CITY OF TUKWILA
WHEREAS, the City of Tukwila is desirous of acquiring
certain rights-of-way within the City limits of the City of
Tukwila, and
WHEREAS, the Washington State Highway Commission is
willing to transfer said rights --of -way to the City of Tukwila,
NOW, THEREFORE, the City Council of the City of Tukwila,
Washington, resolves as follows:
That the Mayor of the City of Tukwila be and is hereby
authorized to enter into an agreement with the Washington State
Highway Commission as contained within Relinquishment Agreement
GM -913, all in accordance with the laws of the State of Washington
and the City of Tukwila.
A copy of said agreement is attached hereto and incorporated
herein by reference.
Passed by the City Council of the City of Tukwila, Washington,
at a regular meeting thereof this ,2nd day of May 1977.

RESOLUJTION AUTHORIZING THE MAYOR TO ENTER
INTO A RELINQUISHMENT AGREEMENT (GM -913)
WITH THE STATE OF WASHINGTON, WASHINGTON
STATE HIGHWAY COMMISSION, IN REFERENCE TO
RELINQUISHMENT OF CERTAIN RIGHTS -OF -WAY.

the State of Washington, acting through the Washington State Highway Commission and the
Director of Highways, hereinafter called the "State" and the City of Tukwila, hereinafter
called the "City
WHEREAS, the State has constructed certain grade intersections and rearranged City
streets as a part of the improvement of SR 405, Jct. SSH 2 -M to Jct. PSH No. 2 in Renton,
through the City of Renton. as shown in red on sheets 1 through 3 of 3 sheets of Exhibit
"A", and
WHEREAS, the said improvement were constructed in accordance with the Contract
Plans and Specifications and it is desirable to set out the responsibility of the State
and the City in the maintenance of these roadways, and
WHEREAS, such an agreement for maintenance responsiblity is provided for by RCW
47.24.010, it is mutually agreed that:

The City shall accept the frontage roads, rearranged City streets and access roads
shown in red on the attached Exhibit A as City streets and shall relieve the State
from all responsibility in. the operation of these roadways as public thoroughfares upon
acceptance by the City.

The City shall perform all maintenance, repair, or reconstruction of the frontage
roads, rearranged City streets and access roads, including rights of way, as shown in
red on the plans marked. Exhibit "A sheets 1 through 3 of 3 sheets, attached hereto and
by this reference made a part of this agreement. Exhibit "A" is illustrated as follows:
Red indicates construction improvements to be relinquished to the City, and yellow in-
dicates an area within the highway right of way at a separated crossing to be maintained
and reconstructed by the City. Except for snow and ice removal, maintenance and
reconstruction to "as-built" standards of the separation structure shall be the
responsibility of the state.

The State shall convey to the City by Deed all the right of way shown in red
on the attached Exhibit "A" within six (6) months from notice of intent to transfer
jurisdiction to the City.

No liability shall attach to the State or the City by reason of entering into
this agreement except as expressly provided herein.
IN WITNESS WHEREOF, the parties hereto have executed this agreement on the day
and year first above written.
