NOW, THEREFORE, the City Council of the City of Tukwila,
Washington, does resolve as follows:
The Tukwila City Council hereby authorizes the Mayor to
execute an Interlocal Services Agreement with King County
for animal control services. Said agreement will be
substantially the same as contract in affect at this time
PASSED BY THE CITY COUNCIL OF THE CITY OF TUKWILA, WASSHINGTON,
at a regular meeting thereof this 20th day of March 1978

INTERLOCAL SERVICES AGREEMENT

4 This AGREEMENT, entered into this day of
5 197, between KING COUNTY, State of
6 Washington, hereinafter referred to as the "COUNTY" and the
7 municipal corporation of TIJKWILA hereinafter
8 referred to as the "CITY
9 WITNESSETH:
10 WHEREAS, the City, pursuant to RCW 39.34.010 and 39.34.080,
11 and Article I, Section 120 of the King County Charter, is
12 desirious o:E contracting with the County for the performance of
13 Animal Control Services and
14 WHEREAS, the County is agreeable to rendering such services
15 on the terms and conditions hereinafter set forth and in consi-
16 deration of payments, mutual covenants and agreements herein
17 contained.
18 IT IS, THEREFORE, covenanted and agreed as follows:
19 1. Obligations: In consideration of the promise of the
20 City and payment of the sum hereinafter set forth, the
21 County promises to:
22 A. Perform to the best of its ability all services
23 relating to licensing and enforcement of City
24 ordinances or resolutions pertaining to Animal
�5 Control;
26 B. Provide a level of service which is the same as that
27 of the rest of the unincorporated area of the County;
28 C. Furnish licenses and application forms for said
29 licenses to the City for sale to the public at the
30 City Hall; Provided, however, that said sales at the
31 City Hall shall terminate on the 30th day of June,19 '78

In consideration of the promises of the County herein-
before set forth, the City promises to:
D. Enact an ordinance or resolution, which is substantial-
ly similar to King County Ordinance No. 1396, as now
or hereafter amended;
E. Delegate to the County the following:
(1) The power to determine eligibility for licenses
issued under the terms of the City ordinance or
resolution, subject to the conditions set forth in
said ordinance or resolution and subject to the
review power of the King County Board of Appeals.
(2) The power to enforce terms of the City ordinance
or resolution, including the power to suspend or
revoke licenses issued thereunder, subject to the
conditions set forth in said ordinance or resolu-
tion and subject to the review power of the King
County Board of Appeals.
(3) The power and duty to issue notices of violation
and court citations shall be jointly exercised by
the County and the City.
2. Compensation and Method of Payment:
The City shall reimburse the County for the services as
delineated in this contract in the following manner:
A. The County shall receive all fines and fees collected
by the County pursuant to the licensing of dogs. cats,
kennels, hobby kennels, pet shops, animal shelters and
grooming parlors
subject to the following rebate provisions:
(1) $.80 for each dog license sold at the City
Hall shall be rebated to the City;
(2) $.50 for each cat license sold at the City

1 Hall shall be rebated to the City;
2 (3) $2.50 for each hobby kennel licensed to operat
3 inside the City shall be rebated to the City;
4 (4) $25.00 for each kennel, pet shop or animal
5 shelter licensed to operate inside the City shall.

7 (5) $12.50 for each grooming parlor licensed to
8 operate inside the City shall be rebated to the
9 City.

11 B. The County shall receive all impound and redemption
12 fees charged against animals.
13 3. Time of Performance: This agreement shall be
14 effective on the 1st day of April 1978
15 and terminate on the 31st day of March 19
16 I:t is further agreed that should both parties desire to
17 continue this agreement after said termination date,
18 this contract may be renewed for a period of one year on
19 the same terms and conditions, upon the giving of
20 written notice by either party to the other not less than
21 thirty (30) days before the expiration of this agreement.
22 4. Modifications: The parties agree that this agreement is
23 the complete expression of the terms hereto and any oral
24 representation or understandings not incorporated herein
25 are excluded. Further, any modification of this agree
26 ment: shall be in writing, signed by both parties, and
27 affixed to this original agreement.
28 5. Termination: This agreement may be terminated only after
�9 thirty days written notice received by one party given
30 by the other. Failure to comply with any of the provi-
31 sions stated herein shall constitute material breach of
32

1 contract and cause for termination. Any termination of
2 this agreement shall not terminate any obligation of
3 either party matured prior to such termination, nor shall
4 it a:Efect the validity of any license issued pursuant to
5 the City ordinance or resolution.
6 6. Hold Harmless: The County agrees to protect and hold
7 harmless the City from and against all claims, demands
8 and causes of action of any kind or character, including
9 the cost of defense thereof arising in favor of third
10 parties on account of personal injuries, death, or damage
11 to property arising from the performance of services
12 herein specified.
13 Both parties understand and agree that the County is acting
14 hereunder as an independent contractor, with the intended
15 following results:
16 A. Control of personnel, standards of performance,
17 discipline, and all other aspects of performance shall
13 be governed entirely by the County;
19 B. All persons rendering service hereunder shall be for
20 all purposes employees of the County, although they
21 may from time to time act as commissioned officers of
22 the City.
23 C. In the event of a dispute between the parties as to the
24 extent of the service to be rendered hereunder, or the
25 minimum level or manner of performance of such
26 service, the determination of the Director of the King
27 County Division of General Services shall prevail
28 unless within ten days of such determination made in
29 writing, the City files a written notice of appeal
30 with the Director. Copies of such notice shall also
31 be filed with the County Executive and the City

1 Mayor In such event the dispute shall then
2 be submitted for review to a three member panel
3 composed of the County Executive, the City Mayor
4 and a third member of their choosing who shall.
5 not be an officer or employee of either the County or
6 the City. A decision or determination agreed upon by
7 a majority of said panel shall be final and conclusive
8 in all respects between the parties hereto.
9 7. Audits and Inspection: The records and documents with
10 respect to all matters covered by this contract shall
11 be subject to inspection, review or audit by the County
12 or City during the term of this contract and seven
13 years after termination hereof.
14 8. Non Discrimination: The County certifies that it is an
15 Equal. Opportunity Employer and has developed and imple-
16 merited an Affirmative Action Program in accordance with

1 the guidelines contained in Revised Order 4 of the
2 U.S. Department of Labor.
3 IN WITNESS WHEREOF, the parties hereto have caused this
4 Agreement to be executed the day and year first herein above
5 written.
