AND ZONING IN MX LOCATIONS AND ESTABLISHING Ak MORATORIUM ON
ACCEPTANCE OF APPLICATIONS FOR, AND ISSUANCE OF, BUILDING
PERMITS, CONIPEETIENSIVE PLAN AM MOMENTS A ND REZ,ONES.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, REPEALING ORDINANCE NO. 1685 RELATING TO LAND USE
AND ZONING IN SIX LOCATIONS AND ESTABLISHING A MORATORIUM ON
ACCEPTANCE OF APPLICATIONS FOR, AND ISSUANCE OF, BUILDING
PERMITS, COMPREHENSIVE PLAN AMENDMENTS AND REZONES.
WHEREAS, the City adopted Ordinance No. 1685 establishing a moratorium on development on property
that would potentially conflict with the new Comprehensive Plan being drafted by the City's designated citizen
committee, Tukwila Tomorrow, pursuant to the State Growth Management Act; and
WHEREAS, the City Council on February 7, 1994, held a public hearing on Ordinance No. 1685 pursuant
to Chapter 207 of Laws of 1992 and heard from affected property owners, all of whom disagreed with the
moratorium and opposed its long term impacts on their development plans; and
WHEREAS, pursuant to the Growth Management Act, the City's amended Comprehensive Plan and
Zoning Map will not be adopted until 1995, a moratorium may create undue hardship upon the property subject
to the moratorium; and
WHEREAS, the City Council does not intend to unreasonably burden such property and does not find that
the protection of the public health, safety and welfare requires establishment of the said moratorium;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON,
HEREBY ORDAINS AS FOLLOWS:
Section 1. Repealer. Based upon public testimony and other evidence presented to it, the Tukwila City
Council hereby repeals Ordinance No. 1685 in its entirety
Section 2. Severability. If any section, sentence, clause or phrase of this ordinance should be held to be
invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not
affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance.
Section 3. Effective Date. This ordinance or a summary thereof shall be published in the official
newspaper of the City, and shall take effect and be in full force five (5) days after passage and publication as
provided by law.

AN ORDINANCE OF THE CITY OF TUKWILA,
WASHINGTON, REPEALING ORDINANCE NO. 1685
RELATING TO LAND USE AND ZONING IN SIX LOCATIONS
AND ESTABLISHING A MORATORIUM ON ACCEPTANCE OF
APPLICATIONS FOR, AND ISSUANCE OF, BUILDING
PERMITS, COMPREHENSIVE PLAN AMENDMENTS AND
REZONES.
On 7 2 at 9' the City Council of the City of Tukwila passed Ordinance
No. /49 1 repealing Ordinance No. 1685, which established a moratorium on
development of property that would potentially conflict with the City's amended
Comprehensive Plan and zoning map; based upon public testimony and other evidence
presented, determined that a moratorium may create undue hardship upon the property
subject to the moratorium; providing for severability and establishing an effective date.
The full text of this ordinance will be mailed without charge to anyone who submits a
written request to the City Clerk of the City of Tukwila for a copy of the text.
