RESOLUTION NO. 593
RESOLUTION AUTHORIZING THE MAYOR
TO EXECUTE A WATER AGREEMENT WITH
WATER DISTRICT 38.
WHEREAS, the City of Tukwila has negotiated a Water
Agreement with Water District 38,
NOW, THEREFORE, BE IT RESOLVED that the Mayor is
authorized to execute the Water Agreement, a copy of which is
attached hereto and incorporated herein by reference.

This is an agreement between the City of Tukwila (herein-
after referred to as TUKWILA) and King County Water District No.
38 (hereinafter referred to as DISTRICT 38).
RECITALS:
WATER AGREEMENT
1. Tukwila and District 38 are currently in negotiations
for transferring o:E common service areas for better and more economi-
cal service to the citizens of the Tukwila and District 38.
2. District 38 desires to purchase water from Tukwila
and Tukwila desires to sell water to District 38.
3. In light of duplication and parallel services, and
the deterioration of District 38 system, this agreement provides for
an effective method of serving citizens of the Tukwila Planning Area.
NOW, THEREFORE, For good and valuable consideration, the
parties agree as follows:
1. Tukwila agrees to sell and deliver water to District
38 through meters to be installed and owned by District 38. The
charge for this service to District 38 shall be sixtv -seven cents,
67 per one hundred (100) cubic feet based on actual flow
through the meters until 12:00 A.M. Midnight, 31 January 1977.
After 31 January 1977, it is recognized by Tukwila and
District 38 that a surcharge will be placed upon Tukwila for storage
deficiency as currently covered under Ordinances of the City of
Seattle. In accordance with this, a surcharge of approximately
six cents 6 t) per one hundred (100) cubic feet will
be added to the billings to District 38 commencing 1 January 1978.
Said actual demand charge to be added will be determined on an annual
basis based on the total demand charge divided by the total cubic
feet of water utilized by Tukwila through its interties with the
Seattle Water Department.
2. District 38 agrees to and will allow Tukwila to
read said meters and check calibration of same as deemed necessary
by Tukwila. In the event that calibration tests indicate the meters'
reading more than ten percent (10 slow of actual flow, District 38
agrees to correct meter reading within the ten percent (10%) value
as herein stated.
3. In the event of a leak between the Tukwila main and
the District 38 meters, District 38 agrees to pay full cost for repair
of same by Tukwila forces.
4. If any of the above mentioned items are in default,
Tukwila has the right, with a ten (10) day written notice, to terminate
service to District 38.
