HomeMy WebLinkAboutOrd 1627 - Water Use Surcharges and Penalties m*0ILA 1906 CITY TUKWILA WASHINGTON ORDINANCE NO./ 6 7 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, AMENDING ORDINANCE 1623 AND CREATING A NEW CHAPTER 14.04.241 OF THE TUKWILA MUNICIPAL CODE WHICH ADDS SURCHARGES ON WATER CONSUMPTION AND PENALTIES FOR VIOLATIONS OF WATER USE RESTRICTIONS DUE TO THE WATER EMERGENCY DECLARED BY RESOLUTION NO. 1208. WHEREAS, the City wishes to respond to the water emergency created by low reservoirs and availability of supply from the City of Seattle, and WHEREAS, the City desires to meet this emergency as a purveyor of the City of Seattle's water system, and WHEREAS, the City's current water rates per Ordinance No. 1623 will be adjusted to pay for additional costs of providing water and to conserve our water supply, and WHEREAS, the City desires to implement a water surcharge for consumption during this emergency. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO HEREBY ORDAIN AS FOLLOWS: Section 1. Water Consumption Surcharges A new Section 14.04.241(a) of Tukwila Municipal Code is hereby created to read as follows: 14.04.241(a). Water Consumption Surcharges. Residential Customers: For each 100 cubic feet of consumption during the emergency period the following schedule will be followed: Up to 400 Cubic Feet: Rate per each 100 CF 1.39 500 -1,000 Cubic Feet: Rate per each 100 CF 1.74 1,100 -1,500 Cubic Feet: Rate per each 100 CF 2.09 1,600 Cubic Feet and above: Rate per each 100 CF 2.78 For qualifying seniors and disabled customers, the rates will be one -half of those above. Multi Family Customers: For each 100 cubic feet of consumption during the emergency period the following schedule will be followed: Up to 400 Cubic Feet: Rate per each 100 CF 1.39 500 Cubic Feet and above: Rate per each 100 CF 1.74 Commercial /Industrial: For each 100 cubic feet of consumption during the emergency period the following schedule will be followed: Up to 400 Cubic Feet: Rate per each 100 CF 1.81 500 Cubic Feet and above: Rate per each 100 CF 2.26 Temporary Meters: For each 100 Cubic Feet the rate will be: 2.26 Section 2. Surcharge Penalties/Water Use Re stric tions. A new Section 14.04.241(b) is hereby created to read as follows: 14.04.241(b). Surcharge Penalties/Water Use Restrictions. For the period of the water shortage emergency the following violations of water use restrictions will result in surcharge penalties: Watering of lawns. Use of hoses without automatic shut -off nozzles. Hosing /watering of sidewalks, patios, or other outdoor surfaces. Any applicable surcharge penalty will be applied as follows: 1. The first citation by the City will be construed as a warning and no cost will be charged. 2. The second citation will result in a $100.00 surcharge which will be applied to the customer's water account. The surcharge will be due and payable in 30 days or a shut -off notice will be issued and the shut -off policy will be activated. 3. A third citation will result in a $200.00 surcharge and each subsequent citing, $500.00. Each of these penalties will be due in 30 days or the shut -off notice policy will be utilized. Section 3. Effective Period. A new Section 14.04.241(c) is hereby created to read as follows: The applicable rates set forth in Ordinance 1623 are hereby superceded and replaced as of the effective date of this ordinance, for the period set forth herein. This emergency water shortage surcharge schedule shall be effective for the following periods: 1. The surcharge fees in Section 1 and TMC 14.04.241(a) will be effective for the water consumption period June 15, 1992 through September 15, 1992, or the date on which the Mayor rescinds the declaration of water emergency, whichever is later. 2. The surcharge penalties in Section 2 and TMC 14.04.241(b) will be applied effective June 1, 1992, and continue through September 15, 1992, or the date on which the Mayor rescinds the declaration of water emergency, whichever is later. Section 4. Effective Date. This Ordinance or a summary thereof, shall be published in the official newspaper of the City, and shall take effect and be in full force five (5) days after passage and publication as provided by law. Section 5. Severability. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such in validity, or unconstitutionality shall not effect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. Section 6. Conflicting Laws. Whenever any conflicts exist between federal, state or local laws, other City ordinances or regulations and this ordinance, the more restrictive provisions shall apply. AN ORDINANCE OF THE CITY OF TUKWILA, WASHINGTON, AMENDING ORDINANCE 1623 AND CREATING A NEW CHAPTER 14.04.241 OF THE TUKWILA MUNICIPAL CODE WHICH ADDS SURCHARGES ON WATER CONSUMPTION AND PENALTIES FOR VIOLATIONS OF WATER USE RESTRICTIONS DUE TO THE WATER EMERGENCY DECLARED BY RESOLUTION NO. 1208. On 6 9'0 the City Council of the City of Tukwila passed Ordinance No. /6 R7 implementing a water surcharge for water consumption in response to the water emergency created by low reservoirs and availability of supply from the City of Seattle, and establishing an effective date. The full text of this ordinance will be mailed without charge to anyone who submits a written request to the City Clerk of the City of Tukwila for a copy of the text.
