AN ORDINANCE OF THE CITY OF TUKWILA, WASHINGTON, AUTHORIZING THE
RECOVERY OF COSTS ASSOCIATED WITH HAZARDOUS MATERIALS INCIDENT
RESPONSE AND CLEANUP WITHIN THE CITY OF TUKWILA RESPONSE AREAS.
WHEREAS, there are occasions when hazardous wastes are transported through the
City of Tukwila, and
WHEREAS, there is a certain recognized risk of a hazardous materials incident
during transportation, and
WHEREAS, persons transporting hazardous materials through the City should be
responsible for cleanup and costs associated with such incidents and the laws of the
State of Washington so provide, and
WHEREAS, the Tukwila Fire Department is the appropriate agency to have
jurisdiction over such incidents,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN
AS FOLLOWS:
Section 1. Hazardous Materials Cleanup. Any person transporting hazardous
materials shall clean up any hazardous materials incident that occurs during
transportation, and shall take such additional action as may be reasonably necessary
after consultation with the Tukwila Fire Department in order to achieve compliance
with all applicable federal and state laws and regulations.
Section 2. Liability for Extraordinary Costs. Any person responsible for
causing the hazardous materials incident, other than operating employees of the
transportation company involved in the incident, is liable to the City of Tukwila
for extraordinary costs incurred by the City of Tukwila in the course of protecting
the public from actual or threatened harm resulting from the hazardous materials
incident.
Section 3. Extraordinary Costs Defined. "Extraordinary costs as used in this
ordinance, means those reasonable and necessary costs incurred by the City of
Tukwila in the course of protecting life and property that exceed the normal and
usual expenses anticipated for police and fire protection, emergency services, and
public works. These shall include, but not be limited to, overtime for city
employees, unusual fuel consumption requirements, any loss or damage to city owned
equipment, and the purchase or lease of any special equipment or services required
to protect the public during the hazardous materials incident.
Section 4. Effective Date. This ordinance shall be in force and effect five
days after publication of the attached Summary which is hereby approved.

Ordinance No Z i providing for hazardous materials cleanup, liability
for costs, a definiti6n of costs, and an effective date.
The full text of this ordinance will be mailed without charge to anyone
who submits a written request to the City Clerk of the City of Tukwila for a
copy of the text.
