HomeMy WebLinkAboutRes 0666 - Interlocal Agreement - Mutual Aid Agreement for Police Services RESOLUTION NO 666 1 A RESOLUTION OF THE CITY OF TUKWILA, WASHINGTON, AUTHORIZING THE MAYOR TO EXECUTE A MUTUAL AID AGREEMENT FOR PUBLIC SERVICES WITH THE MUNICIPALITIES OF RENTON, KENT, AUBURN, AND THE PORT OF SEATTLE. WHEREAS, it is desirable that the police resources of the Municipalities of Renton, Tukwila, Kent, Auburn, and the Port of Seattle be made available to aid and assist each other in preventing and combating potential civil disturbances or riots; and WHEREAS, it is necessary that a cooperative agreement be executed for the interchange of such mutual aid. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DOES RESOLVE AS FOLLOWS: The Mayor is hereby authorized to execute a Mutual Aid Agreement with the Municipalities of Renton, Kent, Auburn, and the Port of Seattle for Police Services to prevent and combat the effects of actual and potential civil disturbances or riots. Said agreement is essentially the same as that attached. PASSED BY THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, at a regular meeting thereof this day of D ec em b e r 1978. INTER- DF�PARTMENTAL MUTUAL AID AGREEMENT (CIVIL DISTURBANCE OR RIOTS POLICE SERVICES) This agreement is entered into pursuant to R.C.W. 39.34, the inter -local cooperation act, and among the following municipalities: Renton, Tukwila, Kent, Auburn, and Port of Seattle. WHEREAS, It is necessary that the police resources and facilities of the above named Cities be made available to prevent and combat the effects of actual and potential civil disturbances or riots, and WHEREAS, It is desirable that each of the parties hereto should voluntarily aid and assist each other in such event, by the interchange of police services and facilities to cope with the problems which would arise in such event; and WHEREAS, It is necessary and desirable that a cooperative agreement be executed for the interchange of such mutual aid on an inter departmental basis; NOW, THEREFORE, IT IS HEREBY AGREED by and each and all of the parties hereto as follows: 1. Each party shall develop a plan providing for the effective mobilization of its police resources and facilities to cope with actual and potential civil disturbances or riots. 2. Each party agrees to furnish such resources and facilities and to render services to each and every other party to this agreement to prevent and combat any such Emergency, Disturbance or Riots in accordance with mutual aid operational plans presently under consideration for adoption, whether heretofore or hereafter adopted, detailing the method and manner by which such Resources, Facilities, and Services are to be made available and furnished, which operational plans may include provisions for Training and Testing to make such mutual aid effective; provided, however, that no party shall be required to deplete unreasonably its own police resources, facilities, and services in furnishing such mutual aid nor to participate if, under certain circumstances, it deems it in its best interests to forego partici- pation. 3. It is expressly understood that this agreement and the operational plans adopted pursuant thereto shall not supplant existing agreements between some of the parties hereto providing for the exchange or furnishing of certain types of facilites and services on a reimbursable, exchange, or other basis, but that the mutual aid extended under this agreement and the operational plans adopted pursuant thereto, shall be without reimbursement unless otherwise expressly provided for by the parties to this agreement and that such mutual aid is intended to be available in the event of an emergency, disturbance or riot of such magnitude that it is, or is likely to be, beyond the control of a single party and requires the combined forces of several or all of the .parties to this agreement to combat. - 4. It is expressly understood that thcb mutual aid extended under this agreement and the operational plans adopted pursuant thereto shall be available and furnished, in accordance with the terms of this agreement, in all cases of actual and potential civil disturbance or riot, and in all cases in which a STATE OF EMERGENCY has been proclaimed as defined in Chapter 12.52 of the King County Code. 5. It is expressly understood that the responsible local official in whose jurisdiction a disorder requiring mutual aid has occurred shall remain in charge at such incident including the direction of such personnel and equipment provided him through the operation of such mutual aid plans. 6. Whenever any public employee of a city, county, or port district, dies or is disabled from performing his duties by reason of engaging in the apprehension or attempted apprehension of law violators or suspected law violators or protection or preservation of life or property, or the preservation of the peace anywhere with- in the jurisdictional limits of the governmental entities named in this agreement, including the local jurisdiction in which he is employed, but is not at the time acting the immediate direction'of his employer, he or his dependents, as the case may be, shall be accorded by his employer the same benefits which he or they would have received had that public employee been acting under the immediate direction of his employer. 7. It is expressly understood that each participating party herein shall continue to maintain insurance coverage on its own personnel whenever giving mutual aid, and furthermore each party shall pay their own employees while such employees are rendering aid pursuant to this agreement. 8. This agreement is intended to supersede and replace any agreement between these parties concerning substantially the same subject matter.
