ORDINANCE NO.
AN ORDINANCE OF THE CITY OF TUKWILA, WASHINGTON, AMENDING
SECTIONS 21.04.310 (1) OF TUKWILA MUNICIPAL CODE TO EXEMPT
ANNEXATION PROPOSALS FROM THE ENVIRONMENTAL CHECKLIST REVIEW
FEE.
WHEREAS, Section 21.04.310 (1) of the Tukwila Municipal Code
requires the proponent of any proposal which requires
environmental review to pay a $100 fee to the City to cover the
cost of reviewing the environmental checklist, and
WHEREAS, The City Council has determined that charging a fee
for checklist review to proponents of annexations may run counter
to the Council's intention, expressed in its annexation policies,
to strongly encourage annexation, and
WHEREAS, annexation is a matter of city -wide concern and
benefit and the Council therefore believes that the City should
provide review of environmental checklists for annexation free of
charge, now, therefore,
THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON DO
ORDAIN AS FOLLOWS:
Section 1. Checklist fee. Section 21.04.310 (1) of the
Tukwila Municipal Code is hereby amended to read as follows:
(1) Threshold Determination. For every environmental
checklist the City will review when it is lead agency, the
City shall collect a fee of $100 from the proponent of the
proposal prior to undertaking the threshold determination,
provided, that no fee shall be charged to or collected from
the proponents of any proposal for annexation to the City
and the City shall review such checklists without charge.
Where payment of a fee is required, the time periods
provided by this Chapter for making a threshold
determination shall not begin to run until payment of the
fee is received by the City.
Section 2. Severability. If any section, sentence, clause
or phrase of this ordinance should be held to be invalid or
unconstitutional by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity
or constitutionality of any other section, sentence, clause or

phrase of this ordinance.
Section 3. Effective Date. This ordinance shall take
effect and be in full force five (5) days after publication of
the attached summary which is hereby approved.

AN ORDINANCE OF THE CITY OF TUKWILA, WASHINGTON, AMENDING
SECTION 21.04.310 (1) OF TUKWILA MUNICIPAL CODE TO EXEMPT
ANNEXATION PROPOSALS FROM THE ENVIRONMENTAL CHECKLIST REVIEW
FEE.
On i 7 1987, the City Council of the City of
Tukwila passed Ordinance No. which provides as
follows:
Section 1. Amends Section 21.04.310 (1) of the Tukwila
Municipal Code to exempt annexation proposals from the
environmental checklist review fee.
Section 2. Provides for severability.
Section 3. Establishes an effective date.
The full text of this ordinance will be mailed without charge
to anyone who submits a written request to the City Clerk of the
City of Tukwila for a copy of the text. APPROVED by the City Council at their meeting of X)73 4¢►
