ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
TUKWILA, WASHINGTON, PROVIDING FOR THE EXERCISE OF THE
POWERS OF INITIATIVE AND REFERENDUM BY THE CITIZENS OF
THE CITY OF TUKWILA.
WHEREAS, the City Council passed Resolution No. 1177 on
March 18, 1991, declaring its intention to provide for the
exercise of the powers of initiative and referendum; and
WHEREAS, Resolution No. 1177 was duly published in the time
and manner provided by law and more than 90 days has expired
from, but excluding, the date of first publication of Resolution
No. 1177, and no referendum petition has been filed as prescribed
by RCW 35A.02.035 as determined by RCW 35A.29.170; and
WHEREAS, the City Council now desires to effectuate the
intent expressed in Resolution No. 1177 by enacting an ordinance
providing for the exercise of the powers of initiative and
referendum;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Powers of Initiative and Referendum Granted. The
citizens of the City of Tukwila, Washington, are hereby granted
the powers of referendum and initiative as provided for in
RCW 35A.11.080 as now or hereafter amended. Pursuant to
RCW 35A.11.100 as now or hereafter amended, these powers of
initiative and referendum shall be exercised in the manner set
forth in RCW 35.17.240 through 35.17.360 as now or hereafter
amended.
Section 2. Effective Date. This ordinance or a summary thereof
shall be published in the official newspaper of the City, and
shall take effect and be in full force five (5) days after the
date of publication.
Section 3. Severabilitv,. If any section, sentence, clause or
phrase of this ordinance should be held to be invalid or
unconstitutional by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity
or constitutionality of any other section, sentence, clause or
phrase of this ordinance.

WASHINGTON, at a regular meeting thereof this day of
