AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF TUKWILA, WASHINGTON, ESTABLISHING
THE BASIS FOR DENIAL OR REVOCATION OF
BUSINESS LICENSES WITHIN THE CITY OF
TUKWILA, AMENDING SECTION 11 OF ORDINANCE
NO. 537 AND TMC CHAPTER 5.04.110; AND
ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the City of Tukwila encourages its business community to comply
with the provisions, requirements, and standards set forth in the Tukwila Municipal
Code; and
WHEREAS, the City of Tukwila has determined the need to implement additional
business licensing regulations to insure such compliance,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, HEREBY ORDAINS AS FOLLOWS:
Section 1. Denial Revocation. Section 11 of Ordinance 537 and TMC 5.04.110 is
hereby amended to read as follows:
a) The City Clerk may deny or suspend any license under this Chapter for a period
of time not to exceed one year, where one or more of the following conditions exist:
1) The license was procured by fraud or by a false or misleading representation
of fact in the application or in any report or record required to be filed with the City
Clerk;
2) The building, structure, equipment, operation or location of the business for
which the license was issued does not comply with the requirements or standards of
the Tukwila Municipal Code;
3) The license holder, his or her employee, agent, partner, director, officer or
manager has violated or permitted violation of any of the provisions of the Tukwila
Municipal Code.
b) Upon determination that grounds for denial or suspension of a license exist, the
City Clerk shall send the license holder a notice of denial or suspension. The notice
shall set forth the grounds for denial or suspension. Upon issuance of such notice, the
license is no longer valid and current.
Section 2. Severability. If any section, sentence, clause or phrase of this ordinance
should be held to be invalid or unconstitutional by a court of competent jurisdiction,
such invalidity or unconstitutionality shall not affect the validity or constitutionality of
any other section, sentence, clause or phrase of this ordinance.
Section 3. Effective Date. This ordinance or a summary thereof shall be published in
the official newspaper of the City, and shall take effect and be in full force five (5) days
after passage and publication as provided by law.

On the City Council of the City of Tukwila passed Ordinance
No. /gyp 7 establishing the basis for denial or revocation of business licenses within
the City, providing for severability, and establishing an effective date.
The full text of this ordinance will be mailed without charge to anyone who submits a
written request to the City Clerk of the City of Tukwila for a copy of the text.
