HomeMy WebLinkAboutOrd 1691 - Community-Oriented Policing Citizens Advisory Board (Repealed by Ord 1729) 0 9 0 8 City ofT u lkwfla et J I 6; j 7� Washington 7 &inance No. 16' F AN ORDINANCE OF THE TUKWILA CITY COUNCIL, WASHINGTON, CREATING A COMMUNITY POLICE ADVISORY BOARD, PROVIDING FOR THE MEMBERSHIP THEREOF, AND ESTABLISHING THE DUTIES OF THE BOARD. WHEREAS, community policing is a philosophy which recognizes the interdependence and shared responsibility of law enforcement and the community in making a safer and more livable community. This partnership jointly identifies community safety issues, determines resources, and applies innovative strategies designed to create and sustain healthy, vital neighborhoods, and WHEREAS, the benefits of such a relationship are immeasurable for not only the police department, but our residents, business community, and City officials, and WHEREAS, the philosophy of Community-Oriented Policing is a means of enhancing the police service, police-community relations, communications, and community confidence, and WHEREAS, the Washington State Criminal Justice Community has adopted Community Oriented Policing, formally establishing a training and orientation program within the State Training Commission, a standing committee within the State Chiefs and Sheriffs Association, and a program driven academic liaison with Washington State University, and WHEREAS, the Mayor, Council and the Chief of Police propose that a Community Police Advisory Board be created, and WHEREAS, the City Council believing the creation of such a Board to be a desirable step in insuring quality citizen input and information exchange concerning police services within the City of Tukwila; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, HEREBY ORDAINS AS FOLLOWS: Section 1. Communitv Police Advisory Board. A new Chapter 2.96 entitled "Community Police Advisory Board" is hereby added to the Tukwila Municipal Code to read as follows: 2.96.010 Board Established. There is hereby established for the City of Tukwila a citizens advisory board to be known as the "Community Police Advisory Board. 2.96.020 Con of Board. The Board shall consist of nine (9) members who shall meet the following qualifications: A. Not less than five (5) of the members shall be City residents, representing residential property owners and renters; B. At least two (2) members shall be owners or managers of businesses located within the City; C. One (1) member shall represent school district(s) within the City; and D. One (1) member shall be a High School student and resident of the City. 2.96.030 ADDointment Terms. A. All Board members shall be appointed by the Mayor, with the exception of the resident high school student who shall be nominated by her/his High School student government organization. All board appointments shall be subject to confirmation by the City Council. B. Initial appointments to the Board shall be made for the following terms. 1. Two members of the Board shall be appointed for one -year terms; 2. Two members of the Board shall be appointed for two -year terms; 3. Two members of the Board shall be appointed for three -year terms; and 4. Three members of the Board shall be appointed for four -year terms. C. All subsequent appointments, except for vacancies, and the student representative shall be for four -year terms, provided that members shall remain in office until their successors are appointed and confirmed. The high school student representative shall be appointed to a term of one year. D. Vacancies occurring other than through the expiration of terms shall be filled for the remainder of the term of the member being replaced. Vacancies shall be filled in the same manner as original appointments. E. Members may be removed at will at any time prior to the end of their term by the Mayor. In addition, members who fail to attend three (3) consecutive meetings, regular or special, may be considered to have vacated their positions and may be replaced, as provided for herein. Any member who ceases to have the qualifications provided in Section 2.96.020 (Composition of Board) shall be deemed to have forfeited his or her office. 2.96.040 Commensation. No member of the Board shall receive compensation for services performed. 2.96.050 Duties of the Board. A. The duties of the Board shall include, but not be limited to, the following: 1. To advise and make recommendations via the Chief of Police on issues concerning public safety and police services within the City such as: a. To enhance police- community relations; b. To review and provide a community perspective and recommendations concerning procedures, programs, and the effectiveness of the police service; c. To promote public awareness of the City's police services and programs, including, but not limited to Business and Residential Crime Prevention programs, Safety training, Domestic Violence intervention, and D.A.R.E.; d. To hold public meetings from time to time to solicit public input regarding police services and programs; e. To serve as a liaison between the police department and the community; f. To encourage individuals and community groups to assist the police department in the implementation of police programs and services; and To review and make recommendations concerning such other and further matters as may be referred to the Board, from time to time, by the Mayor, the City Council, or the Chief of Police. B. The Board shall make a quarterly report to the Mayor and City Council regarding its activities. g. C. Notwithstanding, the duties of the Board as described within subsection A of this section, the Board shall have no power or authority to investigate, review, or otherwise participate in matters involving specific police personnel or specific police related incidents. The Board in no way shall receive or stand in review of complaints initiated against personnel of the police department, nor play any role in civil or criminal litigation. 2.96.060 Meetings and Procedure. A. The Board shall have at least one (1) regular meeting per quarter on such day of the month and at such time as may be determined by the Board. Special meetings may be held as often as the Board deems necessary. All meetings of the Board shall be open to the public, except as otherwise provided in the State Open Public Meetings Act. All requirements of the Open Public Meetings Act shall be followed by the Board. B. For purposes of conducting the Board's business, exercising its powers and for all other purposes, a quorum of the Board shall consist of five (5) or more members. Any action taken by a majority of those present, when those present constitute a quorum at any regular or special meeting of the Board, shall be deemed and taken as the action and decision of the Board. C. The Board shall elect such officers as it deems necessary in order to conduct its business. The Board shall adopt such rules of procedure as it deems necessary. D. The Board shall tape record or keep minutes of all meetings held and all business transacted. All records of the Board shall be open for public inspection, except those that may be exempt from public disclosure under state law. a. Minutes shall be distributed, at a minimum, to the City Council, Office of the Mayor, and the Chief of Police. Section 2. Severabilitv. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. Section 3. Effective Date. This ordinance shall take effect and be in full force five (5) days after publication of the attached summary which is hereby approved. Certify t!:. t is t •:orrect copy of Olt r= (131 C+./ City Clerk INTERLOCAL GOVERNMENTAL AGREEMENT BETWEEN THE QTY OF TUKWILA AND THE KING COUNTY RURAL LIBRARY DISTRICT THIS AGREEMENT is dated the 19th day of December 1991, and is entered into by and between King County Rural Library District, hereinafter referred to as the "District and the City of Tukwila, hereinafter called the "City": WHEREAS, the City owns the building housing the Tukwila Library, at 14475 59th Avenue South, and WHEREAS, the District owns the building housing the Foster Library, at 4205 South 142nd, and WHEREAS, the City currently pays an annual contract fee to the District for provision of library services within the City, and WHEREAS, the City by Ordinance No. 1619 will initiate the process for annexation of the City into the District pursuant to Section 27.12.360, RCW, and WHEREAS, the District will not realize any direct tax revenue for operation of the libraries and provision of library services until the 1993 calendar year, and WHEREAS, the City and the District desire to make provisions for continued funding of library operations during the calendar year 1992, now, therefore, the parties agree as follows: 1. The District will continue to assume maintenance and utility costs for the Tukwila and Foster Libraries in 1992. 2. The District will hold the City's 1992 contract at the 1991 fee level of $564,021. 3. The District recognizes the importance of neighborhood libraries to the City of Tukwila and consequently agrees to maintain library services at both the Foster and Tukwila libraries. 1 4. The District agrees that if the City chooses to annex to the District, the District will be responsible and pay for the construction and all related costs of at least a 5,000 square foot library expandable to 7,500 square feet, induding furnishings and materials and appropriate surface parking exclusively for library patrons, and an anticipated completion date in early 1995 (replaces existing Foster branch). This will be a full service library which will have maximum hours, programs and services commensurate with similar sized libraries. 5. The Tukwila Library at 14475 59th Avenue South will be maintained at a minimum of current service levels. 6. The District will provide or pay up to $400,000 for suitable land (the site) for the structure and parking with the requirements that: a) the site be chosen jointly by the City and the District and will have convenient access with good visibility. b) the design and construction will be consistent with the standards of current District building projects and be in keeping with the desired neighborhood concept. 7. The City shall be the designated SEPA lead agency for all SEPA reviews. 8. Any off -site public improvements such as street, sidewalk, storm drainage and /or utility modifications as may be required as a result of the construction of the library shall be paid for by the District. 9. All on -site work and improvements, such as site preparation, grading, landscaping, shall be paid for by the District. 10. The City by its Mayor shall designate City administration personnel to participate in the District's design review process for the library, and to act as coordinator with the District during the planning, design and construction processes. 11. The District will continue to reimburse the City for the library's portion of maintenance and utility costs for the library's portion of the existing Tukwila Library building at 14475 59th Avenue South. District will pay $1 per year for an annual lease. 2 General Recitals 102 12. If the City chooses to annex to the District, then within 60 days of the date of certification of the results of the annexation election, City and District by a supplemental interlocal governmental agreement shall either supplement or amend this agreement to more specifically set forth the terms and conditicns relative to the Matters set forth in Paragraphs 1 through 11 above. 1. This agreement is to define the rights and obligations of the parties in the event annexation of the City to the District is approved at a special election to be held prior to May 26, 1992. Included in the purposes of this agreement is the provision for continued funding by the City of library services within the City during the period between January 1,1992 and December 31, 1992. If annexation to the District is not approved at said election, this agreement shall be of no further force or effect. 2. Should annexation to the Library District fail to pass, and the City chooses to continue to contract with the Library District for services, it is understood that a) The contract rate for library services for the calendar year commencing January 1, 1993 will be according to the phase -in formula, and b) The contract rate for library services for the calendar year commencing January 1, 1994 and for calendar years thereafter will be 100 percent of the full comparable rate assessed taxpayers in the King County Rural Library District. 3. In the event the City chooses to appoint a Tukwila Library Board of Trustees during any time period when the City is annexed to the District, the District shall regularly solicit input from the Board on issues relating to all aspects of library services and facilities for the residents of Tukwila. 3 Dated as of this 19th day of December, 1991. On .a 5 S/ the City Council of the City of Tukwila passed Ordinance No. 6 9/ creating a community- oriented policing citizens' advisory board, establishing appointment terms for board members, describing duties, meetings and procedures; providing for severability and establishing an effective date.
