ORDINANCE NO. 459
AN ORDINANCE PROVIDING FOR THE CONDEMNATION
OF CERTAIN PROPERTY RIGHTS WITHIN THE CITY
OF TUKWILA,AND SPECIFYING THE METHOD OF PAY-
ING FOR THEM.
The City Council of the City of Tukwila do ordain
as follows:
SECTION I: Whereas it is necessary for the public
health, safety and welfare to repair and improve 58th Avenue
South, within the City of Tukwila,, by widening the right-of-way,
improving the surface., avoiding the hazards of the present
surface, all in accordance with good street construction and
the Tukwila comprehensive street plan.
SECTION II: The condemnation or damaging of certain
private property, or both, is required to create a roadway of
adequate dimension. Compensation therefore, shall be made from
the street fund of the City of Tukwila.
SECTION III: The condemnation or damaging, or both,
of the following described real property, situated in the
City of Tukwila, King County, Washington, is hereby authorized
for the purposes set forth herein: an easement for public road
over and along the westerly 10 feet of lot 5, block 11, Hill-
man's Garden Tracts, City of Tukwila, King County, Washington.
SECTION IV: The City Attorney is hereby authorized
and directed to commence legal action to secure an adjudication
of public use and determine just compensation for any taking
or damage.
