if it is shown to have ceased for over 24 months. This is because residential uses are protected from being "nonconforming" in TMC 18.70.050(5). TMC 18.70.040 therefore does not apply. 4King County Assessor's Office Records (ibid). Improvements to the sewerage system are strongly recommended to solve a compelling health and safety problem. -- The record of sewage spills demonstrates'a great public health and safety need to provide sewer service to this property. This department strongly recommends that such be provided immediately. Based on the above information, the Planning Division determines that the proposed action is consistent with the Tukwila Zoning Code and strongly recommends sewers be required prior to occupancy of the structure.
