AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
TUKWILA, WASHINGTON, WAIVING THE REQUIREMENT FOR
PROPERTIES TO CONNECT TO SEWER IF AVAILABLE WITHIN
250 FEET WHERE METRO WILL BE CONSTRUCTING A SEWER
LINE ON 44TH AVE. S., S. 122ND ST., AND 43RD AVE. S.
WHEREAS, Metro is constructing a sewer main through Tukwila, and particularly along 44th Ave.
S. and 43rd Ave. S. in Allentown; and
WHEREAS, TMC 14.12.030 requires connection to a sewer if it is available within 250 feet of the
building; and
WHEREAS, the requirement has origins where sewers were petitioned by the residents or required as
a safety and health issue; and
WHEREAS, the Allentown Metro mitigation is a one time special case not founded on a petition or
health reasons; and
WHEREAS, a City -wide sewer plan for the seven residential areas without sewers is being reviewed
by the Utility Committee and will be coming forward to City Council with policies for review and adoption;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, HEREBY ORDAINS AS FOLLOWS:
Section 1. That the requirement to connect to sewer is waived for the sewer line to be constructed by
Metro as mitigation in 44th Ave. S., S. 122nd St., and 43rd Ave. S. in Allentown.
Section 2. Severability. If any section, sentence, clause or phrase of this ordinance should be held to
be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality
shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this
ordinance.
Section 3. Effective Date. This ordinance or a summary thereof shall be published in the official
newspaper of the City, and shall take effect and be in full force five (5) days after passage and publication
as provided by law.

On 0 a-2 the City Council of the City of Tukwila passed Ordinance
No. /6. 96, waiving the requirements of TMC 14.12.030 until a comprehensive sewer
plan has been developed by the City; providing for severability and establishing an effective
date.
The full text of this ordinance will be mailed without charge to anyone who submits a
written request to the City Clerk of the City of Tukwila for a copy of the text.
