ORDINANCE NO. 457 r
AN ORDINANCE vacating a portion of 62nd Avenue South
within the City of Tukwila.
WHEREAS the owners of real estate abutting on a portion
of 62nd Avenue South have petitioned the City of Tukwila for
a vacation of that portion described herein and
WHEREAS a hearing on said petition was held pursuant
to RCW 35.79 and there were no objections to the vacation peti-
tion
THE CITY COUNCIL of the City of Tukwila do ordain as
follows:
SECTION I: Said vacation petition is granted and
that portion of 62nd Avenue South described as follows is
vacated.
"The old portion of 62nd Avenue South which adjoins the
East boundary of the property owned by Mr. F. E. Hammons
and Mr. Thos. O. Wimmer, legally described as: Por of E
100' of tract 12 ly N of highway No. 1 less N 25' less
State Highway and adjoining the West boundary of the
property owned by Mr. C. T. Baker, legally described as:
Por TR 15 ly WLY of In DAF: Beg 43' E of NW Cor th S 130'
to pt 46' E of W In SD TR TH E at R /A'S 21' th S to In
THOF, less State Highway." and which terminates at the
Three Tree Point Road with approximately a 15' high bank."
SECTION II. This street vacation is subject to the
right of the City of Tukwila to retain a utility easement now
existing on said vacated property and the right to exercise and
grant easements in respect to the vacated land for the construc-
tion, repair, and maintenance of public utilities and services.
SECTION III. In the event the utilities now located
on said property are relocated solely and completely at the owners
expense than Section II herein, in it's entirety, shall not be

The granting of this-vacation will be oeneficial to the City
of Tukwilla, because it will give an opportunity for con solidation
to the adjoining properties, wnicn xill make it more feasible for
development and which eventually will oring in more revenue to the
City. It will also relieve tne Ci *T;* of the responsibility of the
nazaradous condition which now exists, where tne old portion of
62 nd South abuts the Three Tree Point Road witn a !ii ,n bank.
