AMENDED BY: REPEALED BY: 1758 is Q °i 0 I 0 rsos C ity Washington Ordinance No. '7 f="2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON ADOPTING HEIGHT, SETBACK AND AREA REGULATIONS IN TMC 18.50.020, PROVIDING FOR SEVERABILITY, AND DECLARING AN EMERGENCY. WHEREAS, the City Council adopted Ordinance No. 1655, a portion of which amended pre- existing TMC 18.50.020; and WHEREAS, Ordinance No. 1655 unintentionally modified TMC 18.50.020 to eliminate all height restrictions in all zones other than R -2, R -3, R -4, and RMH zones; and WHEREAS, the City Council finds that the immediate amendment of TMC 18.50.020 is necessary to implement the intent of Ordinance No. 1655 and will be beneficial to the protection of the public health, safety and welfare; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, HEREBY ORDAINS AS FOLLOWS: Section 1. Tukwila Zoning Code Amended. The Tukwila Zoning Code, Chapter 18.50.020, is hereby amended to read as follows: 18.50.020 Height, setback and area regulations. The maximum basic height, and minimum setback and area regulations for all principal and accessory buildings in the various zoning districts are set forth in Table 1 (Figure 18.5) (Attachment A). Outdoor storage of materials shall not exceed twenty feet in height. Section 2. Severability. If any section, sentence, clause or phrase of this Ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this Ordinance. Section 3. Effective Date. This ordinance shall be effective immediately upon its adoption pursuant to RCW 35A.12.130. On 8 F 9" the City Council of the City of Tukwila passed Ordinance No. 7 1a, implementing the intent of Ordinance No. 1655, which unintentionally modified TMC 18.50.020 to eliminate all height restrictions in all zones other than R -2, R -3, R -4, and RMH zones; providing for severability and declaring an emergency.
