HomeMy WebLinkAboutOrd 1710 - Criminal Penalties A f0 2 r J G) of i i 1908 C Washington Ordinance No. ZZ D AN ORDINANCE OF THE CITY OF TUKWILA, WASHINGTON AMENDING SECTION 15 OF ORDINANCE 1677 AS CODIFIED AT TUKWILA MUNICIPAL CODE CHAPTER 8.01.050, REGARDING CRIMINAL PENALTIES, TO REFLECT A CHANGE IN CONTROLLING STATE LAW, AND DECLARING AN EMERGENCY. WHEREAS, the general penalty for criminal violations of the Tukwila Municipal Code is set forth in Chapter 8.01.050; and WHEREAS, such general penalty is a maximum of one year in jail and a fine of $5,000; and WHEREAS, by enactment of RCW 35.21 163, effective July 1, 1994, the legislature has restricted cities, ability to impose different penalties than are provided under state law for acts that constitute crimes under state law, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, HEREBY ORDAINS AS FOLLOWS: Section 1. Penalty. Tukwila Municipal Code Chapter 8.01050 is hereby amended to read as follows: 8.01.050 Penalty. Except as otherwise provided in RCW 35.21 163 as now in effect or as may be subsequently amended, any person violating any provision of this title shall be guilty of a gross misdemeanor and shall be punished by a fine not to exceed $5,000, or by imprisonment in jail for a term not exceeding one year, or by both such fine and imprisonment. Section 2. Severability. If any provision of this ordinance or its application to any person or circumstance is held invalid, the remainder of the ordinance, or the application of the provision to other persons or circumstances is not affected. Section 3. Effective Date. This ordinance, as a public emergency ordinance necessary for the protection of public health, public safety, public property or the public peace, shall be effective immediately upon its adoption. X 7- q y szv eL ORDINANCE NO 171a AN ORDINANCE OF THE CITY OF TUKWILA, WASHINGTON, AMENDING SECTION 15 OF ORDINANCE 1677 AS CODIFIED AT TUKWILA MUNICIPAL CODE CHAPTER 8.01 050, REGARDING CRIMINAL PENALTIES, TO REFLECT A CHANGE IN CONTROLLING STATE LAW, AND DECLARING AN EMERGENCY On 6 2 2 7 the City Council of the City of Tukwila passed Ordinance No. 7/ amending Section 15 of Ordinance 1677 as codified at TMC 8.01 050, establishing penalties for gross misdemeanors consisting of a fine not to exceed $5,000, or by imprisonment in jail for a term not exceeding one year, or by both such fine and imprisonment; providing for severability and establishing an effective date. The full text of this ordinance will be mailed without charge to anyone who submits a written request to the City Clerk of the City of Tukwila for copy of the text.
