ORDINANCE NO. 4-39
AN ORDINANCE OF THE CITY OF TUKWILA, WASHINGTON, PURSUANT TO
RCW 35A.14.330 AND RCW 35A.14.340 ADOPTING A COMPREHENSIVE LAND USE
POLICY PLAN AND PLAN MAP, ADOPTING ZONING REGULATIONS AND ADOPTING A
ZONING MAP TO PROVIDE FOR THE AREA DESCRIBED AS CASCADE VIEW
ANNEXATION AREA AND PROVIDC THAT SAID AREA SHALL BECOME SUBJECT TO
SAID ZONING REGULATIONS AND ZONING MAP UPON ANNEXATION TO THE CITY OF
TUKWILA
WHEREAS, a petition for annexation was received by the City of Tukwila for
the area known as Cascade View and more specifically described in Attachment A
hereto, and
WHEREAS, the petition was certified by the King County Prosecutors Office
as to form and by the Tukwila City Clerk for adequate number of signatures, and
WHEREAS, the City's SEPA responsible official made a determination on
July 24, 1989, that there will be no significant adverse environmental impact
as a result of the proposed annexation, and
WHEREAS, by Resolution No. 1112, the City of Tukwila approved the
annexation and provided, as requested by the petitioners, that the question of
annexation, together with the adoption of zoning and land use regulations,
should be submitted to the electorate following the adoption of pre annexation
zoning and land use regulations pursuant to RCW 35A.14.330 and 35A.14.340, and
WHEREAS, the Tukwila Planning Commission held a public hearing on a
Pre Annexation Zoning Map and Comprehensive Land Use Policy Plan Map for the
area on August 10, 1989, and adopted recommendations to the City Council on
August 24, 1989, and
WHEREAS, the Tukwila City Council has held two public hearings on
September 11, 1989, and October 16, 1989, has reviewed the Planning Staff's
file and has considered the Planning Commission's recommendations,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Area Affected. The area subject to this Ordinance is known as
Cascade View Annexation Area and is as described in Attachment A hereto.
Section 2. Comprehensive Policy Plan Map Amended. The area described in
Attachment A hereto is declared to be within the City of Tukwila's planning
area and the City of Tukwila Comprehensive Land Use Policy Plan is hereby
adopted for such area and the Plan Map is hereby amended to include the area
described in Attachment A with comprehensive plan designations as shown on
Attachment B hereto.
Section 3. Zoning Code and Map Adopted Upon Annexation. At such time as
the area described in Attachment A or any part thereof shall be annexed to the
City of Tukwila, the City Council may provide in the annexation ordinance that
so much of said area as is thereby annexed shall be subject to the Zoning Code
of the City of Tukwila and to the Zoning Map shown in Attachment C hereto,
said Zoning Map and Zoning Regulations herein adopted to be an extension to
the Zoning Regulations for the City of Tukwila.

Section 4. Filing. A certified copy of this Ordinance shall be filed in
the offices of the King County Department of Records and Elections.
Section 5. Effective Date. This Ordinance shall be in force and effect
five days after publication of the attached Summary which is hereby approved.

Commencing at a point on the south line of the northwest quarter
of Section 22. T23N, R4E. W.M., which lies 957.2 feet east of the
west 1/4 corner og said Section;
thence North 18` East along the centerline of Pacific
Highway South 20.88 feet to an intersection with the easterly
extension of the north margin of South 152nd Street, said
intersection being the TRUE POINT OF BEGINNING;
thence North 88 West along said easterly extension and
continuing westerly along said north margin to the east margin of
Military Road South;
thence northwesterly along said east margin to the east margin of
24th Avenue South;
thence northerly along said east margin to the south margin of
South 116th Way;
thence east along said south margin to the west margin of Pacific
Highway South (State Rd. No.1);
thence northerly along said west margin to the thread of the
Duwamish River;

On c 7 to 1989, the City Council of the City of Tukwila passed
Ordinance'No. "6-s9 providing for an amendment to the Comprehensive Plan
Map and Pre Annexation Zoning and Land Use Regulation for Cascade View to
become effective in the event of annexation and providing for an effective
date.
The full text of this ordinance will be mailed without charge to anyone
who submits a written request to the City Clerk of the City of Tukwila for a
copy of the text.
