Rants, Mayor RE: Beverly Hills Apartment Revisions, received 10/12/94 #B94 -0241 Rick Beeler, Director Dear Mr. Porowski, The revised plans do not reflect required changes discussed in the meeting of September 12, 1994. Following are a list of changes required before further review may continue: 1. Landscaping needs to be provided along Pacific Highway as discussed in the meeting. Please show the landscaping on the plan in the location between the south building and the street. Also indicate the type of trees shrubs and groundcover which will be installed. 2. Parking in the northwest corner of the site is still not functional due to the narrow maneuvering area and the change in grade. Eliminate some or all of the stalls in this area to allow adequate vehicle maneuvering. Perhaps eliminating stall number 8 will solve this problem. In addition, dimension stalls on the plan. Standard stalls are 9 x 19 feet and compact stalls are 8 x 16. Up to 30% of the stalls may be compact. Please indicated with a "C" which stalls are compact. 3. The disabled parking stall does not meet State of Washington standards. One van stall, measuring 16 feet in width, needs to be provided. Specify this on the plans in addition to the State required sign at the head of the stall. 4. Provide information regarding the off - premise parking area available to the development as discussed and requested in the September meeting. 6300 Southcenter Boulevard, Suite #100 • Tukwila, Washington 98188 • (206) 431-3670 • Fax (206) 431-3665 Please make these requested revisions and resubmit the plans for zoning final review. Please address the following comments. 1. Provide additional plan details for a Barrier Free parking stall complying to WAC 51 -20 Section 3107. 2. The 'equipment sizing" data submitted to justify the partial use of U -50 windows, is not a recognized justiacation to use the lesser U -value windows per W.S.E.C. However, because of the effort to improve the overall facility, the few prior purchased U -50 windows will be allowed as it would be economically impractical to replace them. 3. The plans must identify and detail any floor level changes resulting from the minimum 7'6' ceiling heights required for the new bedrooms. Also, any doors that swing over these elevation changes must be corrected per U.B.C. Section 3304(i). 4. Provide specific plan reference for plumbing pipe insulation .requirements of W.S.E.C. Section 504.7. 5. Provide location on the plans for required "source specific ventilation' kitchen hoods and show the exhaust capacities needed per Table 3 -1 of Washington State Ventilation Code Section 303.2.1. 6. The existing 2x4 rafter roof framing is described on the plans as "existing roof trusses.' Based on site visits by our department's staff, we do not believe this existing roof framing may be defined as "trusses ", this reference must be removed. In addition, any modification to this existing framing must show that 'conventional construction provisions" described in U.B.C. Section 2517(h), for examples the addition of purlins and braces, etc. 7. The load paths for new wood framing and beam supports have been reasonably identified on your revision. However, it must be demonstrated that all existing footings or foundations supporting the new beam loads for unit #11 are adequate to support the new construction or how they will be reinforced to new code requirements. 6300 Southcenter Boulevard, Suite #100 • Tukwila, Washington 98188 • (206) 431-3670 • Fax (206) 431-3665 October 3, 1994 Beverly Hills Apartment Page 2 8. Provide dimensions of ceiling height or revise the design to provide required height. 9. Anchor bolts 8 inches long .are proposed for the new foundation wall of the converted garages. This must be revised to a bolt length that will accommodate both the required 7 inch minimum embedment per U.B.C. Section 2907(f) and the 2x6 sill plate thickness. 10. A detail should be provided to show how the reinforcement steel in the new foundation is tied to the existing foundations. 11. The plan construction notes must include reference to maintaining and providing fire blocking and draft stops whereever possible. Specific attention must be given to floor and ceiling plate penetration where wiring or plumbing is removed or added. 12. Provide additional details to show accommodation of the minimum attic ventilation requirements in U.B.C. He called the permit counter earlier this morning and stated he is planning to bring the revised plans in today. I'm not sure of how much information you want so have put together the following case history in case you need it. BACKGROUND: Back in mid - August, Vernon Umetus, Planning Dept, asked Bldg Offl and Plan Checkers for some information he needed to prepare a staff study regarding a request for block grant funds from the King Co. rental rehab program. In researching the information for Vernon, it was discovered that the actual amount of work being done on this project far exceeded what had been approved under Building Permit #B94 -0241. That permit had previously been issued based on a work valuation figure of $30,000 shown on the application form. When we found out that the contractor's bid proposal estimate, submitted in April 1994, exceeded $200,000 for the work that was planned, and the figure was still climbing, we initiated a review to determine what work was really being done. Up until that time no inspections had been called for by the contractor. When the building inspector and plan checker visited the site they found that extensive repair work was underway that was not shown on the plans. We subsequently notified the architect of record, verbally and in writing, that construction that exceeded what was shown on the approved plans should be halted and new plans and permit fees would be required. The architect submitted a revision (without paying any additional fees) that showed more details of what they were planning to do, and what had already been done, but still did not have the details or information needed to evaluate the project and perform an in depth plan review. In the meantime, as a result of phone calls from the architect and contractor, and conversations with people in other departments, it became obvious that there could be some major issues raised by all departments involved in the permit process that might add a considerable cost to this project. Just a few of these issues included such things as the possible need to bring the whole project up to State Barrier Free and Energy Code standards, sidewalk installation, undergrounding of utility lines, parking requirements, and extensive structural as well as architectural changes to the buildings themselves. To get all the issues and concerns on the table, a meeting attended by the following named persons was held on September 12, 1994: Duane Griffin, Building Official Ken Nelsen, Plan Checker Dave Larson, Building Inspector Rhonda Berry, Assistant to City Administrator Evelyn Boykan, Human Services Coordinator John Pierog, Public Works Jack Pace, Senior Planner Libby Hudson, Planning James Impett, King Co. Loan Officer, Housing Rehab Programs James Gipson, Property Owner Slawek Porowski, Project Architect Tony Aversano, General Contractor (Fire Marshal was invited but reviewed plans prior to meeting and didn't think the FireDept had any major concerns.) In the meeting we discussed the following things: It was decided, and agreed to, that a new set of revised plans should be submitted and go through the plan check process again, including the payment of additional plan check and permit fees, before any work on the project can continue. Mr. Impett agreed that the valuation to be used to calculate the fees should be approximately $356,500 and that figure will be used, minus the amounts they have already paid, to calculate the new fees. It was also agreed that they would submit the additional plan check fee along with the revisions when they submit them. Some Planning and Public Works requirements are triggered by the valuation of the work exceeding a certain percentage of the assessed valuation of the building(s). State Barrier Free requirements are triggered by the work exceeding 60% of the appraised valuation of the building before work starts. It was pointed out that none of the Departments could establish their requirements until these figures are known. During the meeting Mr. Impett stated that valuation of the improvements would be at least 110% of the appraised valuation of the buildings. It was agreed that the architect would take the barrier free requirements into consideration when submitting the revisions. John Pierog discussed the Public Works requirements about surface water runoff, undergrounding of utility lines, sidewalk requirements, and possible utility easements. It was agreed that the permit applicants would get some additional information and set up a separate meeting with Public Works to work out the details. Jack Pace discussed planning requirements and concerns. These included property line and setback requirements, parking requirements, and sign code. Jack mentioned it might be necessary to have the property surveyed. It was agreed that a separate meeting would 2 etA e se ceims D / le3/7"/o ..__... feY\ CO ;..,Q.1/. •Uri -.gay n h6''fir t- bbt, Hqi7, 4;/ WAILS' 4/7 s • caQe+ .12. 19 9H j C cIo/z. be held between the applicants and Planning to establish what else is needed in order for Planning to complete their portion of the plan check. Dave and Ken provided comments about the structural elements of the building and what they thought would have to be addressed on the new revised plans. They were both specifically concerned about the existing foundation system of the buildings, structural changes being made to load bearing walls, and numerous other structural issues. These issues were discussed in some detail but it was pointed out that nothing said at this meeting should be taken as the final word. Anything said will be subject to change based on changes contained in new revisions when they are submitted. It was agreed upon that mandatory minimum code requirements contained in the building code must be met, and cannot be ignored just because it is difficult to do in these old buildings. However, we all understand that in any remodeling project there are always problem areas that cannot be preplanned for, and it's not practical to have to schedule a specific inspection for every little modification made. With this is mind, I suggested, that because of the complexity of this project, it might be helpful for everyone concerned if the Building Inspector made a point of stopping by the project every workday at a predetermined time. This would serve the purpose of the contractor and inspector being able to discuss problem issues and possible solutions on the same day, thereby allowing the work to stay on a reasonable schedule while at the same time allowing the inspector to see things before they are covered. As of today we are awaiting revised plans and supporting documents from the architect so that the plan check process for this project can continue. I was told at the end of last week that the only construction work presently being done at the project was some minor electrical and plumbing work. cc: Rick Beeler, DCD 3 /TUKWILA MUNICIPAL CODE Sections: 18.72.010 18.72.020 18.72.030 18.72.040 18.72.050 18.72.060 18.72.070 18.72.080 Chapter 18.72 VARIANCES Purpose. Criteria for granting variance permit. Conditions for granting — extension. Application requirements. Application — hearing and notice. Application — Board decision. Prohibited variance. Appeal. 18.72.010 Purpose. It is the purpose of this chapter to authorize upon appeal In specific cases such variances from the provi- sions of the zoning ordinance or other land use regula- tory ordinances as the City may adopt which will not be contrary to the public interest and only where, owing to special conditions, a literal enforcement of the provisions of such ordinance(s) would result in unnecessary hardship. (Ord 1247 §1(part), 1982) 18.72.020' Criteria for granting variance permit. The Board of Adjustment shall consider all requests for variance from the Zoning Code; variance 'from the provisions of such ordinances shall not be granted by the Board of Adjustment unless the board finds that all of the following facts and conditions exist: (1) The variance shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the vicinity and .in the zone in which the property on behalf of which the application was filed is located; (2) The variance is necessary because of special circumstances relating to the size, shape, topography, location or surrounding of the subject property in order to provide it with use rights and privileges permitted to other properties in the vicinity and in the zone in which the subject property is located; (3) The granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and in the zone in which the subject property is situated; (4) The authorization of such variance will not adversely affect the implementation of the Comprehensive Land Use Policy Plan; • (5) The granting of such variance is necessary for the preservation and enjoyment of a substantial property right of the applicant possessed by the owners of other properties in the same zone or vicinity. (Ord 1247 §1(part), 1982) 18.72.030 Conditions for granting — extension. In authorizing the variance, the Board of Adjust- ment may attach thereto such conditions that it deems to be necessary or desirable in order to carry out the intent and purposes of this chapter and in the public interest. A variance so authorized shall become void after the expiration of one year or a longer period as specified at the time of.the Board of Adjustment action, if no building permit has been issued in accordance with the plans for which such variance was autho- rized, 'except that the Board of Adjustment may extend the period of variance authorization without a public hearing for a period not to exceed twelve months upon a finding that there has been no basic change in pertinent conditions surrounding the property since the time of the original approval. (Ord 1247 §1(part), 1982) 18.72.040 Application requirements. An application to the Board of Adjustment for the' issuance of a variance shall be made on forms prescribed by the Planning Department. All applications shall be accompanied by a filing fee as required in Chapter 18.88 and shall include but may not be limited to the following documents: (1) Completed application form; (2) Site plan or other related map materials which clearly indicate the dimensional characteristics of the site and structures involved; (3) Affidavit of the ownership or of substantial beneficial interest in the subject property. (Ord 1247 §1(part), 1982) 18.72.050 Application— hearing and notice. When a proper and complete variance application has been filed, and reviewed by the Planning Department, the Board of Adjustment shall set a date for public hearing, pursuant to notice requirements of Chapter 18.92. (Ord 1247 §1(part), 1982) 18.72.060 Application — Board decision. The Board of Adjustment shall decide all applications no later than 45 days after the public hearing. (Ord 1247 §1(part), 1982) 18.72.070 Prohibited variance. Under no circumstances shall the Board of Adjustment grant a variance to permit a use not generally or conditionally permitted in the zone involved, or any use expressly or by implication prohibited by the terms of this title in said zone. RECORD OF TELECON DATE: 8/30/94 FROM: Duane Griffin RE: Beverly Hills Apartment Project, B94 -0241 Mr Slawek Porowski, 548 -1015, architect for this project called me and started the conversation by saying that everything regarding this project has been a shock or unpleasant surprise. I initially thought he was complaining about our service or inspection procedures, but then realized he was talking about the project itself. The following are some of the comments he made: • "So far, only one unit of all of them they have started work on hasn't ended up being an unpleasant shock or surprise to either himself or the contractor." • "The buildings have been standing only because of grace of god and friction." • "3/4 inch lath and plaster has been about the only thing holding it up." • "Bloody incredible." • "Some of the units built to the standards of slave quarters." The gist of the conversation I had with him was that every time they open something up it leads into major repairs. He said the contractor is very competent and trustworthy individual who takes pride in his work. He said Jim Impett, the person from King Co., who has control of the money the county is putting into this project used to work for a bank and was familiar with this contractors work, and consequently was comfortable in issuing the money to the contractor based on past experience. When I asked how they got into this situation in the first place, without detecting the actual condition of the building, he said that: • The project had been in the planning stages for a long time and the contractor got into it as a friend of a friend of a friend type thing. • During the planning stages the units were occupied and the contractor was only given very limited access to the building to make a determination of what actually had to be done. • It appeared that the owner deliberately misled the contractor, or concealed information he must have known about (based on what appears to be recent inadequate construction repair work done on some of the buildings that the owner must have known about). • The building had asbestos siding on it that couldn't be removed until they had proper permits and had the asbestos removed by licensed asbestos removal contractor. Porowski said the reason for some of the problems encountered is because the contractor is conscientious enough that he has a hard time ignoring obvious structural problems as they are uncovered. Since almost everything they have uncovered leads into another structural problem, this has become a continuing repair project of areas that were not shown on the plans submitted as part of the original permit application package. I questioned him about the description of work and valuation of work figure shown on the original application, since it now appears this is considerably different than what the owner and everyone else involved in the project knew about prior to submitting the application. He said he didn't have an answer for that since the owner was the one who assigned the valuation. (1 checked the permit file later and found that the permit application had been filled out and signed by Porowski as the representative of the owner.) I read him a copy of Ken's draft letter that we would be sending him stating that no construction may be done legally beyond what was shown on the original permit application, and that additional plan check fees would be charged and needed before any further plan checking is done on the revised plans they submitted last week. He said he didn't have any problem with that issue. I mentioned that one of our concerns, now that we have more information about the extent of the work, is that it may kick in other code issues such as barrier free and energy code requirements. I told him this would take further research. The County Health Department has notified the contractor that there is inadequate crawl space clearance under the buildings and it will be required that the necessary clearance be obtained before they will sign off on the plumbing permits. Porowski said that excavating the dirt, in order to get the required clearance, could have a damaging effect on the foundation and cannot be done. When I asked if they intended to go ahead with the other work, even though they are aware of the county requirement, he said yes. I got the impression they were anticipating or assuming that the county will change their mind about this requirement. He told me that right now all the exterior asbestos siding has been removed and the only thing there at the present time is ship lap siding in some places, and just siding paper in others. When I asked if the units they were working on are still occupied he said they have taken apart 7 units that are not now occupied, and there are 5 units in the complex that they haven't taken apart that are still occupied. He then amended his statement to say there is a tenant in one of the upstairs units above the units they have taken apart. 2 I told him that at this point the whole project is getting outside the realm of just the building code, and because of the other government agencies involved in both the work and funding of this project I feel we are going to have to have a meeting with everyone involved. He immediately agreed and said the quicker the better as far as he is concerned. I advised him 1 would have to get further direction from the DCD Director and would get back with him. He thanked me for my time, said he completely understood why I might be frustrated with this project, and he would be looking forward to hearing from me. After this telephone conversation with Porowski I talked to Rick and we decided we would have a meeting with John, Rhonda, Rick, myself, a plan checker, & bldg inspector. Rick called Rhonda and set up a meeting for 10 AM, Thursday, 1 Sep 94. 3 City of Tukwila John W. Rants, Mayor August 30, 1994 Department of Community Development Rick Beeler, Director Slawek Porowski Interurban Architects 670 N 34th St., #202 Seattle, WA 98103 RE: Beverly Hills Apartments, revisions received 8/25/94 Plan check number B94 -0241 Dear Mr. Porowski: To reiterate our phone conversation on August 29, 1994, the proposed revisions has not been approved. Because some work has already been done prior to these revisions being submitted and approved, this Department deems it necessary to notify all parties.involved that no construction may be done beyond what was approved on the initial application. Please review the following general comments and conditions. 1. Framing must be limited to the like replacement of existing decayed structural elements. Any reconfiguration of existing spaces, walls, ceilings, floors, or roofs, may be not continued until these plan changes are reviewed, approved, and re- issued to the applicant. 2. The extent of the proposed revisions requires the complete review by all Tukwila Divisions. You may anticipate additional requirements or corrections from the Divisions of Building, Fire, Planning, and Public Works. 3. Initial inquiries regarding the waiving of permit fees by City Administration has not been. substantiated. Until any fees are officially waived, your revision application must disclose the additional value of construction and all plan check fees will be readjusted and paid before any further plan review can continue. Also, please be advised that, in addition to the revised plan check fees, building permit fees will be increased accordingly and must be paid before the revised plans are issued or work covered by the revisions can continue. Our comprehensive plan supports City assistance in remodeling residential units for low income households. In addition, as a Community Development Block Grant Consortium member we support community renewal projects and seek to contribute our fair share of affordable housing. Thus, we would like to see the project successfully completed. Through a coordinated staff assessment involving Building, Planning, Human Services and the Mayor's Office we would like to help support the completion of this project contingent upon agreement to the following points: 1. The applicant shall guarantee that, for a 20 year period, out of the 13 project units, 20% will be affordable to households making 50% or less of the King County median income and 80% will be affordable to households making 60% of the King County median income or less. 2. The project shall be well maintained by the owner, based on standards to be established and monitored by the County. 3. A firm bid to complete the project be established, based on a complete investigation of the structure. It is recognized that this requires additional investigation of areas to be improved, as would be done in any other commercial remodel where firm bids are required. 4. Plans for the remodel shall be submitted and release of City funds shall be subject to issuance of all needed permits; and 5. Limited funds should be made available to defray the cost of plan preparation because of the project's tight budget, if there are extensive data requirements to prepare a complete permit application. Maintaining the dwelling so it does not violate state and local codes in ways which endanger tenant's health and safety; 2. Adopt and enforce a "zero- tolerance" policy around illegal activities such as drug use /distribution, gang activity, etc. (e.g. signs on property and addendums outlining policy to rental agreements); 3. Establish and maintain a Neighborhood Block Watch (within the complex) to promote safety and deter crime; 4. Cooperate with law enforcement and other City staff to reduce illegal activities; 5. Effective screening of tenant applicants (submit protocol); 6. Participation in the Tukwila Apartment Managers Network; 7. Availability of manager to tenants on a daily basis; 8. At least one (1) meeting with the Office of Human Services to learn what resources are available and cooperation in making those resources available to tenants. This part of the agreement would be monitored for up to five years. Assuming adherence to these commitments, we would like to recommend to the City Council that $58,000 of available block grant funds from 1994 be transferred to the County for use in the Beverly Hills project. The purpose of the funds would be to renovate the Beverly Hills Apartments, a 13 unit complex in Tukwila which houses very low income residents. The complex is in need of major rebuilding. The County has already invested $195,000 to benefit the Tukwila community. Additional assistance from Tukwila in the amount of 43 o (the amount available from recaptured funds plug reassigning the 1994 utility connection assistance funds; $17,000 - which will not be used this year) will leverage an additional $50,000 from the County. This would still leave us about $163,000 for 1995. Assistance in this project is consistent with our current and future philosophies /policies regarding maintaining an affordable housing supply for all income levels. Our current housing policies include promoting the rehabilitation of aging or deteriorating residential structures. Additionally, our proposed housing element policies support maintenance and long -tarm preservation of existing housing for low and moderate income residents. An added benefit is that by using our CDBG dollars the units are guaranteed to remain affordable for low income tenants for 20 years. Because the rehab is currently underway and expected to be completed before the end of 1994, our dollars are needed as soon as possible. King County would take care of the administration of the funds without any additional burden to City staff. Since we are working diligently with the apartment community to promote a healthy and crime -free environment, I would suggest that the property owner agree to the following stipulations which could be met prior to the end of 1994. Since there is a need to complete the rehab soon, I am working with the County on ways to ensure that our expectations are met and included in the contract. Guidelines from the Vision Tukwila Neighborhood Fund Playground Project would be useful in this situation in addition to a few more items. This Program is funded with HOME federal funds which come annually to King County and the consortium of cities. The apartment building . is a community eyesore, and has deteriorated badly over the years. The condition of the buildings -- as seen now when the walls, roof, plumbing and wiring are opened up. -- is so poor that more ex- tensive, and more expensive,'repairs are required. Actually, the buildings . virtually need to be rebuilt; Attached is a copy of the contract for the renovation, dated 4- 2 -94,. for $224,536.64. Also attached is a list of additional repairs needed (beyond what was bid in• the contract), and a list of desirable additions to the property. The total work would cost $336,535. That means another $100,000 is needed beyond the present funds committed. King County could put in $50,000 in CDBG funds, and requests the City of Tukwila to put in $50,000 or. its CDBG• funds to complete this project. Rants, Mayor Department of Community Development MEMORANDUM Evelyn Boykan, Human Services Coordinator Rick Beeler, Director Department staff have made the following determinations after a site visit and discussions with the owner, County agent, architect, contractor, various Building Division staff and Ross Heller of Public Works. The bottom line is that this project can be supported based on Comprehensive Plan policies, but that considerable caution is needed because the fiscal needs to complete the construction and maintain the improvements is not yet clearly established. Our judgement is that project costs have been underestimated due to inadequate project investigation of existing conditions and incorporation of Tukwila development standards. The current (low) renovation estimate is about 60% of new construction costs'. It is possible that the final construction costs will be close to new construction costs. The City should be cautious and reserve a final decision until all needed improvements have been identified, project costs clearly established, and ability to maintain the improvements clearly demonstrated. Specific staff findings and a recommendation are presented below. FINDINGS A. The Comprehensive Plan supports City assistance in remodelling residential units for low income households, in at least three Residence policies of the existing Comprehensive Plan: z About $35 /s.f. of improvement cost vs. roughly $45- 60 /s.f. for new construction. Cost comparisons such as this are difficult since newly built units are required to be of a substantially higher quality than the renovated unite. 6300 Southcenter Boulevard, Suite #100 • Tukwila, Washington 98188 • (206) 4313670 • Fax (206) 4313665 Beverly Hill Apartment Renovation August 11, 1994 Page 2 Residence Policy 2.1: "Promote rehabilitation of ageing or deteriorating residential structures." Residence Objective 3: "Encourage participation in appropriate Federal programs to assist families of low and moderate income." and Residence Policy 3.1: "Assisted housing units should be dispersed throughout the residential community within appropriate zoning categories." B. A long -term commitment to well maintained very low income housing is beneficial to the City. C. The construction activities as of 8/8/94, exceed the scope of the project's existing building permit. Any additional construction is not authorized. The additional work which has been verbally described by the applicant, requires submittal of a new building permit application which satisfies all requirements must be submitted. D. The construction activity to date is consistent with the Zoning Code. Staff speculates that the additional work will be able to satisfy Zoning Code standards, but no determination can be made until plans are submitted and reviewed. E. The estimate of $112,000 to complete the construction (Impett, King Co., 8/1/94) is low, based on new information (Impett, 8/11/94). Any further estimate is subject to significant increases based on the following situation: i. the structural, plumbing and electrical conditions in the two southern building areas were unknown and costs were merely estimated, and ii. the as- yet- to -be- determined cost to satisfy all Building Code and engineering development standards, may not have been adequately incorporated into the anticipated funding requirement. Building and engineering standards must be satisfied whether or not funding is approved. The applicant may request a waiver of permit fees, frontal improvements and other provisions as appropriate. Extensive Building Inspector time is anticipated and it is not appropriate to exempt reinspection fees. Beverly Hill Apart3mentRenovation August 11, 1994 Page 3 F. The final structures, after compliance with minimum Building Code requirements, will be renovated; not new. Diligent maintenance will be essential to retaining project quality. RECOMMEENDATION The Planning Division recommends supporting this project subject to the following conditions: 1. The applicant shall guarantee that, for a 20 year period, the 13 project units will be affordable and rented to households making 30% of the King County median income, 2. The project shall be well maintained by the owner, based on standards to be established and monitored by the County, 3. A firm bid to complete the project be established, based on a complete investigation of the structure. It is recognized that this requires additional investigation of areas to be improved, as would be done in any other commercial remodel where firm bids are required, 4. Plans for the remodel shall be submitted and release of City funds shall be subject to issuance of all needed permits; and 5. Limited funds should be made available to defray the cost of plan preparation because of the project's tight budget, if there are extensive data requirements to prepare a complete permit application. Please contact Vernon Umetsu at 431 -3684, if we can be of further help. cc: Bradshaw /Griffen /Heller /File B94 -0241 fi1et94 \bhapt \boykan. 1 MEMORANDUM TO: Vernon Umetsu, Planning FROM: Ken Nelsen, Building Division DATE: August 9, 1994 SUBJECT: Beverly Hills Apartments After our site visit of the subject property on August 8, 1994, I would like to suggest that you continue to consult with the Building Division prior to making further recommendations on this project. Our staff is currently in discussion on this subject. General conclusions are that any proposed alterations beyond the current permitted repairs will required full code compliance under a separate building permit. cf: Duane Griffin BEVERLY HILLS APTS. RENOVATION DRAFT Summary Project History lut. 8/8/94 8/5/94: Assigned project late in PM. Contacted Bob B. and Dave L. for info. This results in concern over project costs (too high ?), and whether building should have been taken down and rebuilt, based on final value of structures and unknown (but likely high) renovation costs. Talked w/ Evie B. and let her know of concerns. She notes that John M supports the request, based on County assurances of project completion on budget and statements of quality improvements. She supports work to make any corrections to the presented "facts ". 8/8/94 Findings to date: The Building Permit 1. A building permit for $30,000 of renovation work was issued on 7/26/94 (B94- 0241). However, the stated value seems to be dwarfed by the $224,536.64 bid sheet (4/2/94) submitted by the applicant to the County for project funding. 2. The permit specifies all work to be done, including a note that the City Inspector shall specify any structural improvements needed. 3. The work is described in notes and seems to accurately show what is being done. Apartments are only shown in finished plan view (no graphic showing of work). The Grant 4. A bid specification sheet was previously submitted to the County (Jim Impett, 296 - 8639). JI is a real estate loan officer with 17 yrs. of County experience and years more of private loan experience. Per Impett: a. The improvement costs included $56- 58,000 of owner money and $195,000 of County money. Total is about $252,000 (= 57,000 + 195,000). Note: This is greater than the 4/2/94 bid contract of $224,536.64, referenced the Impett memo of 8/1/94. The amount of new owner money should be reconciled. b. The conditions of the existing $195,000 grant include the owner holding rents to the very low income category (e.g., affordable to households with 30% of median income) for 5 years and funds being repaid upon sale. c. The County anticipates making their share of the proposed $100,000 subject to holding rents to the very low income for 20 years, and forgiving the loan over a 20 year period. They would like the City to do the same. d. JI has worked with the contractor over many years and projects. He considers the contractor's previous work (mainly in Seattle) as very competent (good, but not luxurious), and the contractor to be very conscientious and honest. e. The bulk of the County money has not yet been spent, although reroofing has been started. No wall have yet been opened. f. The architect is now doing new drawings to reflect the proposed changes. The arch. knows that this will require a new (or revised) building permit for the additional work. Note: I noted to JI that the original permit was specified by the app. as being $30,000; not the $195,000. This issue of original work approval will have to be resolved with the Building Div. I also noted that expansion of use areas such as expanded living areas, would be subject to today's codes. g. JI will fax a copy of the contract and bid sheet, and meet Dave L and I out at the site. 5. I noted that my concerns about project evaluation and monitoring was considerably eased after our discussion, and I looked forward to reviewing his materials and meeting him. cc: Larson 8/8/94 Met at the site with the following persons: Dave Larson (Teak. Bldg. Insp), Ken Nelson (Tuk. Plns Chkr), Jim Impett (King Co. Loan Off), Slawek Porowski (Arch), Jim Gipson (Owner) and Tony (Aversano ?) (Contractor). I have determined the following: 1. The project is legally non - conforming for parking and other development standards. The proposed construction in B94 -0241, would not increase the level of non - conformity. 2. A proposal to convert garages to living spaces would be acceptable if spaces were replaced in a manner which satisfied current design standards. However, other City codes (i.e., Building) would have to be satisfied. 3. This extensive renovation of clearly dillapidated buildings, was undertaken with a "good- case" bid estimate. It assumed finding favorable conditions in the existing buildings and provided no contingency fund. 4. The existing scope of construction TO DATE exceeds the plan approval, but this could be relatively easily resolved (Nelson, 8/8/94). The anticipated work beyond this point requires new plans. The additional work could require extensive City requirements. 5. New plans, which incorporate all City requirements and a thorough knowledge of the construction are not available. 6. The sufficiency of the additional $112,000 is not known. The applicant has incorporated worst -case bathroom costs, and anticipated structural improvement costs in the $112,000 estimate. No significant structural costs were included for the two southern buildings and it is not know whether sufficient structural repair funds were allocated for the northern buildings (because of the potential for extensive work and not having done enough investigation to actually know the extent of repair required). 7. Impett states that this project was begun as a low cost remodel, but rapidly grew to a large cost project. I noted to JI that my cost concerns focussed on getting a firm number that the City could rely on to see the project completed. This could include a "hell or high water" commitment from the County once we OK'd the money, whatever amount was agreed upon. 8/9/94 8/8/94: Reviewed project with Ross Heller of Public Works. RH notes that significant site improvements may be required. He took a copy of the plans for expedited initial review and will look out for the new plans to be submitted. Reviewed project with Rick Beeler who determined that an expedited pre -app meeting on 8/11 was not possible since plans would not be ready in time for the Public Works development review meeting on 8/9. I appraised JI of the need to submit plans by Friday for expedited Public Works review w/ Heller as contact, the probability of Building Code issues, and that Planning issues were probably resolved, subject to parking. Building noted the need to satisfy Code requirements whether or not the City funded the project. Building requests on -going consultation of any Planning recommendations on this project. Umetsu and Griffen agree that a complete set of building plans and any civil engineering plans need to be submitted before work progresses beyond its current point, it is unwise to allow City funds to be spent on work that is not yet approved, and it would be reasonable to commit City funds to help prepare acceptable plans. 8/9/94 Briefed Evie on this and discussed options. Sent draft response to Duane for OK. 8/10/94 Reviewed with John M and EB. Drafted direction and sent to MCB for OK. 8/11/94 JI called to state that extensive structural damage was being discovered that was not previously known, that the County would have to come up with about $100,000 and would Tukwila agree to devoting its $43,000 to renovating existing problems (not enhancements). I noted that the City was interested in funding improvements which had high value to dollar costs and good end product quality; I suspected that the City would be less interested in funding projects which result in poor quality developments. However, I was fairly confident that his estimated $75,000 for a quality project would not be approved. We briefly discussed Ken Nelson's statement at the site: That work at that point (8/8) exceeded the permit, but could be dealt with; and any further work needed a new or revised permit. I noted that a permit fee waiver was recommended, but that reinspection fees would remain in force. We briefly discussed the need for a reinspection fee and the circumstances surrounding a roofing inspection by Larson yesterday. JI noted that he had been spending all his time on this project, that any County funding beyond the $100,000 was not possible, and that project funds needed to be spent this year. JI will be contacting Evie B. for further info and City coordination, since I have completed my analysis and she is now the project lead. 8/16/94 Completed revisions to memo per Beeler instructions and transmitted to Boykan. The purpose of the funds would be to renovate the Beverly Hills Apartments, a 13 unit complex in Tukwila which houses very low income residents. The complex is in need of major rebuilding. The County has already invested $195,000 to benefit the Tukwila community. Additional assistance from Tukwila in the amount of 43 0 (the amount available from recaptured funds plus reassigning the 1994 utility connection assistance funds; $17,000 - which will not be used this year) will leverage an additional- $50,000 from the County. This would still leave us about $163,000 for 1995. Assistance in this project is consistent with our current and future philosophies /policies regarding maintaining an affordable housing supply for all income levels. Our current housing policies include promoting the rehabilitation of aging or deteriorating residential structures. Additionally, our proposed housing element policies support maintenance and long -term preservation of existing housing for low and moderate income residents. Since we are working diligently with the apartment community to promote a healthy and crime -free environment, 1 would suggest that the property owner agree to the following stipulations which could be met prior to the end of 1994. Since there is a need to complete the rehab soon, 1 an working with the County on ways to ensure that our expectations are met and included in the contract. Guidelines from the Vision Tukwila Neighborhood Fund Playground Project would be useful in this situation in addition to a few more items. For example we could: "'PUG- O8 -'94 MON 10:36 ID:KING COUNTY PCDD TEL NO :206 296 0119 #874 P10 08/03/94 09:22 FAX 206 243 8198 TUK PARK & REC tJ 003 /003 Require a written statement by the property owner and manager pledging commitment and compliance to the followings 1. Availability of manager to tenants on a daily basis; 6. Tfiis Program is funded with HOME federal funds which come annually to King County and the consortium of cities. The apartment building is a community eyesore, and has deteriorated badly over the years. The condition of the buildings -- as seen now when the walls, roof, plumbing and wiring are opened up -- is so poor that more ex- tensive, and more expensive, repairs are required. Actually, the buildings • virtually need to be rebuilt. Attached is a copy of the contract for the renovation, dated 4- 2- 94,.for $224,536.64, Also attached is a list of additional repairs needed (beyond what was bid in the contract), and a list of desirable additions to the property. The total work would cost $336,536. That means another $100,000 is needed beyond the present funds committed. King County could put in $50,000 in CDBG funds, and requests the City of Tukwila to put in $50,OUQ of its CDBG• funds to complete this project. The buildings,• when renovated, will be a great improvement for Tukwila. The owner, James Gipson•; has expressed' fervent interest in getting responsible tenants for the complex who will be a credit to the community, and who will he'Ip'keep the property in presentable condition. We appreciate Tukwila's' interest in supporting the regional fair -share funding of needed affordable housing, and in developing public /private partnerships in providing low and moaerate- income housing. Phony s Phenol Faaa 431- LLs- F""* Memo to: Evelyn Boykan, City of Tukwila From: Jim Impett, king County Loan Officer Re: Beverly .Hills Apartments 12437 Pacific Highway South Tukwila, Washington The Beverly Hills Apartments, a 13 -unit building in Tukwila which houses very -low- income tenants, is currently being renovated through King County's Rental Rehabilitation Program. This Program is funded with HOME federal funds which come annually to King County and the consortium of cities. The apartment building is a community eyesore, and has deteriorated badly over the years. The condition of the buildings -- as seen now when the wails, roof, plumbing and wiring are opened up -- is so poor that more ex- tensive, and more expensive, repairs are required. Actually, the buildings . virtually need to be rebuilt. Attached is a copy of the contract for the renovation, dated 4- 2 -94,. for $224,536.64, Also attached is a list of additional repairs needed (beyond what was bid in the contract), and a list of desirable additions to the property. The total work would cost $336,536. That means another $100,000 is needed beyond the present funds committed. King County could put in $50,000 in CDBG funds, and requests the City of Tukwila to put in $50,000 of its CDBG, funds to complete this project.. The buildings, when renovated, will be a great improvement for Tukwila. The owner, James Gipson, has expressed fervent interest in getting responsible tenants for the complex who will be a credit to the community, and who will he1p'keep the property in presentable condition. We appreciate Tukwila's interest in supporting the regional fair - share funding of needed affordable housing, and in developing public /private partnerships in providing low and moderate- income housing. Thanks for your help.
