AN ORDINANCE OF THE CITY OF TUKWILA, WASH-
INGTON, AMENDING SECTIONS 14.04.240(C) AND
14.16.030(1) OF THE TUKWILA MUNICIPAL CODE;
AMENDING ORDINANCE NO. 1407, I, SECTION 24(C)
AND AMENDING ORDINANCE NO. 1407, IV, SECTION
1(1), TO RAISE THE MAXIMUM LIMIT ON INCOME
NECESSARY FOR SENIOR CITIZENS AND DISABLED
PERSONS TO QUALIFY FOR REDUCED WATER AND
SEWER RATES; AND SETTING AN EFFECTIVE DATE.
WHEREAS, RCW 74.38.070 authorizes cities and towns to provide utility service to
low- income senior citizens at reduced rates; and
WHEREAS, RCW 84.36.381(b) sets the rate for combined disposable income at
fourteen thousand dollars or less; and
WHEREAS, the City Council desires to provide assistance to such eligible persons by
reducing the rates charged for City water and sewer services;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Ordinance No. 1407, I., Section 24(c), adopted the 17th day of November,
1986, is hereby amended to read as follows:
Section 24 (TMC 14.04.240(0 Rates for Metered Water.
(c) Every person sixty -two years of age or older (if married, then either spouse) and every
person totally and permanently disabled residing in a separately metered dwelling and
who is paying directly for such separately billed service either as owner, purchaser or
renter and whose individual disposable income if a single person, or whose combined
disposable income, if a married couple, from all sources is less than fourteen thousand
dollars per year, shall pay a rate equal to fifty percent of all water service charges.
Every such person shall file with the Finance Department their affidavit that he or she
is qualified to be charged the special rate. Such affidavits are to contain information as
required by the Finance Director in order to establish eligibility. Each affidavit will
also include an unqualified promise to inform the City of any changes in financial
condition that would disqualify the person for the special rates. The Finance Director
may require affidavits on an annual basis if deemed necessary.
Section 2. Ordinance No. 1407, IV, Section 1(1) adopted the 17th day of November,
1986, is hereby amended to read as follows:
Section 1 (TMC 14.16.030(1) Schedule of Charges
Rates and charges for sewage service furnished and available for use shall be paid by
the owner of the property and shall be as follows:
(1) Residential Sewage Service (single dwelling unit). A flat rate of four dollars and no
cents per month for each single family residence shall be charged. Every person sixty
two years of age or older (if married, then either spouse) and every person totally and
permanently disabled residing in a separately metered dwelling and who is paying
directly for such separately billed service either as owner, purchaser or renter and
whose individual disposable income if a single person, or whose combined disposable
income, if a married couple, from all sources is less than fourteen thousand dollars per
year, shall pay a rate equal to fifty percent of all sewer service charges. Every such

Section 3. Effective Date. This ordinance shall take effect and be in full force five (5)
days after its passage and publication of this ordinance or a summary thereof in the
official newspaper of the City, as provided by law.

On 1989, the City Council of the City of
Tukwila, pads ed Ordinance No. J5'I/® which provides as follows:
Amends Ordinance No. 1407, I, Section 24(c) raising the maximum limit
on disposable income of senior citizens and disabled persons to
$14,000 thereby allowing for reduced water and sewer rates; amends
Ordinance No. 1407,IV, Section 1(1) setting the allowable reduced
rates for sewer charges at fifty percent; and establishes an effective
date.
The full text of this ordinance will be mailed without charge to
anyone who submits a written request to the City Clerk of the City of
Tukwila for a copy of the text.
