HomeMy WebLinkAboutOrd 1547 - 1988 Uniform Building Code (Repealed by Ord 1842) 1908• CITY OF TUMILA WASHINGTON e q 6 AL 6 0 10 oA 159 ORDINANCE NO. /$/7 -12 0 AN ORDINANCE OF THE CITY OF TUKWILA, WASHINGTON, AMEND ING ORDINANCE 1393 AND CHAPTER 16.04 OF THE TUKWILA MUNICIPAL CODE AND ADOPTING THE UNIFORM BUILDING, PLUMBING, ENERGY, MECHANICAL, AND ABATEMENT OF DANGEROUS BUILDINGS CODES WITH AMENDMENTS. WHEREAS, RCW 19.27.031 mandates that the City Council update its building regulations by adopting the 1988 version of the Uniform Building, Plumbing, Energy, Mechanical, and Abatement of Dangerous Buildings Codes, and WHEREAS, it is in the interest of the public health, safety and welfare to regulate housing hazardous materials in buildings and structures, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASH- INGTON, DO ORDAIN AS FOLLOWS: Section 1. Adoption of the 1988 Uniform Building, Energy, Abatement of Dangerous Buildings, Mechanical and Plumbing Codes. Ordinance 1393 and Sections 16.04.010 and 16.04.030 are amended to read as follows: 16.04.010 Purpose of chapter. This chapter is enacted for the purpose of adopting rules and regulations for the protection of the health, safety and general welfare of the public governing the creation, construction, enlargement, conversion, alteration, repair, occupancy, use, height, court area, sanitation, ventilation and maintenance of any building used for human habitation. 16.04.030 Uniform codes adopted. The following codes are adopted and incorporated by reference as if fully set forth: (1) The Uniform Building Code, 1988 Edition, including Appendix chapters 11, 23 (Divisions I and II), 32, 35, 38, 49, 55, 57, 70, and Standards thereto as adopted by the International Conference of Building Officials. (a) Section 202(a), 1st Paragraph, of the Uniform Building Code, 1988 Edition as adopted by the city, is hereby amended to read as follows: (a) As directed by the Mayor or his /her designee, the Building Official is hereby authorized and directed to enforce all the provisions of this Code and other development laws which are applicable in the City. For such purposes, he shall have the powers of a law enforcement officer. Section 202(a) of the Uniform Building Code, 1988 Edition is amended to add paragraph 3 to include: For the purpose of administering and enforcing Appendix Chapter 70 of this Code the Director of Public Works is appointed and designated as the Building Official with respect to all matters contained within said Appendix Chapter 70. (b) Section 205 of the Uniform Building Code, 1988 Edition is amended to include: "Any person, firm, or corporation violating any of the provisions of this Code shall be deemed guilty of a misdemeanor, and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this Code is committed, continued, or permitted and upon conviction of any such violation such person shall be punishable by a fine of not more than $500 or by imprisonment for not more than 90 days, or by both such fine and imprisonment. Anyone concerned in the violation or failure to comply with the provisions of this Code, whether directly committing the act or effecting the omission constituting the offense or aiding or abetting the same whether present or absent; and anyone who directly or indirectly counsels, encourages, hires, commends, induces or otherwise procures another to violate or fail to comply with provisions of this Code is and shall be an offender under the terms of this Code and shall be proceeded against and prosecuted as such." (2) The Uniform Plumbing Code and the Uniform Plumbing Code Standards, 1988 Edition, published by the International Association of Plumbing and Mechanical Officials, as adopted or amended by King County, which King county Code is hereby included by reference. The Seattle -K County Plumbing Board of Appeals is hereby authorized to hear and determine all matters subject to appeal as specified in such Code. (3) The Washington State Energy Code, Chapter 51 -12 WAC, and all amendments thereto. (4) The Uniform Mechanical Code, 1988 Edition, including Chapter 22, Fuel Gas Piping, Appendix B, as published by the International Conference of Building Officials. (5) The Uniform Code for the Abatement of Dangerous Buildings, 1988 Edition, as adopted by the International Conference of Building Officials. Section 2. Deletion of Certain Sections. Sections 16.04.020, 16.04.055, 16.04.060, 16.04.070, 16.04,080, and 16.04.090 of the Tukwila Municipal Code are hereby deleted. Section 3. Severability. If any portion of this ordinance is found or rendered invalid or ineffective, all remaining provisions shall remain in full force and effect. Section 4. Effective Date. This ordinance or a summary thereof shall be published in the official newspaper of the City, and shall take effect and be in full force five (5) days after passage and publication as provided by law. A6 AN ORDINANCE OF THE CITY OF TUKWILA, WASHINGTON, AMENDING ORDINANCE NO. 1393 AND CHAPTER 16.04 OF THE TUKWILA MUNICIPAL CODE AND ADOPTING THE UNIFORM BUILDING, PLUMBING, ENERGY MECHANICAL, AND ABATEMENT OF DANGEROUS BUILDINGS CODES WITH AMENDMENTS. On /7, 9'9, the City Council of the City of Tukwila, passed Ordinance No. /25 which provides as follows: adopting the Uniform Building, Plumbing, Energy Mechanical and abatement of dangerous Buildings Codes with amendments. The full text of this ordinance will be mailed without charge to anyone who submits a written request to the City Clerk of the City of Tukwila for a copy of the text.
