AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, A AEN.DING ORDINANCE 1321, SECTION V; ORDINANCE 924, SECTION 1; ORDINANCE 486, SECTION V AND CHAPTER 13.88180 OF THE TUKWILA MUNICIPAL CODE BY ADDING PARAGRAPHS D} AND E TO SECTION V THAT AUTHORIZES DEFERRAL OF UNDERGROUNDING FOR. INDIVIDUAL. SINGLE FAMILY HOMES AND FOR INSTALLATION OF NEW OR UPGRADED UTILITY LINES. Ordinance 1607 was amended or repealed by the following ordinances. N //G``TON ORDINANCE NO. 1 7 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, AMENDING ORDINANCE 1321, SECTION V; ORDINANCE 924, SECTION 1; ORDINANCE 486, SECTION V; AND CHAPTER 13.08.100 OF THE TUKWILA MUNICIPAL CODE BY ADDING PARAGRAPHS D) AND E) TO SECTION V THAT AUTHORIZES DEFERRAL OF UNDERGROUNDING FOR INDIVIDUAL SINGLE FAMILY HOMES AND FOR INSTALLATION OF NEW OR UPGRADED UTILITY LINES. WHEREAS, undergrounding requirements have been found to create undue hardship and are impractical for new individual single family homes and for installation of new or upgraded individual utility lines where overhead lines exist; and WHEREAS, deferring the undergrounding requirements for those two types of work by agreement to participate in future undergrounding will better serve the City, individual homeowners, and utilities; and WHEREAS, providing the deferral authority to the Public Works Director will accomplish this revision; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO HEREBY ORDAIN AS FOLLOWS: Section 1. TMC Ch.13.08.100 is hereby amended to include a new subsection (d): d) With respect to applications for short plat or individual single family houses, the undergrounding may be deferred until all utilities on the street are placed underground. The Public Works Director is authorized to approve a deferral based on the following: 1) Application for the deferral is submitted with a drawing showing underground utilities and where they would be placed underground; 2) The application identifies undue hardship that would be incurred in placing the utility underground currently. Hardship is identified as a technological difficulty associated with the facility or with the property or the cost; 3) The undergrounding may be deferred if in the Public Works Director's opinion, the hardship is deemed to outweigh the benefit of the underground installation or the undergrounding. The deferral may be granted only after consideration of the variance criteria identified in Section 18.72.020 (1) (6); and 4) The applicant signs an agreement to participate in future undergrounding through a No Protest LID agreement or other appropriate agreement approved by the Public Works Director. Section 2. TMC Ch.13.08.100 is hereby amended to add a new subsection (e): e) With respect to utility applications for new or increased lines where overhead lines exist, the undergrounding requirement may be deferred until all utilities on the new route are placed underground. The Public Works Director is authorized to approve a deferral based on the following: 1) Application for the deferral is submitted with a drawing showing underground utilities and where they would be placed underground; 2) The application identifies undue hardship that would be incurred in placing the utility underground currently. Hardship is identified as a technological difficulty associated with the facility or with the property or the cost; 3) The undergrounding may be deferred if in the Public Works Director's opinion, the hardship is deemed to outweigh the benefit of the underground installation or the undergrounding. The deferral may be granted only after consideration of the variance criteria identified in Section 18.72.020 (1) (6); and 4) The applicant signs an agreement to participate in future undergrounding through an agreement to pay a proportionate share of the underground trenching costs based on the number of utilities going into the trench and would pay their respective costs for any portion of that route if the City undergrounds any portion of that route. This ordinance or a summary thereof shall be published in the official newspaper of the City, and shall take effect and be in full force five (5) days after passage and publication as provided by law. On ke o4 /9g the City Council of the City of Tukwila passed Ordinance No. emending current undergrounding policy and adding provisions for deferral of undergro nding requirements for single family homes and for installation of new or upgraded utility lines, and providing for an effective date.
