City of Tukwila Washington Ordinance No. 1l 158 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, ADOPTING DESIGN STANDARDS FOR THE CONSTRUCTION OF MULTI FAMILY HOUSING. WHEREAS, the City of Tukwila has expended substantial time and effort in preparing the attached Multi- Family Design Study; and WHEREAS, the Planning Commission and City Council held public hearings on the study; and WHEREAS, the City Council finds that the implementation of the study is necessary and beneficial to the health and welfare of the City and its residents, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO HEREBY ORDAIN AS FOLLOWS: Section 1. The attached Multi Family Design study is hereby adopted in its entirety and shall become binding as of the effective date of this Ordinance. Section 2. The Department of Community Development is instructed to prepare and present a codified alternative ordinance as soon as reasonably practicable. Delay in presentation of same shall not effect the validity of this Ordinance. Section 3. SEPA Exemption and Declaration of Emergency. Pursuant to Tukwila Municipal Code Chapter 21.04. 100 and Washington Administrative Code 197.11 -880, the City Council finds that an exemption under SEPA is temporarily necessary to prevent an imminent danger to public or private property, or to prevent an imminent threat of serious environmental degradation, if multi- family development is allowed inconsistent with the attached Multi- Family Design Study. Alternatively, the responsible official may undertake a review and issue his determination at any time prior to the adoption of the codified alternative ordinance referenced in Section 2 above. Section 4. Severability. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. Section 5. Effective Date. This ordinance or a summary thereof shall be published in the official newspaper of the City, and shall take effect and be in full force five (5) days after passage and publication as provided by law.
