HomeMy WebLinkAboutOrd 1964 - Sign Code Appeal Fee (Repealed by Ord 2303) v.11LA, Repealed by 2303 P Amended by 2004 E „oaf he 1906 City Washington Ordinance No. 4 alp AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, AMENDING TUKWILA MUNICIPAL CODE, SIGN CODE CHAPTER 19.30, BY ESTABLISHING A SIGN CODE APPEAL FEE; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, implementation of and enforcement of the City's staged compliance sign amortization program will result in extraordinary cost to the City; and WHEREAS, to defray these costs the City deems it appropriate that appellants should bear the expense involved in appealing requirements of the City's Sign Code if they do not prevail; and WHEREAS, the proposed appeal fee is a small percentage of the total cost to the City to process an appeal before the City's Hearing Examiner; and WHEREAS, the City has made provision for reimbursement of the appeal fee should an appellant prevail in their appeal; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. New Section Created and Fee Adoption. Appeals under Staged Compliance Sign Amortization Program, Section 19.30.075, is hereby created to read as follows: 19.30.075 Appeals under TMC Chapter 19.30 Fee. Any aggrieved party seeking to appeal the provisions of this chapter shall bring an appeal before the hearing examiner consistent with the process set forth in TMC Chapter 8.45. An appeal fee of $500.00 shall be paid to appeal the terms, conditions, or penalties of this sign code. If the appellant prevails, this appeal fee will be refunded. Section 2. Severability. If any section, subsection, paragraph, sentence, clause or phrase of this ordinance or its application to any person or situation should be held to be invalid or unconstitutional for any reason by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this ordinance or its application to any other person or situation. Section 3. Effective Date. This ordinance or a summary thereof shall be published in the official newspaper of the City, and shall take effect and be in full force and effect five (5) days after passage and publication as provided by law. On July 2, 2001, the City Council of the City of Tukwila passed Ordinance No. 1964, creating a new Section 19.30.075 and adopting a fee for appeals under Staged Compliance Sign Amortization Program; providing for severability; and establishing an effective date. The full text of this ordinance will be mailed without charge to anyone who submits a written request to the City Clerk of the City of Tukwila for a copy of the text.
