REPEALED Secti©ri(s) Repealed Repealed by Card 2468 s �N11LA. q�s� ",�J:�•� .,S rr C ity T kwila of u Washington Ordinance No. r9 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, AMENDING ORDINANCE NO. 663, AS CODIFIED AT TMC 2.64.020 AND TMC 2.64.070, RELATING TO THE SALE OF CITY PROPERTY AND THE NEGOTIATION OF BIDS; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, due to various circumstances it may at times be in the best interests of the City of Tukwila and its citizens to sell City property at less than its appraised value; and WHEREAS, the costs associated with maintaining certain City property, as well as other costs not considered to be a part of the property itself, are often very expensive or burdensome to the City or to a potential purchaser; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. TMC 2.64.020 Minimum Price Set. Tukwila Municipal Code Section 2.64.020, Minimum Price Set, is hereby amended to read as follows: Subsequent to receipt of an assessment of the value of the property, the Council shall fix a minimum price at which such may be sold. No bid shall be deemed acceptable that does not meet the minimum price fixed by the Council. Section 2. TMC 2.64.070 Amended. Tukwila Municipal Code Section 2.64.070, Unacceptable bids Negotiation of bids, is hereby amended to read as follows: In the event no bids, prel isfactory bi ds, have been received pursuant to the method outlined in this chapter, or in the event the al value of the property is less than $500.00, then the Mayor and City Council may receive or negotiate bid e to the sale of such property. Section 3. Severability. If any section, subsection, paragraph, sentence, clause or phrase of this ordinance or its application to any person or situation should be held to be invalid or unconstitutional for any reason by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this ordinance or its application to any other person or situation. Section 4. Effective Date. This ordinance or a summary thereof shall be published in the official newspaper of the City, and shall take effect and be in full force and effect five (5) days after passage and publication as provided by law. On June 4, 2001, the City Council of the City of Tukwila passed Ordinance No.1958, relating to the sale of city property; establishing a process to determine a minimum price through an assessment; clarifying the intent of an acceptable /unacceptable bid process; providing for severability; and establishing an effective date.
