HomeMy WebLinkAboutOrd 1593 - Housing Code (Repealed by Ord 2057) 16 ILA g 1908 CITY OF TUKWILA WASHINGTON ORDINANCE NO. i -7 g A '0 N ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA WASHINGTON CREATING A NEW TUKWILA MUNICIPAL CODE CHAPTER 16.06 AMENDING TUKWILA MUNICIPAL CODE CHAPTER 2.76.070, ESTABLISHING A HOUSING CODE REGULATING RESIDENTIAL BUILDINGS AND STRUCTURES, PROVIDING FOR SEVERABILITY, AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, there exists, and in the future will exist, premises, dwellings, rooming houses, lodging houses, or parts thereof, which by reason of their structure, equipment, maintenance, use, or occupancy affect or are likely to affect adversely the public health, safety and general welfare; and WHEREAS, there exists a need to correct and prevent the existence of such adverse conditions, and to achieve and maintain such levels of residential environmental quality as will protect and promote public health, safety and general welfare; and WHEREAS, it is further found that the establishment and enforcement of minimum housing standards are required; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO HEREBY ORDAIN AS FOLLOWS: Section 1. New Chanter Established. There is hereby created and established a new Chapter 16.06 of the Tukwila Municipal Code, which new chapter shall be entitled and may be referred to as "Housing Code Section 2. Purnose of Chanter Established. A new section 16.06.010 is hereby added to the Tukwila Municipal Code to read as follows: 16.06.010 Pumose of Chanter. This chapter is enacted for the purpose of providing minimum standards to safeguard life or limb, health, property and public welfare by regulating and controlling the use and occupancy, location and maintenance of all residential buildings and structures. The purpose of this code is not to create or otherwise establish or designate any particular class or group of persons who will or should be especially protected or benefitted by the terms of this code. Section 3. Uniform Housing Code Adopted. A new section 16.06.020 is hereby added to the Tukwila Municipal Code to read as follows: 16.06.020 Uniform Housing Code Adopted. The following code is adopted and incorporated by reference as if fully set forth: (1) The Uniform Housing Code, 1988 Edition and Standards thereto as adopted by the International Conference of Building Officials, with the following modifications: (a) Pages numbered iv through vi of the Uniform Housing Code, 1988 Edition adopted by the City, are hereby deleted. (b) All references to "the building official" in the Uniform Housing Code, 1988 Edition adopted by the City, are hereby revised to read "the code enforcement official (c) All references to "the Housing Advisory and Appeals Board" in the Uniform Housing Code, 1988 Edition adopted by the City, are hereby revised to read "the City of Tukwila Board of Adjustment (d) All references to "the Hearing Examiner" in the Uniform Housing Code, 1988 Edition adopted by the City, are hereby revised to read "the City of Tukwila Board of Adjustment (e) Section 503(c), "Width of the Uniform Housing Code, 1988 Edition adopted by the City, is hereby deleted. (f) Section 701(a) of the Uniform Housing Code, 1988 Edition adopted by the City is hereby revised to read: Section 701(a) Heating. Every dwelling and guest room shall be provided with heating facilities capable of maintaining a room temperature of at least 65 °F when the outside temperature is 24 °F or higher, measured at a point three feet above the floor in all habitable rooms, baths and toilet rooms. When the outside temperature is less than 24 °F, the heating facility must maintain an average temperature of at least 58 °F measured at the same floor level in the same rooms. (g) Section 1301(a) of the Uniform Housing Code 1988 Edition adopted by the City, is hereby revised to read: Section 1301(al Board of Adjustment. The Board of Adjustment shall exercise all powers relating to the conduct of hearings. (h) Section 1301(d) of the Uniform Housing Code, 1988 Edition adopted by the City, is hereby revised to read: Section 1301(d) Continuances. The Board may grant continuances for good cause shown, for all cases before it. (i) Sections 1305(b), (c), (d), (e) and (f) of the Uniform Housing Code, 1988 Edition adopted by the City, are hereby deleted. Section 4. Filing of Conies of Uniform Code. A new section 16.06.030 is hereby added to the Tukwila Municipal Code to read as follows: 16.06.030. Housing Code Cony to be Available to Public. The City Clerk of the City shall maintain on file not less than one (1) copy of the code referred to in Section 16.06.020 and the code shall be available to the public. Section 5. Board of Adjustment Duties Designated. Section 2.76.070(1) of the Tukwila Municipal Code is hereby amended to read as follows: 2.76.070 Powers and Duties Designated. The Board of Adjustment shall have the following powers and duties: (1) To hear and decide appeals from orders, recommendations, permits, decisions or determinations made by a City official in the administration or enforcement of the provisions of the zoning ordinance (Title 18 of the code) or other land use regulatory ordinances as the City may adopt, or of the Housing Code codified at Chapter 16.06; Section 6. Severability. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. Section 7. Effective Date. This ordinance or a summary thereof shall be published in the official newspaper of the City, and shall take effect and be in full force five (5) days after passage and publication as provided by law.
