RESOLUTION AUTHORIZING THE f1AYOR TO EXECUTE AN
ANIMAL CONTROL SERVICE AGREEMENT WITH KING COUNTY,
WASHINGTON, FOR THE PERIOD APRIL 1, 1977, THROUGH
MARCH 31, 1978.
WHEREAS, the City of Tukwila has previously executed a contract
with King County, Washington, for the control of animals, which contract
it wishes to renew and continue through March 31, 1978; and
WHEREAS, the City of Tukwila wishes to include in this agree-
ment the senior citizen program allowing City residents sixty -five years
of age or older the opportunity to purchase a King County pet license
for either dog or cat for the lifetime of the animal.
NOW THEREFORE, the City Council of the City of Tukwila does
resolve as follows:
The City of Tukwila shall renew its animal control
services contract with King County, Washington, for the
period April 1, 1977, through March 31, 1978, and the
Mayor shall execute such an agreement, in addition, said
agreement shall include the Senior Citizen Program.
PASSED BY THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON,
at a regular meeting thereof this 7th day of March 1977.

Attached please find an original and three copies for the
renewal of our interlocal agreement relating to animal control
services.
Enclosed for your information is King County Ordinance No. 2869,
passed by the County Council on September 7, 1976. This ordin-
ance allows County residents sixty -five years of age or older
the opportunity to purchase a King County pet license for either
$8.00 (dog) or $4.00 (cat), good for the lifetime of the animal.
It becomes effective on April 1, 1977.
Therefore, unless we are specifically notified prior to March 1,
1977, to include the senior citizen lifetime pet license program
in your area, we will administer the 1977 pet licensing in the
same manner as in previous years.
It is our hope that you will notify us to include this senior
citizen program, through some official action of your legisla-
tive body. We feel the program is worthwhile and needed. It
should be noted that these senior citizen lifetime pet licenses
will be sold only at our main downtown office, either in person
or by mail.

INTERLOCAL SERVICES AGREEMENT
4 This AGREEMENT, entered into this day of
5 197 between KING COUNTY, State of
6 Washington, hereinafter referred to as the "COUNTY" and the
7 municipal corporation of TUKWILA hereinafter
8 referred to as the "CITY
9 WITNESSETH:
10 WHEREAS, the City, pursuant to RCW 39.34.010 and 39.34.080,
11 and Article I, Section 120 of the King County Charter, is
12 desirious of contracting with the County for the performance of
13 Animal Control'Services and
14 WHEREAS, the County is agreeable to rendering such services
15 on the terms and conditions hereinafter set forth and in consi-
16 deration of payments, mutual covenants and agreements herein
17 contained.
18 IT IS, THEREFORE, covenanted and agreed as follows:
19 1. Obligations: In consideration of the promise of the
20 City and payment of the sum hereinafter set forth, the
21 County promises to:
22 A. Perform to the best of its ability all services
23 relating to licensing and enforcement of City
24 ordinances or resolutions pertaining to Animal
25 Control;
26 B. Provide a level of service which is the same as that
27 of the rest of the unincorporated area of the County;
28 C. Furnish licenses and application forms for said
29 licenses to the City for sale to the public at the
30 City Hall; Provided, however, that said sales at the
31 City Hall shall terminate on the 30th day of June,19

1 In consideration of the promises of the County herein
2 before set forth, the City promises to:
3 D. Enact: an ordinance or resolution, which is substantial
4 ly similar to King County Ordinance No. 1396, as now
5 or hereafter amended;
6 E. Delegate to the County the following:
7 (1) The power to determine eligibility for licenses
8 issued under the terms of the City ordinance or
9 resolution, subject to the conditions set forth in
10 said ordinance or resolution and subject to the
11 review power of the King County Board of Appeals.
12 (2) The power to enforce terms of the City ordinance
13 or resolution, including the power to suspend or
14 revoke licenses issued thereunder, subject to the
15 conditions set forth in said ordinance or resolu-
16 tion and subject to the review power of the King
17 County Board of Appeals.
18 (3) The power and duty to issue notices of violation
19 and court citations shall be jointly exercised by
20 the County and the City.
21 2. Compensation and Method of Payment:
22 The City shall reimburse the County for the services as
23 delineated in this contract in the following manner:
24 A. The County shall receive all fines and fees collected
25 by the County pursuant to the licensing of dogs, cats,
26 kennels, hobby kennels, pet shops, animal shelters
27 and grooming parlors
28 subject to the following rebate provisions:
29 (1) $.80 for each dog license sold at the City
30 Hall shall be rebated to the City;
31 (2) $.50 for each cat license sold at the City

Hall shall be rebated to the City;
(3) $2.50 for each hobby kennel licensed to operate
inside the City shall be rebated to the City;
(4) $25.00 for each kennel, pet shop or animal
shelter licensed to operate inside the City shall
be rebated to the City;
(5) $12.50 for each grooming parlor licensed to
operate inside the City shall be rebated to the
City.
11 B. The County shall receive all impound and redemption
12 fees charged against animals.
13 3. Time of Performance: This agreement shall be
14 effective on the 1st day of April 19 77,
15 and terminate on the 31st day of March 1978.
16 It is further agreed that should both parties desire to
17 continue this agreement after said termination date,
18 this contract may be renewed for a period of one year on
19 the same terms and conditions, upon the giving of
20 written notice by either party to the other not less than
21 thirty (30) days before the expiration of this agreement.
22 4. Modifications: The parties agree that this agreement is
23 the complete expression of the terms hereto and any oral
24 representation or understandings not incorporated herein
25 are excluded. Further, any modification of this agree
26 ment shall be in writing, signed by both parties, and
27 affixed to this original agreement.
28 5. Termination: This agreement may be terminated only after
29 thirty days written notice received by one party given
30 by the other. Failure to comply with any of the provi-
31 sions stated herein shall constitute material breach of

1 contract: and cause for termination. Any termination of
2 this agreement shall not terminate any obligation of
3 either party matured prior to such termination, nor shall
4 it affect the validity of any license issued pursuant to
5 the City ordinance or resolution.
6 6. Hold Harmless: The County agrees to protect and hold
7 harmless the City from and against all claims, demands
8 and causes of action of any kind or character, including
9 the cost of defense thereof arising in favor of third
10 parties on account of personal injuries, death, or damage
11 to property arising from the performance of services
12 herein specified.
13 Both parties understand and agree that the County is acting
14 hereunder as an independent contractor, with the intended
15 following results:
16 A. Control of personnel, standards of performance,
17 discipline, and all other aspects of performance shall
18 be governed entirely by the County;
19 B. All persons rendering service hereunder shall be for
20 all purposes employees of the County, although they
21 may from time to time act as commissioned officers of
22 the City.
23 C. In the event of a dispute between the parties as to the
24 extent of the service to be rendered hereunder, or the
25 minimum level or manner of performance of such
26 service, the determination of the Director of the King
27 County Division of General Services shall prevail
28 unless within ten days of such determination made in
29 writing, the City files a written notice of appeal
30 with the Director. Copies of such notice shall also
31 be filed with the County Executive and the City

Mayor In such event the dispute shall then

2 be submitted for review to a three member panel
3 composed of the County Executive, the City Mayor
4 and a third member of their choosing who shall
5 not be an officer or employee of either the County or
6 the City. A decision or determination agreed upon by
7 a majority of said panel shall be final and conclusive
8 in all respects between the parties hereto.
9 7. Audits and Inspection: The records and documents with
10 respect to all matters covered by this contract shall
11 be subject to inspection, review or audit by the County
12 or City during the term of this contract and seven
13 years `after termination hereof.
14 8. Non Discrimination: The County certifies that it is an
15 Equal Opportunity Employer and has developed and imple-
16 mented an Affirmative Action Program in accordance with

3 IN WITNESS WHEREOF, the parties hereto have caused this

AN ORDINANCE relating to pet license fees, establish-
ing reduced rater for County residents sixty -five
1 years of age or older, amending Ordinance 1396,
Section 1 and King County Code Section 11.04.030.

3 BE IT ORDAINED BY THE COUNCIL OF KING COUNTY:
4 Ordinance 1396, Section 1, and King County Code Section
5 11.04.030(b) is hereby amended as follows:
6 11.04.030 DOG AND CAT LICENSES REQUIRED.
7 (a) LICENSE REQUIREMENTS. All dogs and cats harbored, kept
8 or maintained in King County over four months of age shall be
9 licensed and registered annually; provided however, that dogs kept
10 in kennels need not be licensed as provided in Section 11.04.040.
11 (b) FEES. Dog and cat licenses shall be issued by the
12 animal control authority upon application and payment of an annual
13 license fee made payable to the county treasurer in the sum of
14 eight dollars for dogs, provided that when proof is submitted that
15 such dog has been neutered or spayed the fee shall be four dollars,
16 and four dollars for cats, provided that when proof is submitted
17 that such cat has been neutered or spayed, the fee shall be two
18 dollars. The effective date for such license fees shall be
19 January 1, ].974. King County residents sixty -five years of age
20 or older shall be entitled to purchase a special permanent license
21 for the lifetime of cats or dogs for which they are the registered
22 owners when said animals are maintained at said owner's registered
23 address. Eligible residents may purchase the special permanent
24 animal licenses at a cost of eight dollars per licensed dog and
25 four dollars per licensed cat and they shall not be required to
26 annually purchase a new license for the lifetime of such licensed
27 animals, provided that, no person shall be granted more than three
28 permanent animal licenses for any combination of three cats and
29 dogs for which they are the registered owner; provided further
30 that, the animal control authority is authorized to enact the
31 necessary rules and procedures to efficiently implement the program.
32 The effective date for such licenses ;;hall Le April 1, 1977. The
33 annual license fee shall become due and payable on April 1st of

1 each year. Applications for a dog or cat license shall be on
2 forms provided by the animal control authority. No proration of a
3 license fee for a portion of the calendar year shall be made. All
4 license tags issued herein shall be securely affixed to a substan-
5 tial collar, harness or other means which shall be worn by the dog
6 at all times. As an alternative to a license tag an animal may be
7 identified as licensed by being tattooed on its right ear or on
8 its inside right thigh or groin with a license number approved or
9 issued by the animal control authority.
10 (c) PENALTY. In addition to paying the appropriate license
11 fee a late penalty in the sum of ten dollars shall be charged on
12 all applications received after April 30th and the sum of twenty
13 five dollars shall be charged on all applications received after
14 June 30th of each year. It shall be a rebuttable presumption that
15 an animal has not been licensed unless a proof of purchase, within
16 the preceding thirty days, is presented to the licensing officer
17 or agent, the animal's owner has moved into the county within the
18 preceding thirty days, the animal had been under the age which
19 requires a license, or other proof deemed acceptable in the
20 department's rules and regulations.
21 (d) FEES COLLECTED. All fees and fines collected under this
22 chapter shall be deposited in the county current expense fund.
23 (e) NONAPPLICABILITY. The provisions of this section shall.
24 not apply to dogs or cats in the custody of a veterinarian or
25 animal shelter or whose owners are nonresidents temporarily within
26 the county for a period not exceeding thirty days. The fees
contained herein shall become effective beginning with the 1975
20 license year, except for those relating to_persons age sixty -five
29 and over which shall become effective with the 1977 license year.
