AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
TUKWILA, WASHINGTON, AMENDING ORDINANCE 1400 AND
TUKWILA MUNICIPAL CODE CHAPTER 3.22, BY PLACING REAL
ESTATE TRANSFER TAX PROCEEDS INTO THE LAND
ACQUISITION, RECREATION AND PARK FUND (301) FOR USE OF
ANY PROJECTS WITHIN SUCH FUND; PROVIDING FOR
SEVERABILITY, AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the City desires to fund necessary Capital Improvement Projects; and
WHEREAS, the City desires to fund all projects in the Land Acquisition, Recreation, and Park
Fund (301);
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, HEREBY ORDAINS AS FOLLOWS:
Section 1. Ordinance 1400, adopted on September 2, 1986, Section 4(2), as codified at TMC
3.22.040(b) is hereby amended to read as follows:
3.22.040 Distribution of Tax Proceeds and Limitin¢ the Use Thereof.
(b) The remaining proceeds from City taxes imposed herein shall be distributed to the City on
a monthly basis, and shall be placed by the Finance Director in the Land Acquisition, Recreation
and Park Development Fund (301) for use in conjunction with any project within this Fund.
Section 2. Severability. If any section, sentence, clause or phrase of this ordinance should be
held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity or constitutionality of any other section, sentence,
clause or phrase of this ordinance.
Section 3. Effective Date. This ordinance shall be in full force and effect on January 1, 1994,
which is more than five (5) days after passage and publication as required by law. This ordinance
shall be subject to referendum procedure set forth in RCW 82.46.021. Pursuant to that section, the
City Clerk is hereby designated as the filing officer for the referendum petition.

On /�O7,cP/yy1A.L1 /993 the City Council of the City of Tukwila passed
Ordinance No. /r 7' placing real estate transfer tax proceeds into the 301 Fund
for use of any projects within such fund; providing for severability, and establishing an
effective date.

submits a written request to the City Clerk of the City of Tukwila for a copy of the text.
