HomeMy WebLinkAboutRes 0574 - Development Agreement - South 143rd Place ImprovementsCITY OF WASHINGTON RESOLUTION NO. 574 RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A DEVELOPERS AGREEMENT WITH JOHN C. RADOVICH TO IMPROVE A PORTION OF SOUTH 143RD PLACE. WHEREAS, the owner of property on South 143rd Place desires to improve the street serving its property by a future local improvement district under the conditions of a developers agreement as provided by Chapter 17.20 of the Tukwila Municipal Code, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, RESOLVES AS FOLLOWS: That the Mayor of the City of Tukwila be and is hereby authorized to enter into an agreement with the property owner, John C. Radovich, to provide for development of South 143rd Place, all in accordance with Chapter 17.20 of the Tukwila Municipal Code. A copy of said agreement is attached hereto and incorporated herein by reference. Bauch, Mayor Maxine Anderson City Clerk DEVELOPERS AGREEMENT s Alb S7 The City of Tukwila, a municipal corporation in the State of Washington, hereinafter referred to as "City and John C. Radovich and Carol D. Radovich hereinafter referred to as "Developer agree as follows: WHEREAS, the City operates and maintains within its boundaries a system of water distribution, sewer collection and storm drainage facilities and a system of paved streets all within its boundaries, which can serve the property of the Developer, and WHEREAS, the City has a comprehensive plan covering water, sewer ON and storm drainage facilities and minimum standards for the control and design of same within the City, as well as paved streets, and Na WHEREAS, Developer agrees to participate equitably in a future 60 local improvement district or other development method for the improvement of South 143rd Place which includes, but is not limited to, widening, grading, paving, curbs and gutters, sidewalks, storm drainage, water distribution, street illumination and right -of -way acquisition to the requirements of the Director of Public Works, and as hereinafter called the "Development NOW, THEREFORE, IT IS AGREED: 1. John C. Radovich and Carol D. Radovich is in fact the actual owner of the land or real property for which the Development is requested. 2. The land or real property for which the Development is requested and to which this agreement applies is real estate in Tukwila, Washington, described as Lots 38 and 39, Block 17, of Hillman's Seattle Garden Tracts as recorded in Volume 11 of Plats, Page 24, of the records of King County, Washington. 3. The Developer shall not assign this agreement without the written consent of City. THE CITY OF TUKWILA l BY: EDGAR D. BAUCH, MAYOR ATTEST: 4. The City covenants and agrees that it will maintain and operate the Development after satisfactory com- pletion and acceptance in accordance with the terms of this agreement. 5. Partial waiver or waiver by acquiescence by City of any provisions or conditions of this agreement shall not be a waiver of any other provision or condition of this agreement. 6. This agreement shall constitute an easement and servi- tude and a covenant running with the land upon the property described in this agreement and shall be binding upon the heirs, assigns, grantees and successors in the interest to the Developer. 7. The Development will be constructed at such time as the City deems the improvement of South 143rd Place necessary. 8.
