HomeMy WebLinkAboutOrd 1600 - Violations of Court Orders 4 g 1906 C T UKWIL A WASHINGTON ORDINANCE NO. --14 AN ORDINANCE OF THE CITY OF TUKWILA, WASHINGTON, REGARDING VIOLATIONS OF COURT ORDERS, PROVIDING FOR SEVERABILITY, AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City of Tukwila now has in effect certain provisions providing criminal penalties for violations of certain court orders, and WHEREAS, the City of Tukwila now desires to expand such provisions to create a criminal misdemeanor for the violation of all valid court orders, and WHEREAS, the City Council finds that this amendment is in the best interests of the citizens and will help to protect the public health, safety and welfare, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON DO ORDAIN AS FOLLOWS: Section 1. Failure to Abide by Court Order. Section 8.30.040 of the Tukwila Municipal Code is hereby amended to read as follows: 8.30.040 Failure to Abide by Court Order. It shall be unlawful for any person subject to a Restraining Order, No Contact Order, or any other court order or condition of probation or release, to knowingly violate the terms of that order or condition. Each violation shall constitute a misdemeanor. Section 2. Severabilitv. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. Section 3. Effective Date. This ordinance shall take effect and be in full force five (5) days after publication of the attached summary which is hereby approved. On June 13. 1991. the City Council of the City of Tukwila passed Ordinance No. 1600, expanding provisions which constitute creating a criminal misdemeanor for violations of all valid court orders. The full text of this ordinance will be mailed without charge to anyone who submits a written request to the City Clerk of the City of Tukwila for a copy of the text.
