HomeMy WebLinkAboutOrd 1606 - Acquisition by Negotiation for South 160th Street Iu 1906 CITY OF TUKWILA WASHINGTON ORDINANCE NO. /4 O4-0> AN ORDINANCE AUTHORIZING THE ACQUISITION BY NEGOTIA- TION OR CONDEMNATION OF PERMANENT ROADWAY RIGHT -OF- WAY ON PROPERTY DESCRIBED BELOW, AS DESCRIBED BELOW, TO BE USED FOR THE PURPOSES OF AND IN CONNECTION WITH THE CONSTRUCTION, MAINTENANCE, REPARATION, AND OPERA- TIONAL USE FOR VEHICLE AND PEDESTRIAN TRAFFIC ALONG SOUTH 160TH STREET BETWEEN 51ST AVENUE SOUTH AND 53RD AVENUE SOUTH AS WELL AS UTILITIES. WHEREAS, the City Council has determined to improve South 160th Street between 51st Avenue South and 53rd Avenue South with curb, gutter, sidewalk, and lighting improvements; and WHEREAS, the improvements have been designed to improve vehicle safety, provide sidewalk for pedestrian safety, and lighting for night pedestrian and vehicle safety; and WHEREAS, design of such improvements within existing right -of -way would result in the roadway having a series of left and right curves having 20 MPH design speeds; and WHEREAS, there are cumulative safety considerations of the up- to -10% grade as the road comes down the side of the hill from 51st Avenue South to 53rd Avenue South, the hillside sloping to the north limiting the roadway to 28 feet wide with a sidewalk on just one side, that it is on the north side of the hill shaded with trees that prevent snow and ice from melting, that the speed limits are 30 MPH on both sides of the 51st Avenue South to 53rd Avenue South link, and the 20 MPH curves cannot be seen by approaching motorists and will be unexpected; and WHEREAS, safety can be substantially increased by acquiring approximately 1,988 square feet of right -of -way allowing a single 30 MPH curve in place of the 20 MPH curves; and WHEREAS, the City has been unsuccessful to date in negotiating the acquisition of the right -of -way necessary to the construction of the project; and WHEREAS, the City Council has committed City funds for said project; and WHEREAS, the City Council has determined that it is necessary to acquire by further negotiation or by eminent domain proceedings the hereinafter described property in order to construct and improve South 160th Street; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO HEREBY ORDAIN AS FOLLOWS: Section 1. That the City of Tukwila acquire by negotiation or eminent domain proceedings in the Superior Court of King County, Washington, the following described property: A permanent right -of -way on that portion, described below, of that property, legally described below, and as shown on Attachment A, for purposes of the construction, maintenance, reparation and traffic operation as a public street: ORDINANCE Page 2 That portion of the northwest quarter of Section 26, Township 23 North, Range 4 East, W.M., in King County, Washington, described as follows: Commencing at the southeast corner of property described in a deed dated February 24, 1953, and recorded under Auditor's File No. 4317609; thence N76 "07'40 "W along the northeasterly right -of -way line of South 160th Street a distance of 109.97 feet; thence N70 "55'05 "W along said right -of -way line a distance of 216.50 feet to the True Point of Beginning; thence continuing N70" 55' 05 "W along said right -of -way line a distance of 88.55 feet; thence N40 "25'10 "W along said right -of -way line a distance of 137.58 feet; thence S47 "21'59 "E, 60.55 feet to a point on a curve through which a radial line of said curve bears S43 "10'11 "W from the radius point; thence southeasterly along said curve to the left having a radius of 620.00 feet through a central angle of 14 "40'09" and an arc distance of 158.74 feet to the True Point of Beginning. The above described parcel of land contains 1,988 square feet, more of less. The Property is located generally on the northern edge of South 160th Street east of 51st Avenue South, and consists of a triangular parcel of approximately 1,988 square feet, all in Tukwila, Washington. A map of the area is attached for reference as Exhibit B. The escrow agent is authorized to correct the legal description above, if necessary. Section 2. That the use to be made of said right -of -way is a public use, to -wit: the construction, maintenance, reparation and traffic operation of South 160th Street between 51st Avenue South and 53rd Avenue South. The cost of acquiring said property shall be paid for with City and Government funds. Section 3. If any section, sentence, clause, or phrase of this ordinance shall be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause, or phrase of this ordinance. Section 4. That this Ordinance is hereby designated as a public emergency ordinance and shall take effect immediately and that the attached summary shall be published and is hereby approved. On a 5i the City Council of the City of Tukwila passed Ordinance No. /e authorizing the acquisition by negotiation or eminent domain proceedings, of permanent roadway right -of -way on property along South 160th Street between 51st Avenue South and 53rd Avenue South for purposes of and in connection with the construction, maintenance, reparation, and operational use for vehicle and pedestrian traffic.
