A`6 y AN ORDINANCE OF THE CITY OF TUKWILA, WASHINGTON, ENACTED PURSUANT TO RCW 35A.14, ANNEXING AN UNINCORPORATED ISLAND OF TERRITORY WITHIN THE CITY, CONTAINING APPROXIMATELY THREE ACRES AND LOCATED GENERALLY AT SOUTH 139th STREET AND 53RD AVENUE SOUTH, AND FIXING THE EFFECTIVE DATE OF ANNEXATION WHEREAS, that parcel of real property generally located at South 139th Street and 53rd Avenue South, consisting of five (5) single family residences, more particularly described in Exhibit A attached hereto and by this reference incorporated herein, lies entirely within the boundaries of the City of Tukwila; and WHEREAS, the unincorporated area described in Exhibit A contains less than one hundred (100) acres, to wit, approximately three (3) acres; and WHEREAS, the City's SEPA Responsible Official has made a determination of nonsignificance; and WHEREAS, by Resolution No. 1110 dated July 17, 1989, the City Council proposed annexation of said area and set a public hearing thereon on August 7, 1989; and WHEREAS, the surrounding area was annexed without requiring the assumption of the City's outstanding indebtedness; and WHEREAS, upon due and proper notice posted and published, the City Council, pursuant to RCW 35A.14.297, held a public hearing on August 7, 1989, and determined that said annexation should be approved; and WHEREAS, it is in the best interests of the City of Tukwila and the residents of the territory described in Exhibit A for it to become annexed to the City of Tukwila; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Annexation. The territory described in Exhibit A attached hereto and incorporated herein situated in King County, Washington, and lying within the boundaries of the City of Tukwila, Washington, is hereby annexed to and incorporated in the City of Tukwila. Section 2. Assumption of Indebtedness. The property within the territory annexed hereby shall not be required to assume through assessment or taxes any indebtedness, bonded or- otherwise, contracted prior to or existing as of the effective date of the annexation. Section 3. Effective Date of Annexation. The area described in Exhibit A shall become a part of the City of Tukwila on September 22, 1989. Notice of the effective date of annexation together with a description of the area annexed shall be published as required by RCW 35A.14.297. Section 4. Effective Date of Ordinance. EXHIBIT A A parcel of land situate in the southwest 1/4 of Section 14, T23N, R4E, W.M., being a portion of the Stephen Foster Donation Claim No. 38 more particularly described as follows: Commencing at a point being the intersection of the centerline of 53rd Avenue South with the centerline of South 139th Street (Also known as the north line of Colegrove's Acre Tracts as recorded in Volume 11, Page 85 of Plats, Records of King County, Washington); thence easterly along said north line 20 feet to the TRUE POINT OF BEGINNING, said point being on the east margin of 53rd Avenue South; thence easterly along said centerline of South 139th Street as platted in Hillman's Seattle Garden Tracts, as recorded in Volume 11 of Plats, Page 24, Records of King County, 492.8 feet to a point that is 1069.80 feet east of the west line of said Section 14; thence North 45 49'00" West, 39.53 feet; thence North 45 West, 323.74 feet; thence West, 236.08 feet to the easterly margin of 53rd Avenue South; thence South 00 East along said easterly margin to the TRUE POINT OF BEGINNING. EXHIBIT A Page SUMMARY OF ORDINANCE NO. /sad, AN ORDINANCE OF THE CITY OF TUKWILA, WASHINGTON, ENACTED PURSUANT TO RCW 35A.14, ANNEXING AN UNINCORPORATED ISLAND OF TERRITORY WITHIN THE CITY, CONTAINING APPROXIMATELY THREE ACRES AND LOCATED GENERALLY AT SOUTH 139th STREET AND 53RD AVENUE SOUTH, AND FIXING THE EFFECTIVE DATE OF ANNEXATION On August 7, 1989, the City Council of the City of Tukwila passed Ordinance No. /6 which provides as follows: Annexes to the City of Tukwila the property described as of September 22, 1989, and provides for an effective date. The full text of this ordinance will be mailed without charge to anyone who submits a written request to the City Clerk of the City of Tukwila for a copy of the text.
