HomeMy WebLinkAboutOrd 1670 - Oxbow Annexation v s �11LA L i� w Si\ Ii/ 0 2 r i ...1 J O 4, 1 i' At 1 j 2,, City of Tukwila Washington Ordinance No. /6 70 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, ANNEXING AN AREA KNOWN AS THE OXBOW, WAIVING THE ASSUMPTION OF EXISTING TUKWILA BONDED INDEBTEDNESS AND ADOPTING PRE ANNEXATION COMPREHENSIVE PLAN AND ZONING DESIGNATIONS. WHEREAS, a "Notice of Intent to Annex" was submitted to the Tukwila City Clerk by the Desimone Trust pursuant to RCW 35A.14.120, as presented in City Council Resolution 1255, and WHEREAS, after a meeting between the Desimone Trust and the City Council, City staff, property owners, and business owners, an annexation area was established based on logical service area boundaries and staff was directed to proceed with further annexation research in Resolution 1255 on May 3, 1993, and WHEREAS, an environmental Determination of Non significance was issued on May 26, 1993 on the annexation, and draft comprehensive plan and zoning designations to be established simultaneous upon annexation (Tukwila File No. L93- 0035), and WHEREAS, a Notice of Intent to Annex was filed with the King County Boundary Review Board (BRB) who approved the annexation on July 12, 1993, (BRB File No. 1809), and WHEREAS, pre- annexation comprehensive plan and zoning designations were reviewed pursuant RCW 35A.14.120, 330, and 340, in a Planning Commission public hearing on May 27, 1993, and City Council public hearings on June 7, 1993 and July 12, 1993, and WHEREAS, the City Council approved circulation of a property owner direct annexation which established the boundaries of the annexation, waived assumption of bonded indebtedness, and established the comprehensive plan and zoning designations to be effective upon annexation, on July 12, 1993, and WHEREAS, the Department of Community Development certifies that the received petitions requesting annexation exceed the required 60% of area value needed to approve the proposed annexation (Exhibit A), and B); WHEREAS, the City Clerk certifies that the received petitions are valid (Exhibit NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, HEREBY ORDAINS AS FOLLOWS: Section 1. Annexation. The real property known as the Oxbow and specifically described in Exhibit C attached hereto, and incorporated herein by this reference as if set forth in full, sh9uld be and hereby is annexed to and made a part of the City of Tukwila as of full, �c� e 1993. Section 2. Assumption of Indebtedness. Property within this annexation area shall not be required to assume through assessment or taxes, any indebtedness, bonded or otherwise, contracted prior to or existing as of the effective date of the annexation. Said property shall be assessed and taxed at the same rate and on the same basis as property within the City to pay for any bonds issued or other debts contracted subsequent to the date of annexation. Section 3. Establishment of Comprehensive Plan and Zoning Designations. Simultaneously upon annexation, property in this area shall be subject to the following land use designations: a. "Heavy Industrial" on the Tukwila Comprehensive Plan Land Use Map, and b. "M -2, Heavy Industry" per TMC 18.42 and a "Building Height Exception Area" per TMC 18.50.030, in the Tukwila Zoning Code. Section 4. Effective Date. This ordinance or a summary thereof shall be published in the official newspaper of the City, and shall take effect and be in full force five (5) days after passage and publication as provided by law. CITY OF TUKWILA SUMMARY OF ORDINANCE NO. /6 70 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, ANNEXING AN AREA KNOWN AS THE OXBOW, WAIVING THE ASSUMPTION OF EXISTING TUKWILA BONDED INDEBTEDNESS AND ADOPTING PRE ANNEXATION COMPREHENSIVE PLAN AND ZONING DESIGNATIONS. On the City Council of the City of Tukwila passed Ordinance No. /6 70 annexing an area known as the Oxbow, waiving the assumption of existing Tukwila bonded indebtedness and adopting pre- annexation comprehensive plan and zoning designations; and establishing an effective date.
