HomeMy WebLinkAboutOrd 1631 - Radon Measuring Device Fees pa 1908 CITY OF TU OVILA WASHINGTON ORDINANCE NO. 3/ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, AMENDING SECTION 16.04.140 OF THE TUKWILA MUNICIPAL CODE, TO ESTABLISH FEES TO RECOUP THE COST OF THE CITY PROVIDING RADON MEASURING DEVICES TO RESIDENTIAL CONSTRUCTION PROJECTS PERMITTED PRIOR TO BUT NOT FINALIZED BEFORE JULY 1, 1992; TO ESTABLISH A BUILDING PERMIT FEE FOR PROVIDING RADON MEASURING DEVICES FOR PERMITS ISSUED AFTER JULY 1, 1992, AS REQUIRED BY RCW 19.27, AND DECLARING AN EMERGENCY IN THE INTEREST OF THE PUBLIC HEALTH AND SAFETY. WHEREAS, the City of Tukwila is required, pursuant to RCW 19.27, to purchase and provide a radon measuring device for each new single family residence, and each ground floor living unit in multi family structures receiving final inspections after July 1, 1992, and for the period July 1, 1992 thru June 30, 1995; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, HEREBY ORDAINS AS FOLLOWS: Section 1. Application Fee and Measuring Devise Fee. Tukwila Municipal Code Section 16.04.140 is hereby amended to read as follows: a. 16.04.140 Application Fee and Radon Measuring Device Fee. The fee for relocation investigation service shall be twenty -five dollars ($25.00). The fee for demolition inspections shall be thirty dollars ($30.00). In the event a building permit is issued for a relocated building, the fees for building, plumbing, electrical and mechanical permits shall be based upon the total value of the improved building or structure at its relocated site as estimated by the building official. b. Effective July 1, 1992, a twenty dollar ($20.00) fee will be charged for every radon measuring device that the City of Tukwila provides to a new residence. This fee is to cover the City's cost of purchasing, storing, delivering, and additional administrative procedures to support the program. This fee will be added to the cost of all single and multi family residential building permit fees before the permit is issued. Section 2. Current Permit Holders. Effective immediately, the Tukwila Permit Center will notify all residential building permit holders who obtained their permit prior to July 1, 1992, but will obtain their final inspection after July 1, that an additional twenty dollars ($20.00) per required radon measuring device will be charged and must be paid for prior to their calling for any final inspections. Section 3. Severability. Should any section, subsection, sentence, clause or phrase of this ordinance or its application to any person or situation be declared unconstitutional or invalid for any reason, such decision shall not affect the validity of the remaining portions or its application to any other person or situation. Section 4. Effective Date. This ordinance shall take effect and be in force immediately upon its passage as an emergency ordinance regarding permit procedures for radon measuring devices PASSED BY THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, at a Regular Meeting thereof this 0.20 day of am^ ,1992. On '7- „7 D the City Council of the City of Tukwila passed Ordinance No._4 L, amending Section 16.04.140 of the TMC to establish fees to recoup the cost of the City providing radon measuring devises to residential construction projects, providing for severability, and establishing an effective date. The full text of this ordinance will be mailed without charge to anyone who submits a written request to the City Clerk of the City of Tukwila for a copy of the text.
