AMENDED BY: REPEALED BY: 1770 §2 1796 §2 1845 City of Tukwila Washington AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, AMENDING TUKWILA MUNICIPAL CODE CHAPTER 16.06 TO ADOPT THE 1994 EDITION OF THE UNIFORM HOUSING CODE, PROVIDING FOR SEVERABILITY, AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City Council has determined to update its current regulations regarding premises, dwellings, rooming houses, lodging houses, or parts thereof, which by reason of their structure, equipment, maintenance, use or occupancy affect or are likely to affect adversely the public health, safety and general welfare, by adopting the 1994 Edition of The Uniform Housing Code; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, ORDAINS AS FOLLOWS: Section 1. Uniform Housing Code Adopted. Section 16.06.020 is hereby amended to read as follows: 16.06.020 Uniform Housing Code Adopted. The following code is adopted and incorporated by reference as if fully set forth: (1) The Uniform Housing Code, 1994 Edition and Standards thereto as adopted by the International Conference of Building Officials, with the following modifications: (a) Pages number iv through vi, "Codes and Related Publications ", of the Uniform Housing Code, 1994 Edition adopted by the City, are hereby deleted. (b) All references to "the building official" in the Uniform Housing Code, 1994 Edition adopted by the City, are hereby revised to read "the code enforcement officer". (c) Section 203.1 "General ", of the Uniform Housing Code, 1994 Edition adopted by the City, is hereby revised to read: 203.1 General. In order to hear and decide appeals of orders, decisions, or determinations made by the code enforcement officer relative to the application and interpretations of this code, there shall be a Hearing Officer induding but not limited to a City employee(s) or any other person or entity hired for the purpose of presiding over appeals filed pursuant to this chapter. The Hearing Officer shall render all decisions and findings in writing to the appellant with a duplicate copy to the code enforcement official. Appeals to the Hearing Officer shall be processed in accordance with the provisions contained in Chapter 8.45 of the Tukwila Municipal Code. (d) Section 701.1 of the Uniform Housing Code, 1994 Edition adopted by the City, is hereby revised to read: Section 701.1 Heating. Every dwelling and guest room shall be provided with heating facilities capable of maintaining a room temperature of at least 65°F when the outside temperature is 24°F or higher, measured at a point three feet above the floor in all habitable rooms, baths and toilet rooms. When the outside temperature is less the 24°F, the heating facility must maintain an average temperature of at least 58°F measured at the same floor level in the same rooms. (e) Section 1305.1 of the Uniform Housing Code, 1994 Edition adopted by the City, is hereby deleted. (f) Sections 1305(e), (.3) (.4), (.5), and (.6) of the Uniform Housing Code, 1994 Edition adopted by the City, are hereby deleted. Section 2. Board of Adjustment Duties Designated. Section 2.76.070(1) of the Tukwila Municipal Code is hereby amended to read as follows: 2.76.070 Powers and Duties Designated. The Board of Adjustment shall have the following powers and duties: (1) To hear and decide appeals from orders, recommendations, permits, decisions or determinations made by a City official in the administration or enforcement of the provisions of the zoning ordinance (Title 18 of the code) or other land use regulatory ordinances as the City may adopt. Section 3. Severability. If any section, sentence, dause or phrase of this ordinance should be held to be invalid or unconstitutional by court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of another section, sentence, clause or phrase of this ordinance. Section 4. Effective Date. This ordinance or a summary thereof shall be published in the official newspaper of the City, and shall take effect and be in full force five (5) days after passage and publication as provided by law. On 6 /a the City Council of the City of Tukwila passed Ordinance No. /7 3 updating Tukwila's current regulations regarding premises, dwellings, rooming houses, lodging houses, or parts thereof, which by reason of their structure, equipment, maintenance, use or occupancy affect or are likely to affect adversely the public health, safety and general welfare, by adopting the 1994 Edition of The Uniform Housing Code; providing for severability and establishing an effective date.
