RESOLUTION NO. 587
RESOLUTION OF THE CITY OF TUKWILA, WASHINGTON, URGING
THE FEDERAL COMMUNICATIONS COMMISSION TO CONSIDER THE CITY
AS A COMMUNITY AND PERMIT ALL CABLE TELEVISION SYSTEMS
OPERATING IN SUCH AREA TO CARRY CANADIAN TELEVISION SIGNALS.
WHEREAS, the City of Tukwila, King County, Washington as defined
by the United States Bureau of Census is a statistical area, and the City
of Tukwila, Washington, is closely identified with and has similar interests
and concerns as South King County, as described in King County Motion 2119;
WHEREAS, the Canadian signals have been cirandfathered in South
King County, as also defined in King County Motion 2119, dated August 25, 1975;
WHEREAS, South King County comprises an area south of Seattle has
relatively recent suburban expansion with the location of major industries;
high percentage of residents employed at industries located within the
community, with median income slightly below county average, Green River
Community College and Hinhline Community College, both available as
possible centers for community access television activities;
WHEREAS, the Federal Communications Commission has granted
licenses to carry Canadian television signals to some, but not all, of the
cable television companies serving said discrete area;
WHEREAS, the effect of this licensing system has been to allow
some residents of South King County to receive Canadian television programs,
and not others, which effect is discriminatory and without rational
justification;
WHEREAS, it is in the public interest to provide all residents
of the South King County area with an equal opportunity to view Canadian
television; and
WHEREAS, an application for Cable Television Certificate of
Compliance has been filed pursuant to Section 76.11 and 76.13 of the
Commissions Rules and Regulations by TELEPROMPTER OF SEATTLE, Code
No. WA 0205, File No. CAC 1543 and CAC 6139.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF TUKWILA AS FOLLOWS:
That the City of Tukwila requests and urges the Federal Communications
Commission to consider the City of Tukwila, a part of the South King County
area, as a community in granting licenses for carriage of Canadian television
signals and to grant immediately to each and every cable television company
operating in said area the right to carry such signals to subscribers.

at a regular meeting thereof this 6th day of June 1977.

Pursuant to Sections 76.11 and 76.13 of the Commission's
Rules and Regulations, Crystal Cablevision, Inc. and Northwest
Cablevision, Inc., d /b /a Teleprompter of Seattle (TPT), hereby

Application.

5. The system is operating in communities located
within the Seattle- Tacoma, Washington, major television market,
which is designated by Section 76.51(a) as the 20th television
market. While carriage of the above requested signals is normally
inconsistent with the Commission's Rules, TPT believes that
carriage of said signals is in the public interest and respect
fully requests special relief for such carriage.
6. A showing of consistency with the Commission's
access channel and other non broadcast cable service regulations
is as follows:
(a) If the system has at least 3500 subscribers or
when it gains at least 3500 subscribers, the system will have at
least 120 MHz of bandwidth, and the technical capacity for non
voice return communications by June 21, 1986, unless a waiver of
the regulations is subsequently obtained; provided, however, that
if the system had at least 120 MHz of bandwidth on June 21, 1976,
the system is not required to modify its facilities to provide the
technical capacity for nonvoice return communications.
(b) If the system has at least 3500 subscribers or
when it gains at least 3500 subscribers, the system (to the

extent of its available activated channel capacity) will provide
a channel for the following purposes: public access, educational
access, local government access, and leased access, and in any
event one full channel for shared access purposes, consistent
with Section 76.254 of the Commission's Regulations.
(c) If the system has at least 3500 subscribers or
when it gains :3500 subscribers, the system will have equipment
available for :Local production and presentation of non automated
cablecast programming and will permit its use for public access
services. The system will not exercise, consistent with Section
76.256(b) of the Commission's Regulations, control over the content
of access cablecast programs, but will adopt operating rules
(including a schedule of charges consistent with Section 76.256(c))
consistent with Section 76.256(d) of the Commission's Regulations.
(d) To the extent that the Commission has lawfully
preempted the regulation of access channels and other nonbroadcast
cable services, the system will comply with Section 76.258 of the
Commission's Regulations.
(e) During the time the system has fewer than 3500
subscribers, if it provides access services, the system will
comply with the provisions of Sections 76.256(b) and (d) of the
Commission's Regulations.
7. A. copy of the complete Application has been served
on the franchising authorities and if such Application is not

made available for public inspection by the franchising authorities,
applicant will provide for such inspection at the business office
of the system at any time during regular business hours.
8. An Affidavit of Service required by Section 76.13
(b)(6), of the information described in Section 76.13(b)(1) of
the Commission's Rules and Regulations, is attached hereto, identi-
fied as Exhibit. A, and is incorporated herein by this reference.
The filing fee required to be paid under the terms of Section 1.1116
of the Commission's Rules and Regulations has been suspended.
WHEREFORE, it is respectfully requested that a Certificate
of Compliance be issued expeditiously to TPT for carriage of
television signals on each of its cable television systems serving,
respectively, Medina, King County (North), Issaquah and Tukwila,
Washington.

Application are true and correct to the best of his knowledge and
belief and are made in good faith.
