HomeMy WebLinkAboutOrd 1582 - Moratorium on Development of Certain Property / Exempt Certain SEPA Processes (Repealed by Ord 1758) ILA 1909 CITY OF TUKWILA of -a'Ud 75 8 WASHINGTON ORDINANCE NO. /5 9 P AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, AMENDING ORDINANCE NO. 1544 AS PREVIOUSLY AMENDED BY ORDINANCES 1550 AND 1566, TO EXTEND THE PERIOD OF THE MORATORIUM ON DEVELOPMENT OF CERTAIN PROPERTY IN THE CITY OF TUKWILA, TO EXEMPT CERTAIN SEPA PROCESSES, AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, by Ordinance No. 1544 passed November 20, 1989, as clarified and amended by Ordinance No. 1550 passed December 18, 1989, and as amended by Ordinance No. 1566 passed May 7, 1990, the City Council imposed a moratorium on development on certain property within the City, and WHEREAS, the purpose of such moratorium was to prevent development on such specified property, unless exempt or unless a waiver was granted by the City Council, until the adoption of an ordinance to protect and regulate development of environmentally sensitive areas within the City, and WHEREAS, the moratorium is schedule to expire by the terms of Ordinance 1544 as amended by Ordinance 1566 on October 8, 1990, and WHEREAS, it is in the public interest and necessary to prevent environmental degradation for the moratorium to be extended to allow for orderly deliberation and passage of a Sensitive Areas Ordinance, and WHEREAS, due to the length and extent of deliberation and public comment, the planning commission has not completed its deliberations, and it is not possible to pass a Sensitive Areas Ordinance by the expiration date of the moratorium, and WHEREAS, the City Council has determined that the environment will not be adversely affected by allowing the SEPA review processes to be commenced on proposed developments, and WHEREAS, the City fully intends to adopt a sensitive areas ordinance by February 15 1991. The possibility remains that this date may not be met. It is preferred, then, to leave the moratorium in effect until the ordinance is passed and placed into effect. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO HEREBY ORDAIN AS FOLLOWS: Section 1. Extension of Moratorium. Pursuant to Section 23 of Ordinance 1544, the moratorium imposed by Ordinance 1544 and clarified and amended by Ordinance 1550 and by Ordinance 1566, is hereby extended until the effective date of the Sensitive Areas Ordinance. Section 23 is therefore amended to read as follows: B. The moratorium established herewith shall be temporary in nature, shall commence on the effective date of this ordinance, and shall run until the effective date of a Sensitive Areas Ordinance. Section 2. Exemption for SEPA Review. SEPA review of proposed developments may be commenced but not finalized during the period the moratorium is in effect. Section 2.D of Ordinance 1544 as previously amended by Section 2 of Ordinance 1550 is hereby further amended to read in full as follows: D. All applications for development specifically including, but not limited to, new permit applications, rezones, or plats (regular or short) on any property in Tukwila, Washington, described in paragraph A above, submitted during this moratorium shall be refused and not processed until this moratorium has terminated, except that application for SEPA review may be accepted and the review process commenced upon the applicant's signing of a written agreement that the process will not be finalized until after the effective date of the Sensitive Areas Ordinance and that the provisions of such Ordinances will be part of the substantive SEPA policy pursuant to which the final SEPA determination will be made. Section 3. Reaffirmation of Moratorium. In all other respects the provisions of Ordinance Nos. 1544, 1550 and 1566 are reaffirmed. Section 4. Effective Date. This ordinance shall be in full force and effect five days after publication of the attached summary, which is hereby approved. On J D D the City Council of the City of Tukwila passed Ordinance No/54.- extending the moratorium on development of certain property; exempting certain SEPA processes; reaffirming the provisions of Ord. Nos. 1544, 1550, and 1566; and establishing an effective date.
