HomeMy WebLinkAboutOrd 1584 - Cascade View Annexation - Development Regulations for Permit ILA CITY TUKWILA WASHINGTON ORDINANCE NO. 1" AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, AMENDING ORDINANCE NO. 1580, ADOPTING KING COUNTY DEVELOPMENT REGULATIONS FOR SPECIFIC PERMIT APPLICATIONS FOR REAL PROPERTY COMMONLY KNOWN AS THE CASCADE VIEW ANNEXATION AREA, AMENDING SECTION 1 TO INCLUDE SIGNAGE AND AMENDING SECTION 3 TO INCLUDE "APPROVE AND INSPECT SIGN PERMITS." WHEREAS, prior to the effective date of annexation, a sign permit application was filed with King County for processing under King County development regulations, and the permit was not completely processed by King County before the date the annexation area became part of the City of Tukwila, and WHEREAS, King County currently has no jurisdiction to continue processing a sign permit, and it is necessary for the protection of the public health and safety for this situation to be rectified immediately. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWII.A, WASHINGTON, DO HEREBY ORDAIN AS FOLLOWS: Section 1. Development Regulations. Section 1 of Ordinance No. 1580 is hereby amended to read as follows: The City of Tukwila adopts King County's development regulations for the permits identified in amended Attachment A to this Ordinance. King County's development regulations include the King County road standards, road adequacy standards, and grading ordinance; King County's general provisions for loading areas and off street parking; King County's general provisions for signage, landscaping and screening; the Uniform Building Code, Uniform Mechanical Code, and Uniform Fire Code as modified by King County; the enforcement provisions of Title 23 of the King County Code; and the development permit fees of Title 27 of the King County Code. Section 2. Review Process. Section 3 of Ordinance No. 1580 is hereby amended to read as follows: King County is authorized to be the agent for the City of Tukwila to review, approve, inspect, finalize and issue certificates of occupancy for the building permits, approve and inspect sign permits, and approvals for short plats described in Attachment A. Section 3. Severabilitv. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. Section 4. Effective Date. This ordinance shall take effect and be in full force five (5) days after publication of the attached summary which is hereby approved. On /015 the City Council of the City of Tukwila passed Ordinance No/1� amending Sectidns 1 and 3 of Ord. #1580 which adopted King County Development Regulations for specific permit applications for the Cascade View Annexation area; providing for Severability; and establishing an effective date.
