ORDINANCE NO. 1571
AN ORDINANCE OF THE CITY OF TUKWILA,
WASHINGTON, AMENDING TUKWILA MUNICIPAL
CODE SECTIONS 11.60.050 AND 11.60.060 RELATING TO
COMPENSATION TO BE PAID THE CITY FOR RIGHT -OF-
WAY VACATION
WHEREAS, the City Council wishes to clarify certain ambiguities as to the method of
determining required compensation for vacation of City right -of -way,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWHA,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Section 11.60.050 of the Tukwila Municipal Code is amended to read in
full as follows:
11.60.050 Approval ordinance of vacation. If the City Council approves the vacation
of any city right -of -way, it shall, by ordinance, vacate the property pursuant to RCW`
35.79.030; provided, however, that such vacation of land shall not become effective until
person acquiring the land to be vacated has compensated the City in an amount equal to
one -half the fair market value of the property pursuant to RCW 35.79.030 and determined
as provided in Section 11.60.060 below. The City shall retain in the vacation ordinance any
easement rights deemed necessary by the City.
Section 2. Section 11.60.060 of the Tukwila Municipal Code is amended to read in
full as follows:
11.60.060 Appraisal. Appraisals from a member of the American Institute of Real
Estate Appraisers shall be required, or not required, pursuant to the following guidelines:
(1) If the total assessed value of the land requested to be vacated is less than ten
thousand dollars, a professional appraisal shall not be required and the assessed value shall
be used. In determination of this value, the applicant must demonstrate the value of the
adjacent land as shown on the records of the county department of records and elections
and the county assessor's office and compute this value on a per- square -foot basis. This
value per square foot shall be multiplied by the square footage of the total land area in
square feet requested to be vacated.
(2) If the assessed value of the land requested to be vacated is in excess of ten
thousand dollars, as computed above, an appraisal by a member of the American Institute
of Real Estate Appraisers who is acceptable to the city shall be prepared at the applicant's
expense prior to the acceptance and processing of the street vacation application by the city.
Section 3. This ordinance or a summary thereof shall be published in the official
newspaper of the City, and shall take effect and be in full force five (5) days after passage
and publication as provided by law.

11.60.060 RELATING TO COMPENSATION TO BE PAID THE CITY
FOR RIGHT -OF -WAY VACATION
On ?II 1990, the City Council of the City of Tukwila passed
Ordinance No. /_45'7/ providing for the amendment of Tukwila Municipal
Code Sections 11.60.050 and 11.60.060 relating to the compensation to be paid
the city for right -of -way vacation and fixing an effective date.
